Fakultas Hukum Universitas Brawijaya rositanosia@gmail.com Abstraksi Universitas Brawijaya adalah salah satu pemegang paten terbanyak di Indonesia. Berdasarkan Pasal 20 Undang – undang No. 13 Tahun 2016 tentang Paten, Pemegang Paten wajib membuat produk atau menggunakan proses di Indonesia. Hal tersebut harus menunjang transfer teknologi, penyerapan investasi dan/atau penyediaan lapangan kerja. Pasal tersebut merupakan pengaturan lanjutan dari prinsip dapat diterapkan di industri. Agar paten tersebut dapat diterapkan di industri, maka diperlukan komersialisasi paten oleh pemegang paten. Namun dalam prakteknya, Universitas Brawijaya belum melaksanakan komersialisasi sesuai dengan ketentuan pasal tersebut. Padahal komersialisasi dapat bermanfaat bagi masyarakat dan membantu Universitas Brawijaya dalam membayar biaya pemeliharaan tahunan. Jika ditinjau dari teori efektivitas hukum, secara substansi Undang – undang No. 13 Tahun tentang paten tidak ada pertentangan dengan peraturang perundang – undangan lain baik secara horizontal maupun vertikal. Namun, secara struktur Universitas Brawijaya masih berstatus Badan Layanan Umum sehingga mempersulit dalam mengurus perizinan. Selain itu, budaya hukum di Universitas Brawijaya adalah mendaftarkan paten masih dilandasi untuk akreditas fakultas maupun universitas dan kenaikan pangkat, belum melihat dari segi bisnisnya. Sehingga tingkat kesiapan teknologi paten yang didaftarkan rendah. Zairul Alam, SH., MH. Faculty of Law Universitas Brawijaya rositanosia@gmail.com  ABSTRACT Universitas Brawijaya is known to hold the highest number of patents in Indonesia. According to Article 20 of Law Number 13 of 2016 on Patent, a patent holder is highly required to create products or implement process in Indonesia. This action should also support transfer of technology, investment, and provide job vacancies. The Article is the regulation following the principles that can be applied in industries. The implementation of patent in industries certainly requires patent commercialisation by the patent holder. However, in the practice, Universitas Brawijaya has not implemented the commercialisation based on the provision of the Article. In fact, this step is seen useful for society and it could also help with yearly maintenance cost needed by Universitas Brawijaya. Seen from the perspective of the effectiveness of law, in a substantial way, the Law Number 13 of 2016 on Patent is not irrelevant to other laws either horizontally or vertically. However, since the status of the university is as General Services Body, it creates hindrance in terms of the process required in licensing. Moreover, it has been the culture that licensing always takes the accreditation of faculties and university and position promotion in the university as the prerequisite, overlooking the business aspects.
