IMPLEMENTASI PASAL 5 HURUF a PERATURAN DAERAH KABUPATEN BADUNG NOMOR 2 TAHUN 2012 TENTANG KEPARIWISATAAN TERHADAP USAHA BAR “BALI JOE”

Fakultas Hukum Universitas Brawijaya   ABSTRAK Kepariwisataan merupakan salah satu hal terpenting di dalam suatu daerah karena merupakan salah satu dari sumber pendapatan daerah. Salah satu daerah pariwisata di Indonesia yang paling pesat perkembangan pariwisatanya adalah Provinsi Bali tepatnya di Kabupaten Badung. Segala kegiatan kepariwisataan harus mematuhi prinsip-prinsip yang telah ditetapkan pada Peraturan Daerah Kabupaten Badung Nomor 2 Tahun 2012 tentang Kepariwisataan. Keberadaan Bali Joe Bar sangat melanggar prinsip-prinsip kepariwisataan yang tertulis dalam pasal 5 huruf a Peraturan Daerah Kabupaten Badung Nomor 2 Tahun 2012 tentang Kepariwisataan karena Bali Joe Bar sendiri dikhususkan untuk kaum homoseksual sedangkan di dalam kehidupan beragama di Indonesia, hubungan sesama jenis sangat dilarang. Penelitian ini akan membahas mengenai bagaimana implementasi Pasal 5 huruf a Peraturan Daerah Kabupaten Badung Nomor 2 Tahun 2012 tentang Kepariwisataan terhadap usaha bar “Bali Joe”. Dalam penelitian ini juga akan dibahas bagaimana dampak dari usaha bar “Bali Joe” terhadap sektor pariwisata Kabupaten Badung. Kata Kunci: Kepariwisataan, Prinsip-Prinsip Kepariwisataan, Usaha Bar  ABSTRACT Tourism is always considered important since it contributes to regional revenue of a region. Bali is one of the provinces in Indonesia that is experiencing growth in its tourism Industry, especially in Badung. However, all tourism-related activities must abide by the principles set in Regional Regulation of the Regency of Badung Number 2 of 2012 concerning Tourism. Bar called Bali Joe is found to break the tourism principles stipulated in Article 5 letter a of Government Regulation of the Regency of Badung Number 2 of 2012 concerning Tourism since this bar is open only for homosexuals. This principle is obviously against the principles of Islamic religion which the majority of the people of Indonesia follow and homosexuality is obviously forbidden by the religion. This research is mainly focused on the discussion over how is the Article 5 letter a of Regional Regulation of the Regency of Badung Number 2 of 2012 concerning Tourism implemented regarding Bali Joe Bar business? In addition, this research also dealt with the impacts of the bar business on tourism industries in the Regency of Badung. Keywords: Tourism, Tourism Principles, Bar Business
