Abstract

Generally Malaysian legal system is influenced by the tradition of English Common Law System while the Indonesian legal system more mengadobsi tradition of Dutch civil law system in addition to the system of Islamic law and customary law systems also affect the national law of each country. Comparative study of constitutional law system Malaysia and Indonesia is a constitutional law studies using normative legal research with comparative law approach to examine the advantages and disadvantages of the legal systems of both countries, especially in the state system between the two countries including the judicial system, in order to obtain a overview of the differences and similarities of national legal systems of both countries. Based on the research results through liberary research found that institutional format nagara Malaysia and Indonesia have differences in terms of both form the state and the ruling party. Malaysia is a country that adheres to the type of federal state which includes federal and state government system with a democratic monarchy. While the Indonesian state, which includes the unitary form of the central government and autonomous regions with a republican system of government with the principles of constitutional democracy. In addition, it was also discovered that a power-sharing system of Malaysia and Indonesia when viewed from theory Trias politica have differences. Where The diPertuang Agong as the Head of State Malaysia holds three (3) as well as the power of the executive, the legislative and judiciary powers. While in Indonesia the third power of each stand-alone, in which executive power is held by the President, the legislative power by Parliament and judicial power in the hands of the Supreme Court and the Constitutional Court. Abstract

National zakat movement has been implemented in the statehood but in fact it has not been able to overcome the poverty. This study aimed to recognize (1) what programs are carried out by the Province of Maluku in order to overcome the poverty in the Maluku? (2) whether and how the Amil Zakat institutions program (Baznas) Province of Maluku in order to reduce the poverty in Maluku? (3) How the contribution of Islamic Higher Education Institutions in order to succeed the National Zakat Movement as effort to reduce the poverty in Maluku? The results shows that already many national programs that be implemented in Province of Maluku, but the data shows the poverty indicators in Province of Maluku is still high. Amil Zakat Institution (BAZNAS) in Province of Maluku has been doing the program but still not significant in overcoming the poverty in Province of Maluku. This study also provides several scenarios for Islamic higher education institutions to reduce the poverty in Province of Maluku. Keywords: zakat, zakat institutions, poverty, Maluku

Abstract

The aim of the study was to identify and analyze the socio-demographic, attitudinal and contextual influences on the motivation of Bugis Muslim entrepreneurs in Ambon City and to find out an Islamic economic review of the entrepreneurial motivation of the Bugis Muslim community in Ambon City. This research is a type of field research using a quantitative approach to a sample of 30 Bugis people from 30 populations in the Gedung Putih Batu Merah Ambon. Data collection was used through Likert scale measurements and analyzed through multiple linear regression analysis. The results of the study show: (1) Socio-demographic, attitudinal and contextual variables partially and simultaneously have no effect on entrepreneurial motivation. (2) In the perspective of Islamic economics, the entrepreneurship motivation of the Bugis Muslim community is relatively good where they believe that everything that success in entrepreneurship depends on sincere intentions and seeking the pleasure of Allah SWT. If someone fears Allah, he will surely be given a way out of trouble. In addition, by establishing good relationships and working sincerely, Allah will make the journey to success easier.
