Abstract

Islamic law is universal, elastic and dynamic. This concept provides implementable consequences for Muslims which able to prove and raise the Islamic values in the reality of life without crossing from their Islamic region, but also do not make silly attitudes that put Muslims in position lost to the outskirts of the cultural heritage area. Therefore, Prophet Muhammad SAW. has recommended and legitimized to his friend, Muadz bin Jabal for doing individual interpretation (ijtihad) in any settlement of problem which not found in al-Qor’an and Hadith. Furthermore, this raise a form of legal istinbat method is known as istihsan in Usul al-Fiqh. Nevertheless, the existence of istihsan is debated by the Islamic jurists. Abstract

The financial institutions as mediators of the parties who have excess of funds to the parties who lack of fund so that to be complement each other and serves as the financial intermediary of community. In reality, each institution or organization has several types, namely; first; pure-profit organization, second; quasi-profit organization, third; quasi-non-profit organization and fourth; pure-nonprofit organization. The purpose of first institution type is to make a profit as much as possible in the supply and sale of goods, secondly; aims to make a profit and get other purposes as needed by the owner, thirdly; aims to make profit (surplus) and serve the community, while the last institution aims to improve the community welfare and serve it. The type of organization will continue to face numerous polemics, inequality and disparities occurs today. Therefore, the Islamic economic system is needed as an economic alternative to answer the problems occurs at this time. Key words: Business systems, development, Islamic economics

Abstract

Hadanah is an authority to care and educate children who have not mumayiz (immature) or adults who have lost their thinking intelligence. The authority is more appropriate possessed by a women (mothers). Because the female instinct is more appropriate to care and educate children and her patience in dealing with the children life problems is higher than the patience of a man (father). Although both parents, especially the mother has authority and responsibility in hadanah, but in the Islamic perspective, a mother with schizophrenia is considered have not authority and responsibility to carry out hadanah for his children. Since people with schizophrenia have not the legal capacity to care and educate her children

Abstract

Blood transfusion is closely related to the function of human caliphate on the earth at building harmonious relations and benefit for the humanity among fellow, without being limited by differences in belief (religion) between the donor and the recipient. Therefore, blood donor between people of different faiths in the Islamic law perspective is allowed. Similarly the financing at Blood Donor Unit at PMI for the benefit of blood transfusion, is not identical with commercialization (purchase) of blood, so it is allowed in the Islamic law. In addition, blood donors did not lead to the legal consequence in form of the forbidden status of the donor and recipient
