Abstract

Penelitian ini bertujuan untuk menganalisis peranan Sentra Penegakan Hukum Terpadu (Gakkumdu) Kota Parepare dalam memproses pelaporan dugaan pelanggaran pidana penggunaan ijazah palsu pada Pemilihan Kepala Daerah (Pilkada) Kota Parepare Tahun 2024. Fokus kajian diarahkan pada mekanisme penanganan pelaporan, koordinasi antar lembaga dalam Sentra Gakkumdu (Bawaslu, Kepolisian, dan Kejaksaan), serta kendala-kendala yang dihadapi dalam proses penegakan hukum pemilu. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan jenis penelitian deskriptif. Data diperoleh melalui wawancara mendalam dengan pihak Gakkumdu, dokumentasi, dan studi pustaka. Hasil penelitian menunjukkan bahwa Gakkumdu Kota Parepare memiliki peran strategis dalam menyelidiki dan menindaklanjuti laporan dugaan ijazah palsu, namun terdapat sejumlah kendala seperti keterbatasan waktu penanganan, kurangnya bukti awal dari pelapor, serta hambatan teknis dalam verifikasi dokumen ke institusi pendidikan. Meskipun demikian, Gakkumdu dinilai telah berupaya optimal melalui koordinasi lintas lembaga dan penggunaan mekanisme hukum yang tersedia. Penelitian ini merekomendasikan penguatan kapasitas investigasi, peningkatan literasi hukum masyarakat, serta perbaikan sistem verifikasi dokumen sebagai upaya mendukung penegakan hukum pemilu yang adil dan transparan.

Abstract

Perkawinan di bawah umur masih menjadi fenomena hukum dan sosial yang marak di Indonesia meskipun telah terjadi perubahan batas usia minimal melalui Undang-Undang No. 16 Tahun 2019. Penelitian ini bertujuan untuk menganalisis secara yuridis praktik perkawinan anak dalam perspektif hukum pidana Indonesia. Pendekatan yang digunakan adalah yuridis normatif dengan mengkaji regulasi seperti KUHP, UU Perlindungan Anak, dan UU Perkawinan. Hasil penelitian menunjukkan bahwa praktik dispensasi kawin yang longgar serta lemahnya penegakan hukum mengakibatkan hukum pidana belum berfungsi efektif sebagai instrumen perlindungan anak. Selain itu, pertanggungjawaban pidana terhadap pihak selain pelaku utama, seperti orang tua, penghulu, dan tokoh masyarakat, belum diterapkan secara konsisten meskipun memiliki dasar hukum yang jelas. Penelitian ini menekankan perlunya penafsiran progresif, penegakan hukum yang lebih tegas, dan sinergi antar lembaga guna mewujudkan perlindungan maksimal terhadap anak. Dengan demikian, hukum pidana tidak hanya sebagai alat represif, tetapi juga preventif dalam mencegah dan menindak praktik perkawinan anak.

Abstract

The need for a judicial system that is not only legal-formal but also substantive and just has become increasingly urgent amidst the ongoing crisis of integrity and public trust in modern judicial institutions. This research stems from the urgency to re-explore the realities of the pre-Islamic Arab judicial system and the system during the time of Prophet Muhammad (PBUH), which emphasized transcendental justice, ethics, and the values of public interest (maṣlaḥah). The study aims to examine the characteristics of the judicial systems in pre-Islamic Arabia and during the Prophet's era, as well as how the principles and methods applied in that context can be compared to and contribute to the development of modern judicial systems. The method used in this study is normative legal research based on library research, employing historical, conceptual, and comparative approaches. Data were collected from primary sources such as the Qur’an and Hadith, as well as secondary sources including classical and contemporary works on Islamic law and judicial systems. The study finds that the judicial system during the Prophet’s time was not formally institutionalized, yet it already embodied fundamental principles of modern justice—such as impartiality, presumption of innocence, equality before the law, and a substantive form of appellate review. Prophet Muhammad (PBUH) applied six main methods for resolving disputes: iqrār (confession), bayyinah (evidence/witness), yamin (oath), qasāmah (collective oath), firasah (judicial intuition and reasoning), and ṣulḥ (mediation). These methods demonstrate that the Prophetic system was flexible, contextual, and highly responsive to the social dynamics of the time. In conclusion, the Islamic judicial system during the Prophet’s era is not merely a historical legacy but a paradigmatic model that remains relevant for strengthening contemporary legal systems. Integrating the ethical and transcendental values of the Prophetic model into modern judiciary is believed to enhance the trajectory of law toward dignified and humanistic justice.

Abstract

This study examines the dynamics of legal politics in the power relations between the executive and legislative branches in Indonesia following the amendments to the 1945 Constitution. The background to this study is the need to review Indonesia's constitutional structure, which was previously rife with executive dominance, particularly during the New Order era. The constitutional reforms undertaken between 1999 and 2002 were crucial in redesigning the state's power relations, with the aim of creating balance by strengthening the legislative, budgetary, and oversight functions of the House of Representatives (DPR). This research uses qualitative methods with a normative-juridical approach, anchored in the analysis of regulations, constitutional documents, and a review of primary and secondary legal literature. The results show that although the amendments have formally strengthened the DPR's position in the presidential system, their implementation has presented new challenges in the form of legislative dominance that is vulnerable to being exploited for partisan interests. The multiparty system in Indonesia's presidential system has also created power friction between the president and parliament, hampering government effectiveness. The chaos in the function of checks and balances is exacerbated by the weakness of countervailing institutions such as the Regional Representative Council (DPD) and the People's Consultative Assembly (MPR). Further reforms are needed that address not only institutional design but also the development of a deliberative political culture and the strengthening of independent oversight institutions to support substantive democracy

Abstract

Lavender Marriage refers to a marital union undertaken to conceal sexual orientation in order to avoid social stigma. This study analyzes the validity of such a marriage contract under Islamic law and the framework of maqāṣid al-sharī'ah through a case study in Nangka Village, North Binjai District. Employing a juridical-empirical approach with a descriptive-analytical method, data were collected through interviews, observations, and literature review. The findings indicate that although this practice may fulfill the formal requirements of marriage under positive law, it contradicts the essential objectives of marriage in Islam, particularly the establishment of a harmonious family (sakinah, mawaddah, wa rahmah) and the preservation of lineage (ḥifẓ al-nasl). Elements of deception (tadlīs) are present, resulting in greater harm (mafsadah) than benefit (maṣlaḥah), whether morally, socially, or psychologically. The study recommends strengthening premarital counseling, moral development, and public education to prevent similar practices.

Abstract

The case of indications of caesium-137 radioactive contamination in the Cikande modern industrial area, Banten, is used in this study as a normative illustration to describe the potential for serious threats to health and the environment and to indicate a legal vacuum. This study aims to analyze the possible forms of corporate liability outside the official nuclear industry if it is proven to have caused contamination, with reference to the provisions of Law Number 32 of 2009 concerning Environmental Protection and Management (PPLH Law) and Law Number 10 of 1997 concerning Nuclear Energy. The research method used is normative juridical with a conceptual approach, using cases as normative illustrations to demonstrate the urgency of the need for legal reform. The results of the analysis show that the environmental legal framework provides a normative basis for applying liability to corporations outside official nuclear installations that are proven to be the cause of contamination by using the principle of strict liability. This study recommends reformulating the Nuclear Energy Law by expanding the scope of legal subjects to include activities outside official nuclear installations that have the potential to cause radiation hazards and creating more comprehensive laws and regulations to prevent and deal with the threat of radioactive contamination to the environment

Abstract

This study aims to analyze and compare the changes to the adultery articles in the Criminal Code (KUHP) and the National Criminal Code (KUHP), and to examine the Islamic legal values ​​contained in these regulations. Internalization is expected to strengthen national morality, protect morality, and maintain public order. The Criminal Code only regulates adultery as sexual intercourse involving married parties, making it irrelevant to the moral values ​​of Indonesian society, which uphold religious and moral norms. Meanwhile, the National Criminal Code broadens the scope of adultery to include any sexual intercourse outside of marriage, whether the perpetrators are married or not. The urgency of this research lies in the importance of reforming national criminal law to better reflect the moral, social, and religious values ​​entrenched in Indonesian society. The old Criminal Code, a legacy of Dutch colonialism, is no longer relevant for its full implementation because it is built on liberal principles and values ​​that conflict with the character of the Indonesian nation, which is based on Pancasila. This research is a normative legal study using a statute approach and a conceptual approach, followed by descriptive and analytical analysis. The research findings indicate that the amendment to the adultery article in the National Criminal Code not only broadens the scope of the crime of adultery but also reflects the internalization of Islamic legal values ​​into the national criminal law system. Thus, the new Criminal Code represents a harmonization of positive law and religious moral values, consistent with the character of the Indonesian nation, which is based on Pancasila. This research not only classifies adultery perpetrators as married and unmarried but also examines how Islamic legal values ​​contributed to the formation of the National Criminal Code.

Abstract

This study explores the application of the ijarah principle in the wage system for sales workers in Banjaran District, focusing on assessing justice ('adl) and worker protection. The research aims to evaluate whether the commission-based wage system implemented in small-scale toy businesses aligns with the principles of ijarah contracts in Islamic law. Using a descriptive-analytical qualitative approach, data were collected through interviews, observation, and documentation. The findings indicate that the wage system formally meets essential elements of ijarah, including clear contracts and mutual consent. However, substantive justice and worker protection are not fully achieved, as workers bear economic risks without a guaranteed minimum income. This study proposes a reform of the ijarah-based wage model by integrating income guarantees and risk-sharing mechanisms in accordance with the maqāṣid al-sharī'ah. These findings are expected to contribute to the development of a fairer wage system in Sharia-compliant employment relations

Abstract

Juvenile crime constitutes a complex legal phenomenon that cannot be separated from the influence of the social environment, particularly the involvement of adults surrounding the child. The television drama Juvenile Justice portrays juvenile crime not merely as an individual act, but as the result of power relations, neglect, and exploitation by adults who bear legal duties of supervision and protection. This study aims to analyze patterns of adult involvement in juvenile crime and to assess the relevance of the doctrine of vicarious liability from a criminal law perspective. Employing normative legal research with a qualitative approach, this study applies both conceptual and case-based approaches. The data were derived from primary and secondary legal materials, complemented by scene analysis of Juvenile Justice as an object of popular culture studies. The findings indicate that juvenile अपराध in the series is structurally connected to the role of adults, either through failures of supervision or through active involvement that facilitates the commission of criminal acts. The doctrine of vicarious liability is therefore considered relevant as a legal instrument for extending criminal responsibility to adult actors who make significant contributions to juvenile crime, without undermining the principles of legality and culpability. This study concludes that the application of vicarious liability may serve as a more just and proportionate alternative within the juvenile criminal justice system by allocating criminal responsibility in a balanced manner between child offenders and the adult actors operating behind the commission of the crime.
