This study aims to analyze the criminal liability of the press in the use of Artificial Intelligence (AI) for news writing based on the Press Law and the Second Amendment ITE Law. The use of AI in the world of journalism poses legal challenges related to liability for the news produced, especially if the news violates the law such as spreading hoaxes or misleading information. The method used in this study is normative legal research, which examines applicable legal regulations, as well as journalistic ethical principles in relation to AI. The study identifies who is criminally responsible if news generated by AI breaks the law, as well as explores potential ethical violations that may arise due to inaccuracies in information published by AI. The results of the study show that although the Press Law provides for press freedom, criminal responsibility remains on media that use AI in news production. In addition, the Second Amendment of the ITE Law emphasizes criminal sanctions for perpetrators who disseminate harmful electronic information, including fake news produced with AI. This study also found that the implementation of the Journalistic Code of Ethics (KEJ) is a big challenge, considering that AI cannot always meet journalistic ethics standards that prioritize truth, balance, and objectivity. This study suggests that there should be clearer regulations regarding the use of AI in journalism to maintain public trust and avoid violations of the law that have the potential to harm society.
