NIKAH ANTARAGAMA MENURUT MUHAMMAD QURAISH SHIHAB

Abstract

Emphasis;Ulama in various regions of the world have different opinions to interpret QS. Al-Maidah [5]: 5, QS. Al-Baqarah [2]: 221, and QS. Al- Mumtahanah [60]: 10. These verses discuss the issue of interfaith marriage. In Indonesia there is expert leading commentator of the Qur'an whose opinions are followed by the public, namely M. Quraish Shihab. According to him, a muslim is allowed to marry the woman of ahl al-kitab by QS. Al-Maidah [5]: 5. While QS. Al-Baqarah [2]: 221 which prohibits the marriage of a muslim with idolatrous women and vice versa, talked about the idolatrous only. Quraish said, ahl al-kitab is not included in the scope of idolaters, because ahl al-kitab include only two classes; Jews and Christians, anytime, anywhere and from any descendant. Therefore, until now muslim men are allowed to marry Jewish and Christian women. While the marriage between muslim women with men idolaters is forbidden according to the QS. Al-Baqarah [2]: 221. Regarding the marriage of muslim women with men of ahl al-kitab, al-Qur'an does not explicitly explain. However, according to Quraish, it does not mean there is permissibility to marry men of ahl al-kitab. The reason is if al-Qur'an allows it, absolutely QS. Al-Ma'idah: 5 allowing to marry women of ahl al- kitab, will confirm it. This opinion is supported by QS. Al-Mumtahanah [60]: 10 which prohibits a muslim woman to marry and unbeliever man.Keywordsm a r r i a g e , m u s l i m s , unbeliever, ahl al-kitab, idolatrous. Ulama di berbagai wilayah dunia berbeda pendapat ketika memaknai QS. Al- Maidah [5]:5, QS. Al-Baqarah [2]:221, dan QS. Al-Mumtahanah [60]:10. Ayat- ayat itu membicarakan persoalan nikah antaragama. Di Indonesia terdapat pakar tafsir al-Qur'an terkemuka yang pendapatnya banyak diikuti masyarakat, yaitu M. Quraish Shihab. Menurutnya, seorang pria muslim dibolehkan kawin dengan wanita ahl al-kitab berdasarkan QS. Al-Maidah [5] :5. Sedangkan QS. Al-Baqarah [2]: 221 yang melarang perkawinan seorang pria muslim dengan wanita musyrik maupun sebaliknya, hanya berbicara tentang musyrik. Dalam pandangan Quraish, ahl al-kitab tidaklah termasuk dalam cakupan musyrik, karena ahl al-kitab mencakup dua golongan saja; Yahudi dan Nasrani, kapanpun, di manapun dan dari keturunan siapapun. Oleh karena itu, sampai sekarang pun pria muslim dibolehkan menikahi wanita Yahudi dan Nasrani, tidak dengan selain keduanya. Sedangkan perkawinan antara wanita muslim dengan pria musyrik, adalah diharamkan, sesuai dengan QS. Al-Baqarah [2]: 221. Mengenai pernikahan wanita muslimah dengan pria ahl al-kitab, al-Qur'an tidak menjelaskannya secara tegas. Meskipun demikian, menurut Quraish, itu bukan berarti ada kebolehan menikahi pria ahl al-kitab. Hal ini karena, jika al-Qur'an membolehkannya, tentunya QS. Al-Ma'idah [5]: 5 yang membolehkan menikahi wanita ahl al- kitab, pun akan menegaskannya. Pendapatnya ini diperkuat pula dengan QS. Al-Mumtahanah [60]: 10 yang melarang seorang wanita muslim menikah dengan pria kafir.
