Abstract

Indonesia's maritime security governance currently faces a crisis stemming from institutional fragmentation and overlapping jurisdictions among law enforcement agencies, which triggers operational inefficiency, high-cost governance, and legal uncertainty at sea. This article aims to formulate a maritime governance blueprint that synthesizes the law enforcement mandates of the 1982 UNCLOS with local constitutional wisdom to permanently resolve these conflicts of institutional ego. This research is systematically structured utilizing a normative-juridical methodology through statutory, conceptual, and comparative approaches. The analysis reveals that this crisis constitutes a collision of norms, the resolution of which necessitates the operationalization of Pancasila as a meta-legal framework or Grundnorm. The fundamental values of Pancasila must be transmuted into maritime institutional engineering, encompassing a single-door inspection mechanism, functional integration under a unified command, and collaborative governance. Operationally, this framework demands execution either through a legislative approach (an Omnibus Law scheme) or via Judicial Review at the Constitutional Court. This article contributes a Global South paradigm, demonstrating that the rule of law at sea can be achieved by coherently domesticating international standards into the mechanics of local constitutional law.
