Abstract

AbstractInventory of traditional medicine as a form to protect intellectual property of Bengkulu Province, to know the obstacle factor in exploring the knowledge of traditional medicine and to know the role of government in protecting knowledge of traditional medicine in Bengkulu. Research uses empirical research. The results show there is some traditional drug knowledge that can be explored by traditional drug makers. Traditional medicine has existed since hereditary and provide efficacy to the consumer. The exploration of this knowledge of the intellectual property element, some of the problems the makers do not know that the intellectual property can protect the existing culture. The role of government is needed to protect thenational culture, especially regional culture as an asset of the Indonesian nation.IntisariMenginventarisasi obat tradisional sebagai wujud untuk melindungi kekayaan intelektual Provinsi Bengkulu, untuk mengetahui faktor penghambat dalam eksplorasi pengetahuan obat tradisional serta untuk mengetahui peran pemerintah dalam melindungi pengetahuan obat tradisional di Bengkulu. Penelitian menggunakan penelitian empiris. Hasil penelitian menunjukkan terdapat beberapa pengetahuan obat tradisional yang dapat dieksplorasi oleh pembuat obat tradisional. Obat tradisional telah ada sejak turun temurun dan memberikan khasiat kepada konsumen. Eksplorasi pengetahuan ini unsur kekayaan intelektual, beberapa permasalahan pembuat tidak mengetahui bahwa kekayaan intelektual itu dapat melindungi kebudayaan yang telah ada. Peran pemerintah sangat diperlukan  ntuk melindungi kebudayaan nasional terutama kebudayaan daerah sebagai asset bangsa Indonesia.

Abstract

AbstractThe Ramsar Convention have been transformed and implemented into Indonesian law. In practice, still found non-synchronized regulations that have not been able to implement the sustainable and wise use of wetlands. The prevention of peatland degradation must be holistic by involving the community and make intens socialization in order to create a sense of belonging and ownership. It is the purpose of this article to analyze the implementation of the Ramsar Convention 1971 on the peatland ecosystem protection and management at Tanjung Puting National Park, Central Kalimantan, and related to how Government efforts and policy to prevent the degradation of peatland since it was established as Ramsar Site in Indonesia.IntisariKetentuan-ketentuan dalam Konvensi Ramsar telah dilaksanakan dan ditransformasikan ke dalam peraturan perundang-undangan di Indonesia. Dalam praktiknya, masih ditemukan peraturan-peraturan yang tidak sinkron, sehingga belum dapat melaksanakan komitmen pemanfaatan lahan basah secara bijaksana dan berkelanjutan. Upaya pencegahan degradasi gambut harus dilaksanakan secara holistik dengan mengikutsertakan masyarakat dan mengintensifkan sosialisasi agar tercipta sense of belonging, dan ownership. Penelitian ini bertujuan untuk menganalisis implementasi Konvensi Ramsar 1971 terkait perlindungan dan pengelolaan ekosistem gambut di Taman Nasional Tanjung Puting, Kalimantan Tengah. Sekaligus untuk melihat sejauh mana upaya Pemerintah dalam mencegah degradasi ekosistem gambut, sejak Tanjung Puting ditetapkan sebagai Situs Ramsar di Indonesia.

Abstract

Abstract. Background of this article is, although it was first emerged in Common Law system countries, the practice of class action has been growing in Indonesia. This mechanism brings an opportunity to simplified the court’ process and to reduce the risk of disparity judgements. This article found similarities and differences scope and procedure of certification in Indonesia and the USA. Before examining the case, a presiding judges, accordingly to Supreme Court Regulation Number 1 Year 2002 concerning Procedure of Class Action, have to determine whether the case is eligible to be examine as class action case. This procedure is universally well-known as certification mainly focuses on the fulfilment of class action’s substantive requirements: numerosity, commonality, typicality and adequacy of representation and formal requirements. The similar requirements are also implemented in the USA accordingly to Federal Rule of Civil Procedure, Rule 23 Class Action. However, in those countries have different procedure when it comes to legal remedy to the certification order, mechanism to opt-out in case of settlement or withdrawal, the role of judge in assisting poor litigants and determining counsel’s fee. This article recommends Indonesia has to amend the Supreme Court regulation to add provisions on legal remedy, and mechanism to opt-out in case of settlement or withdrawal.

Abstract

AbstractThe term Four Pillar became a public debate. The main problem is the use of the Four Pillars term consisting of Pancasila, the 1945 Constitution, NKRI, and Bhinneka Tunggal Ika has raised questions from the community. This research is a qualitative research that examines the existing norms and legislation through the normative laws approach. The purpose of this research is to analyze the normative laws and the impact of the Constitutional Court’s decision on the use of the Four Pillars term. The Constitutional Court’s decision is in accordance with the logic of legal language and the prevailing rules related to the concept and the nature of Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia, and Unity in Diversity can not be categorized into one of the same variants is true. In this case the MPR RI has made a mistake in the language logic using the term 4 Pilar MPR RI. IntisariIstilah Empat Pilar menjadi perdebatan publik. Pokok persoalannya yaitu penggunaan istilah Empat Pilar yang terdiri atas Pancasila, UUD 1945, NKRI, dan Bhinneka Tunggal Ika telah menimbulkan pertanyaan dari masyarakat. Penelitian ini merupakan penelitian kualitatif yang mengkaji norma dan peraturan perundang-undangan yang ada melalui pendekatan penelitian hukum normatif. Tujuan penelitian ini adalah menganalisis dasar normatif dampak putusan MK terhadap penggunaan istilah Empat Pilar. Putusan MK telah sesuai dengan kaidah logika bahasa hukum dan kaidah yang berlaku terkait dengan konsep dan hakikat Pancasila, UUD 1945, NKRI, dan Bhinneka Tunggal Ika tidak dapat dikategorikan menjadi satu varian yang sama. Dalam hal ini MPR RI telah melakukan kesalahan logika bahasa dalam menggunakan istilah 4 Pilar MPR RI.
