Ius Humani Law Journal is a platform (iushumani.org) open to researchers around the world. Abstract

Food sovereignty has been addressed from the normative and jurisprudence; However, it is necessary to understand its scope from the internal constitutional in the Latin American region; all this, based on the new paradigm that supposes the conjunction of the agrarian, the food and the environmental within the concept of timely and equitable access to safe food. This led to the analysis of its legal nature as a principle or as a fundamental right from public international law and Latin American Constitutional Law nurtured by Good Living, contrasted with the sustainable development model. From a qualitative documentary research, it was possible to conclude that food sovereignty is defined transversally; however, the mechanisms for its observance do not have State effectiveness in regard to its necessary elements such as opportunity and safety. In Latin America, elements of the rights of peoples are incorporated from the Sumak Kawsay.

Abstract

With the 2008 Constitution, Ecuador became a pioneer in the constitutional recognition of nature as a legal subject, while at the same time promoting large-scale mining and placing it at the center of its economic future. Against this backdrop, the article focuses on the analysis of possible dogmatic contradictions within the Ecuadorian legal framework, between the rights of nature and mining rights related to large-scale mining operations. In this sense, a synthesis of the trajectory and development of the rights of nature in Ecuador is presented, as well as the historical passage of large-scale mining in the country and a brief synthesis of the environmental impacts documented in the academic literature. Based on this, a series of points of dogmatic tension were identified, according to the terms of the Ecuadorian Constitution. For the development of this article, the theoretical-doctrinal method was used, through two levels: hermeneutic and theoretical-dogmatic. It is argued that the Ecuadorian legal regime has not been constructed or updated to integrate the premises of the constitutional recognition of the rights of nature nor the potential violations of these rights caused by large-scale mining activities.

Abstract

This research aims to detect the methodologies scholars use to conclude what is a human right or a natural right. For most of them, the mere citation of an article of the constitution or law does not provide enough justification for rights, and they usually resort to other supra-positive elements which are summarized in the “Natural Law Formula”. Commonly, they will appeal to human dignity, some psychological or natural inclinations, the values of society, some important goods, goals and means, and to certain principles coined in different places of the legal system. This Article discuss how authors deal with these starting points in their analysis, which precisely are the main elements of the mentioned formula. After showing how the formula works in the human rights field, we consider new possible applications of the versatile formula. It can be used deducing legal conclusions from general principles, ends, values and other elements, and inferring general standards from specific cases, as well. While scholars tend to use the deductive methodology that goes from the general to the particular, courts use the inductive methodology that goes from the case law to the general rules and standards. Finally, the Article introduces new applications of the formula in different sciences and arts related to the human being, like anthropology, ethics, and economics. Thus, this study shows how the formula can be used to develop interdisciplinary studies.

Abstract

El presente articulo pretende relatar de modo muy sucinto ciertas particularidades de la inclusión de las materias contencioso-administrativa y contencioso-tributaria en el proceso de audiencias reglado, en Ecuador, por el Código Orgánico General de Procesos (COGEP): su caracterización y las posibles ventajas y desventajas que la transformación procesal ha evidenciado prima facie -y a ojos de este relator- a esta fecha (mayo de 2022). En nuestro país, a partir de la promulgación del COGEP, académicos, jueces y abogados anunciaron abiertamente un sinnúmero de retos y reparos a la transformación procesal impuesta en los ámbitos atribuidos para el litigio de lo contencioso administrativo y lo contencioso tributario, cuya discusión sigue inconclusa. La finalidad que este trabajo persigue es relievar algunos de los posibles aciertos y desaciertos que aún se debaten públicamente sobre el cambio realizado.

Abstract

A functioning democratic regime that can meet the basic needs of citizens and guarantee material security for the vulnerable and most vulnerable segments of the population is the primary foundation of the European path of development of Ukraine. The purpose of this paper is to analyse the key goals of the state social policy of Ukraine in the context of the implementation of European Union standards and examine the current state of implementation of declared social and legal principles on the territory of the Ukrainian state. The leading methods of the study were methods of analysis and generalisation, through which the existing conflicts of the normative foundation in the field of social protection were identified, and a comparison method, the use of which demonstrated the existing shortcomings of the development strategy. investigating social priorities, the authors identify the main strategic goals of state social regulation, the main omissions of modern social policy, and the primary causes of the current social crisis. Therewith, the current state of the legislative social framework is investigated and an objective assessment of the implementation of European legislation in the national regulatory field of Ukraine is provided. Therewith, positive trends in establishing social justice by declaring gender equality and overcoming discrimination and integrating information systems into the provision of social services were analysed, and practical recommendations for successful euro adaptation, the decisive task of which is to improve the quality of life of Ukrainian citizens, were provided

Abstract

En los últimos años, la autoridad dentro de la Iglesia católica ha sido objeto de críticas y se la ha acusado de cometer abusos sobre las personas que se encuentran bajo su responsabilidad. La referencia al derecho natural de corte clásico puede aportar luces para entender esta problemática y plantear una hoja de ruta que encuentre soluciones prácticas. El respeto a la dignidad humana y la libertad de conciencia, serán los ejes para garantizar un ejercicio adecuado y justo de la autoridad. Además del iusnaturalismo utilizado como herramienta hermenéutica para plantear una salvaguarda de los derechos de los fieles frente a posibles acciones abusivas de la autoridad eclesiástica, el presente estudio recurrirá al pensamiento del Papa Francisco. Tanto los documentos pontificios emanados durante su pontificado, así como ciertas intervenciones de menor relevancia magisterial, plantean una hoja de ruta clara, que promueve una renovación en el pensamiento y los comportamientos de quienes hacen cabeza dentro de la Iglesia. Se trata de una invitación para volver a lo esencial, desde un humanismo que pretende seguir las huellas de Cristo encarnado, comprensivo y misericordioso con todos, evitando la mundana tentación de gobernar sin servir. Las conclusiones finales serán de índole práctica, al estilo bergogliano.

Abstract

In the course of the modern state building processes, European integration of Ukraine, as well as negative events unfolding as a result of Russia's armed aggression, the property right as one of the fundamental constitutional rights is experiencing restrictions and transformations. The purpose of the scientific research is to highlight the content of the guarantee (principle) of the inviolability of property rights, and how they are embedded in the Fundamental Laws of Ukraine, Poland and Germany. The following general and specifically legal methods of scientific knowledge form the methodological basis of the study: the system-structural method, the method of comparison and logical-legal method. The analysis of constitutional guarantees regarding the inviolability of property rights on the example of Ukraine, Poland and Germany was conducted in the article. According to the results of the conducted research, it is proposed the following separation of the guarantees regarding the inviolability of property rights stipulated by the constitutions guarantees of legislative consolidation of rights and procedures; immediate principles and guarantees of effectuation of the property rights; guarantees of administrative support; guarantees of protection and defense of the property rights. Significance of results and the prospects for further research. The proposed classification makes it possible to more widely define the constitutional guarantees of the property rights, which also makes it possible to provide the legal protection to a wider range of public relations regarding the property.
