UPAYA DIREKTORAT JENDERAL KEKAYAAN INTELEKTUAL DALAM MEMBERIKAN PERLINDUNGAN HUKUM INDIKASI GEOGRAFIS TERHADAP SUMBER DAYA ALAM DI INDONESIA (Studi di Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan HAM)

Abstract

Fakultas Hukum, Universitas Brawijaya apriyanifeby17@gmail.com   ABSTRAK Penelitian ini bertujuan untuk mengetahui upaya Direktorat Jenderal Kekayaan Intelektual (DJKI) dalam memberikan perlindungan hukum indikasi geografis terhadap sumber daya alam di Indonesia. Menurut dаtа  dаri Beritа Resmi Indikаsi Geogrаfis yаng dipublikаsikаn DJKI Kemenkumhаm, sааt ini Indonesiа hаnyа memiliki  65 produk kekаyааn khаs dаri dаerаh yаng sudаh memiliki sertifikаsi Indikаsi Geogrаfis (IG). Jumlаh tersebut terkumpul sejаk dibuаtnyа perundаngаn perlindungаn IG yаng tercаntum dаlаm Perаturаn Pemerintаh (PP) Nomor 51 Tаhun 2007 tentаng Indikаsi Geogrаfis.  Jumlаh permohonаn disetiаp tаhunnyа jugа hаnyа 10 sаmpаi 16 permohonаn. Disisi lаin Direktur Jenderаl Kekаyааn Intelektuаl (Dirjen KI), Freddy Hаrris, menаrgetkаn 1000 pendаftаrаn Indikаsi Geogrаfis (IG) sebаgаi аset kekаyааn intelektuаl unggulаn Indonesiа dаlаm empаt tаhun ke depаn. Bаnyаknyа potensi Sumber Dаyа Аlаm di Indonesiа yаng dibаrengi dengаn kekаyааn yаng dimiliki Indonesiа tidаk berbаnding lurus dengаn pendаftаrаn Indikаsi Geogrаfis. Аdа beberаpа hаl yаng menjаdi kendаlа sehinggа mаsih sedikit permohonаn pendаftаrаn untuk Indikаsi Geogrаfis. Kendаlа terkаit pendаftаrаn indikаsi geogrаfis аdаlаh аwаl hаmbаtаn dаlаm upаyа memberikаn perlindungаn hukum terhаdаp Sumber Dаyа Аlаm yаng berpotensi menjаdi produk Indikаsi Geogrаfis di Indonesiа. Jenis Penelitian ini menggunakan penelitian Yuridis Empiris dengan metode pendekataan yuridis sosiologis. Metode pengumpulan data menggunakan studi pustaka, studi lapangan dan pengolahan data. Berdasarkan hasil penelitian ini maka diketahui bahwa DJKI mengalami hambatan hukum dalam melaksanakan pendaftaran indkasi geografis yaitu kurangnya kesadaran hukum Masyarakat Perlindungan Indikasi Geografis (MPIG) dan sengketa antara merek dan indikasi geografis. DJKI juga telah melakukan upaya untuk memaksimalkann jumlah pendaftaran indikasi geografis di Indonesia dengan cara melakukan sosialisasi dengan masyarakat dan menjalin kerjasama dengan kementerian lain untuk meningkatkan potensi indikasi geografis di Indonesia Kata Kunci: Indikasi Geografis, Sumber Daya Alam, Direktrat Jenderal Kekayaan Intelektual   ABSTRACT This research is aimed to find out measures taken by Directorate General of Intellectual Property (henceforth DJKI) to provide legal protection of geographical indications for natural resources in Indonesia. Based on official data by Geographical Indications published by the DJKI of the Ministry of Law and Human Resources, Indonesia only has 65 products of intellectual property with certificate of Geographical Indications (IG). This number has been obtained since establishment of law concerning IG as enacted in Government Regulation Number 51 of 2007 concerning Geographical Indications (IG). The number of proposals received only ranges from 10 to 16 proposals. On the other hand, the DJKI, Freddy Harris, projects that there will be at least 1000 proposals registered to Geographical Indications in the next four years. However, abundant natural resources belonging to the people of Indonesia is not relevant to the number of proposals to Geographical Indications. Some impeding factors are still found getting in the way of the registration to Geographical Indications. This research employed empirical juridical method supported by socio-juridical approach. The data was obtained from literature review, observation, and data management. The result of this research reveals that lack of legal awareness in the protection provided for Geographical Indications and dispute between brand and Geographical Indications are the main barriers. To grow the number of registrations to Geographical Indications and to optimise the potential of Geographical Indications in Indonesia, the Directorate General has introduced it to the societies and built some partnerships with other ministries.
