Fakultas Hukum, Universitas Brawijaya galangwandiro@gmail.com  ABSTRAK Pertimbangan Hukum Hakim terhadap pemusnahan barang bukti Harimau Sumatera dalam tindak pidana pasal 21 UU no 5 tahun 1990 dengan putusan pengadilan, pilihan tema dipengaruhi oleh adanya penanganan terhadap bukti dalam bentuk bagian dari satwa liar yang dilindungi, yang memiliki kekuatan hukum tetap dengan putusan Pengadilan dan didasarkan pada pertimbangan hukum hakim sebagai perwujudan asas legalitas, di atas berdasarkan UU No. 5 tahun 1990 tentang konservasi sumber daya alam, ekosistem dan Keanekaragaman Hayati.Tapi penanganan bukti yang mengabaikan manfaat atas bukti perlindungan satwa liar di sini dengan bagian-bagiannya. Ketentuan-ketentuan ini tercermin dalam Undang-Undang Dasar 1945 Indonesia di mana sumber daya alam yang dimiliki dan berlokasi di Indonesia digunakan dan untuk kemakmuran rakyat. Dari hasil penelitian dengan metode di atas, penulis mendapat jawaban atas permasalahan yang terkait dengan penanganan satwa liar yang dilindungi bukti Harimau Sumatera dan bagian-bagiannya diawali dari: (1) pertimbangan hukum hakim; (2) unsur-unsur pelanggaran pidana terhadap satwa liar yang dilindungi; dan (3) prinsip kemanfaatan. Kata Kunci: Hewan Terancam Punah, Harimau Sumatra, UU 5 Tahun 1990 ABSTRAK The legal Considerations Result destruction of criminal acts With the exhibits of the Sumatran tiger (Panthera tigris sumatrae), the choice of theme is effected by the presence of handling against evidence in the form of parts of protected wildlife, which has the force of law remains with the Court ruling and is based upon consideration of the law the judge as the embodiment of the principle of legality, above based on Act No. 5 of year 1990 concerning conservation of natural resources, the ecosystem and Biodiversity.But the handling of evidence that ignore the benefit over evidence protected wildlife here with its parts.These provisions are reflected in the Indonesia Constitution of 1945 in which the natural resources owned and located in Indonesia used and utilized for the prosperity of the people. Of research results with the method above, the author gets answers to problems related to the handling of evidence protected wildlife Sumatran tigers and their parts beginning of: (1) the principle of expediency; (2) the elements of a criminal offence against protected wildlife; and (3) the freedom of a judge in a lawsuit by observing the disconnected elements of benefit over evidence in the form of parts of protected wildlife which is based on the principle of legality.
