Abstract

Abstract The practice of pawning in Mundu Village, Tanjung Subdistrict, Brebes Regency has long been practiced and the practice can be explained as follows, namely with a Debtor intending to borrow money to a creditor with a guarantee that the Debtor gave his land to the Creditor to be used as collateral as well as to take the results of his claim until the Debtor returns the loan. Such a contract is certainly detrimental to the Creditor. Therefore, the authors are interested in examining the practice of pawning that occurred in the village. The purpose of this study is to enlighten the local community that the practice is not in accordance with what is taught by Islamic law. The method used in this research is Normative which is to examine the data in the field and analyzed with the norms contained in Islamic Law. The results of his research are that the party entitled to use the pawn item is the Borrower of the debt, while the person giving the debt is not entitled to take advantage of the pawn item except with the permission of the owner of the item.Keywords: Pawn; Underhand Agreement; Islamic Law AbstrakPraktek gadai di Desa Mundu, Kecamatan Tanjung, Kabupaten Brebes sudah sejak dahulu dipraktekan dan prakteknya tersebut dapat dijelaskan sebagai berikut yaitu dengan Debitur yang bermaksud meminjam uang kepada kreditur dengan jaminan Debitur menyerahkan tanah sawahnya kepada Kreditur untuk dijadikan jaminan sekaligus untuk diambil hasil garapannya sampai Debitur mengembalikan uang pinjaman tersebut. Akad semacam ini tentunya merugikan bagi pihak peminjam hutang, Oleh karena itu penulis tertarik untuk meneliti praktek gadai yang terjadi di Desa tersebut. Tujuan dari penelitian ini untuk memberi pencerahan bagi masyarakat setempat bahwa praktek tersebut kurang sesuai dengan apa yang diajarkan oleh hukum Islam. Metode yang digunakan dalam penelitian ini adalah Normatif yakni mengkaji data yang ada di lapangan dan dianalisis dengan norma-norma yang terkandung dalam Hukum Islam. Hasil penelitiannya adalah bahwa pihak yang berhak memanfaatkan barang gadai adalah si Peminjam hutang, sedangkan yang memberi hutang tidak berhak untuk memanfaatkan barang gadai kecuali seizin oleh pemilik barang. Kata Kunci : Gadai; Perjanjian Dibawah Tangan; Hukum Islam
