Abstract

This paper provides a review of the book The Law of Secrets, of the author Juan Carlos Martínez-Villalba Riofrío studying the secrets and how law does protect. To this end, the author has analyzed the general theory of secrecy, secrets and methodology, its overall rating, essential elements and their different legal dimensions, the secret as a subjective right. It also establishes that professional secrecy is protected by constitutional principles such as the right to privacy.

Abstract

This paper demonstrates the various unconstitutional and fallacies of the Organic Law of Judicial guarantees and Constitutional Control. For that, there will be a comprehensive collation between the mentioned law and the Constitution of the Republic of Ecuador and force. Through this analysis shows a lack of knowledge of Ecuadorian law or legal science by their authors. This study elucidated, inter alia, the inconsistencies in matters relating to the interpretation of constitutional provisions, full compensation, material and integral; challenge administrative acts, judicial unit.

Abstract

This review provides a comparison between the different editions of the famous work of Hervada, discussed here. The outcome of this analysis arise five new hermeneutical rules that analyze how to interpret positive law or agreement that eventually undermine the natural law. It is also evident that the principles proposed by Hervada are a good basis for general legal hermeneutics.

Abstract

This paper aims to determine, through a deep analysis of different doctrines, the definition of environmental damage; it also seeks to determine the difference between damage to nature and the civil environmental damage, which is damage to individual interests or collective environmental event occasion. To this purpose, we intend to study certain procedural rules and case law concerning Ecuadorian environmental management, also in comparative law considers how countries like Chile, Spain and Argentina regulate compensation and repair environment.

Abstract

Inexistence and nullity of juridical acts are basic institutions in Ecuadorian Law. These are two different categories that have in common the chasing of the invalidity of the juridical acts that didn’t form according to Law. Inexistent acts are deprived by the law of any legal effect, while null acts have legal effects but a judge can declare them null and erase their legal effects that have already taken place. This paper reviews the legal regulation of inexistent and nullity under Ecuadorian Law, as well as the rulings of the National Court of Justice regarding the issue.

Abstract

This work allows us to establish the Economic Constitution and the Competition Law (C.L) in the Constitution. Additionally, the paper analyzes whether the rules outlined in the C. L. and in doctrine are consistent and appropriate with the Constitution of Ecuador. The Competition and Antitrust Laws has rules for investigating and punishing the cartels, the abuses of power market (dominant position), the rules for merger control, the behaviors of Abuse of economic dependence, and unfair competition behaviors. Always the Antitrust Authority will analyze these behaviors in terms of welfare of both: the consumer and the market.

Abstract

Private international law is justified at a time when the legal systems of nation states seeking a way to extend their areas and competencies. This desire led to the conflict between national laws, which grew smaller as did the novel concept of "international community", but did not suppress national relativism. A new law began to settle, then, with the progress of the integration process. Community laws have mechanisms to be applied, even when states would try to ignore them or to fulfill a relative way.

Abstract

It is a study of comparative law between the Arbitration Rules of the United Nations Commission for International Trade Law (UNCITRAL), specifically established in the Arbitration Rules, and the arbitration in Ecuadorian system. The paper first defines the concept of arbitration, international arbitration differentiating domestic arbitration. In a second time, there are a historical reference both as an institution and the UNCITRAL Arbitration Rules. Following, the author show a background study, Arbitration and Mediation Ecuadorian Law. Finally appears the comparation between the two systems, with the resulting conclusions.
