This study aims to analyze the factors that hinder and support the change from conventional land title certificates to electronic certificates and examine the normative conditions of electronic certificates in providing certainty and legal protection. This study uses a normative legal research method with a statutory and conceptual approach. This study departs from the existence of normative ambiguity in the use of the phrase can be done electronically as contained in Article 84 paragraph (1) of “Government Regulation Number 18 of 2021 and Article 2 paragraph (2) of the Regulation of the Minister of ATR/Head of BPN Number 1 of 2021 concerning Electronic Certificates, which gives the impression of a dualism of the legal system in regulating land title certificates between conventional and electronic systems. The results of the study indicate that the change from the land registration system to electronic certificates is part of an effort to modernize land services aimed at increasing efficiency, transparency, and legal protection. However, its implementation still faces various obstacles, such as limited infrastructure, the digital divide, minimal socialization, and unclear norms that lead to legal uncertainty and the degradation of the evidentiary power of electronic certificates, which only serve as valid evidence but do not yet have the full evidentiary power of conventional certificates. Therefore, norm reconstruction and regulatory harmonization are needed to clarify the legal basis, strengthen the validity of evidence, and realize electronic certificates that provide certainty and legal protection. Penelitian ini bertujuan untuk menganalisis faktor-faktor yang menghambat dan mendukung perubahan sertifikat hak atas tanah konvensional menuju sertifikat elektronik serta mengkaji kondisi normatif sertifikat elektronik dalam memberikan kepastian dan perlindungan hukum terhadap kepemilikan hak atas tanah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Penelitian ini beranjak dari adanya kekaburan norma dalam penggunaan frasa ‘‘dapat dilakukan secara elektronik’’ sebagaimana termuat dalam Pasal 84 ayat (1) Peraturan Pemerintah Nomor 18 Tahun 2021 dan Pasal 2 ayat (2) Peraturan Menteri ATR/Kepala BPN Nomor 1 Tahun 2021 tentang Sertifikat Elektronik, yang menimbulkan kesan adanya dualisme sistem hukum dalam pengaturan sertifikat hak atas tanah antara sistem konvensional dan sistem elektronik. Hasil penelitian menunjukkan bahwa perubahan sistem pendaftaran tanah menuju sertifikat elektronik merupakan bagian dari upaya modernisasi pelayanan pertanahan yang bertujuan meningkatkan efisiensi, transparansi, dan perlindungan hukum bagi pemegang hak atas tanah. Namun, implementasinya masih menghadapi berbagai hambatan, seperti keterbatasan infrastruktur, kesenjangan digital, minimnya sosialisasi, serta kekaburan norma yang menyebabkan ketidakpastian hukum dan terdegradasinya kekuatan pembuktian sertifikat elektronik yang hanya berstatus sebagai alat bukti yang sah, tetapi belum memiliki kekuatan pembuktian sempurna sebagaimana sertifikat konvensional”. Oleh karena itu, diperlukan rekonstruksi norma dan harmonisasi regulasi untuk memperjelas dasar hukum, memperkuat validitas pembuktian, serta mewujudkan sertifikat elektronik yang memberikan kepastian dan perlindungan hukum bagi pemegang hak atas tanah di Indonesia.
