Abstract

As a public official, a notary has the authority to draft authentic deeds that possess authentic evidentiary value. However, in practice, issues often arise where deeds become legally defective due to false data or information provided by the applicant. This paper addresses the issue of a notary's liability regarding deeds that are legally defective as a result of such false data. The research employs a normative legal methodology utilizing statutory and conceptual approaches, supported by primary, secondary, and tertiary legal materials. The analysis indicates that a notary's liability is, in principle, limited to the formal veracity of the deed, whereas material veracity remains the responsibility of the parties involved. While a deed based on false data may be legally defective and subject to annulment, a notary can be held liable if proven negligent or if they failed to exercise due care in the performance of their duties.
