From a legal perspective, the development of digital platforms demands regulations that balance the protection of creators' exclusive rights with legal certainty for digital service providers. However, copyright regulations in Indonesia do not explicitly regulate the safe harbor principle and notice and takedown mechanism as implemented in the United States' Digital Millennium Copyright Act (DMCA). This study aims to analyze the adoption of the safe harbor principle and notice and takedown mechanism in the Indonesian copyright legal system and examine their implications for TikTok content creators in Indonesia. This study uses a normative juridical method with a statutory and comparative legal approach through a review of the Copyright Law, the Electronic Information and Transactions Law (ITE Law), and the DMCA. The results show that the lack of explicit regulations regarding platform liability protection and content removal procedures leads to legal uncertainty in handling digital copyright infringement. This study contributes to providing recommendations for strengthening Indonesian copyright regulations by regulating notice and takedown mechanisms and safe harbor principles that are adaptive to developments in digital technology.
