This study analyzes Supreme Court Decision No. 1341 K/Pdt.Sus-PHI/2024 concerning the settlement of disputes over unilateral termination of employment by employers in cases involving employees’ refusal of job transfers, along with its legal implications. The issue arises from the tension between employers’ prerogative rights to implement workforce transfers and the protection of employees’ rights within the framework of Indonesian labor law. This research employs a normative juridical method with a case approach, utilizing secondary data obtained through literature and document studies, which are analyzed qualitatively. The findings indicate that the Supreme Court’s decision is legally justified, as it aligns with Article 163(1) of Law No. 13 of 2003 on Manpower and Article 52(1) of Government Regulation No. 35 of 2021. The decision reflects a balanced approach by recognizing the employer’s authority to conduct lawful transfers while ensuring fair compensation for employees based on their length of service. Furthermore, the legal consequence of the decision confirms that the employment relationship is terminated due to the refusal to comply with a legitimate transfer order, thereby obligating the employer to fulfill employees’ entitlements in accordance with prevailing labor regulations. This study contributes to the development of labor law by clarifying the legal boundaries of transfer policies and their implications for the legitimacy of unilateral termination of employment in industrial relations disputes.
