<![CDATA[Alvino Bimo Sayogo, Ngesti Dwi Prasetyo, S.H., M.Hum., Ibnu Sam Widodo, S.H., M.H Fakultas Hukum Universitas Brawiaya Email : alvinobimo59@gmail.com  ABSTRAK Presidential threshold adalah salah satu syarat pencalonan presiden yang bertujuan untuk memberikan posisi dukungan kuat untuk pemerintah dihadapan DPR. Akan tetapi penggunaan perolehan suara pemilihan umum sebelumnya menimbulkan kekhawatiran akan relevansi penggunaan perolehan suara itu terhadap posisi tawar pemerintah. Penyebabnya model penggunaan perolehan suara semacam ini sudah tidak lagi relevan dengan pilihan dan dukungan masyarakat yang dinamis. Beberapa permohonan kepada Mahkamah Konstitusi telah diajukan berkaitan dengan masih dimuatnya syarat ini dalam pemilihan umum serentak. Keetidakpercayaan terhadap relevansi perolehan suara dianggap hanya sebagai permainan politis untuk melanggengkan kekuasaan partaipartai besar saja. Kata Kunci: Presidential Treshold, Pemilihan Umum, Syarat pencalonan presiden, dan Kedaulatan rakyat ABSTRACT The presidential threshold is required for those involved in the presidential candidacy aimed to allow them to have a strong position and the great number of followers for the government before the House of Representatives. However, the use of the votes gained from the general election has sparked apprehensiveness over the relevance of the use of the votes gained towards the bargaining position of the government. This situation emerges because this method of voting is no longer relevant to the dynamic preference of the societies. Some proposals have been submitted to Constitutional Court regarding the fact that this requirement still applies in general election held simultaneously. Lack of trust towards the relevance of the votes gained seems to be a political way done to give opportunities to bigger parties.
