Artificial Intelligence (AI) has made legal practice easier, especially when it comes to drafting agreements. AI can be used to identify hazards, generate terms, examine contracts, and offer suggestions about the content of contracts. But using AI also brings up legal questions about the legality of contracts, the legal standing of AI, and the parties' liabilities. In accordance with Article 1320 of the Indonesian Civil Code, this study will examine the legality of contracts that incorporate AI. It will also examine the current state of AI and the effects of its application on the parties' rights, responsibilities, and liabilities under Article 1338 of the Indonesian Civil Code. Legal materials are evaluated using a descriptive-qualitative method, and the study uses a normative-juridical approach that makes use of statutory and conceptual approaches. The results show that, as long as the four conditions for a legal agreement are satisfied, the employment of AI does not automatically make an agreement void. While humans or legal entities acting as legal subjects retain power, binding force, and legal culpability, AI is better viewed as an assisting tool. Therefore, in order to guaranty legal certainty and the protection of the parties involved, the deployment of AI necessitates human evaluation and monitoring.
