Abstract

This research is about prevention of trafficking based on human security perspective. There most important thing connected to human security issues is the prevention of woman trafficking is not effective This study used a qualitative method. Primary and secondary data collections were used to collect the data. Primary data were obtained by interview and observation, while secondary data were collected from document and articles. Data analysis is covered data collection, reduction, display of data, and inferences.This study found that woman trafficking from the risk assessment’s point of view has become a threat to human security. It is noted that the implementation of women trafficking prevention did not work out as expected.  The prevention that has been done from the government are involves enhancement of education supervision of border. Those activities actually did not touch the grass-root women from Entikong that vulnerable to women trafficking. Moreover, the protection from the local government of Sanggau district which cooperated with non government organizations is running spatially.

Abstract

Experience Construction of Communications and Self-concept of Fat Women in Pekanbaru, Riau in phenomenological perspective, aiming to uncover the experience of interpersonal communication and self-concept of obese women, obese women motives in the effort to achieve ideal body weight, and to know how they interpret the meaning of fat.This study uses qualitative research as approach, constructivism as paradigm and phenomenology as the type of study. The research subjects were 15 obese women in Pekanbaru that have been purposively selected. To collect the data this study used in-depth interviews, observation and literature study methods.The results revealed that: the experience of communication associated with overweight women include obesity, pleasant communication experience, and experience the unpleasant communication. This is a result of interaction with family, environmental education, employment and the opposite sex.Participants who have overweight at the age of children to adolescence have more positive self-concept. Otherwisefor the adults they tend to have negative self-concept. There are three categories of self-concept of obese women 1) Positive view of self, physically, psychologically and socially; 2) negative view of self physically and psychologically, but socially positive, 3). negative view of self physically, psychologically and socially.Many obese women try to lose their weight, it its motivated by the reason of fitnes for healthy life, and reason of freshnes for body appearance. The motivation source of to lose weight some participants derived from personal motives and the othersfrom social motives.

Abstract

Marriage is  not exclusively a business of the individuals who are going to get married; instead it also involves friends, families, and community as well. Marriage is sacred. That is why it involves many people in performing its procession, particularly for women who have essential roles in it; from the setting of marriage and marriage ceremonies up to its completeness. Whereas men only follow what women said or designed to facilitate a marriage procession.            This research was  aimed: (1) to obtain a description on the participation of community in the Acehnese marriage system, (2) to obtain a description on the motivation of community to participate in the Acehnese marriage system, 3) to obtain data on the forms of community participation in keeping marriage system in the  Acehnese community.This research was conducted by using a descriptive-qualitative method focused on the case of marriage of Acehnese people in the district of Aceh Besar.  Data collection was conducted by using in-depth interview, observation, and documentary study. The researcher also used FGD (Focus Group Discussion) to ensure the accuracy of the analysis.            Marriage sistem in Aceh Besar community has become a social institution to be complied by all community members. Women have a dominant role in every step of marriage ceremony, and together with other people always share their participation in various kinds, such as power, thought, time, or even materials to support the party. The participation was motivated by habitual solidarity, sense of responsibility, care of life, togetherness encouraged by social economic, and job description. Aceh Besar community defend the marriage sistem by obeying customary rules and transformation of marriage ceremonies from old generation to young generation in order to always appreciate their culture as has been showed by Majelis Adat Aceh (MAA) that played an important role in maintaining the preservation of the Acehnese culture.

Abstract

It is likely that inter-religion marriage often takes place due to plurality adhered by the Indonesian people. Many couples have not had their inter-religion marriage registered due to refusal by the Civil Registry Office to register their marriage on grounds that the inter-religion marriage is not permitted in religious teachings, and further, it is not regulated in Law No. 1 of 1974. This fact obviously raised the feeling of injustice and legal uncertainty in the inter-religion marriage so that it is interesting to investigate the aims of which were: to discover the law on inter-religion marriage in the politics on marriage law based on Five Basics Principles of the Republic of Indonesia (Pancasila) when associated with function of the marriage registry institution, to discover the legal certainty of the interreligion marriage conducted overseas when associated with function of the marriage registry under the Indonesian legal system, as well as the inter-religion marriage law in the political perspective on equitable marriage law based on Pancasila as an effort for legal system development of national family. Toanalyzethe research findings, the following theories are adopted, which are, the Pancasila-based legal state, Pancasila-based justice as well as legal development and legal certainty theories.The research was a legal research natured by adopting approaches on legal history and comparative as well as laws and regulations. The research was descriptive nature and in view of the costruction, it was a prescriptive research.The main data required for the research consisted secondary and primary data.Data collection that have been adopted was document study and interview methods The analysis of the data collecting was conducted on a qualitative juridical method focusing on the analysis on the legal certainty and legal aspect which live and grow among the public, as well as legal synchronization.The research indicated that the inter-religionmarriage in Indonesia has taken place due to a legal uncertainty in the context of Law No. 1 of 1974 which did not regulate whether or not the inter-religion marriage practice was permitted. On the contrary, however, the relevant law has opened the possibility of such marriage to took place. It was also possible that the uncertainty on the inter-religion marriage was due to the provisions regarding marriage as set forth in Law No. 1 of 1974 and Law No. 23 of 2006 which conflict with each other. The state should therefore guarantee that the public legal certainty is to be realized as one characteristic indicated in a Pancasila-based legal state is the existence of legal certainty. Viewed from the theories on Pancasila-based justice as well as legal development and legal certainty approache.Thus, to realize public orderliness and harmony, it shall be necessary to only register the marriage at one institution. This has to be conducted as an effort to keep orderliness of population administration and legal certainty when it comes to inter-religion marriage.

Abstract

The Phenomenon of political strengthening of the local clans rely on the genealogic relationship including women’s political participation. Mastery of strategic positions in political parties representing the power of the dominant clans. Political participation of women in political parties suggests that the presence of kinship linkages with key figurs in the dominant clans. The research question is how the domination of clan in Kaili Society articulated  in political Parties. This research has been carried out by using a qualitative approach.The result of research shows that the authority of traditional institusions remain because of a determinant factor in strengthening the dominance of clan social structure. It is formed by a process of social change on traditional power system on the pust turns into the existence of such cultural institutions today, so that the dominant clan members occupy the top social status and strategic role. The central figure that take a lead in Kaili is the madika. It is increase the recruitment of female in the number but a role uin the activities of political parties precisely reduced and  weakened.

Abstract

This dissertation, discuss the issues : How the harmonization of the legal constraints in the process of establishment of regulations; and How the harmonization of the legal constraints in implementation regulations in spatial scope in the coastal areas and How the harmonization model in the spatial law in coastal areas to ensure the realization of sustainable development ?Through a descriptive approach: in terms of assessment though interdisciplinary and multidisciplinary, and management approach across sectors, across regions and across stakeholders (integrated), then analyzed it through normative juridical. The conclusions is : 1) The harmonization of legal constraints in the process of establishment regulation of spatial in the coastal areas is  the Ministry of Justice and Human Rights just authorized to coordinate the process of harmonization 2) The harmonization of legal constraints in the implementation regulation of the coastal areas consist of the weakness of substance quality from Law of National Long term Development Plan and its derivatives, and also no sanction can be downed for everyone who against the plans. 3) The harmonization of legal model in environmental and spatial legal system based of theological, ecological and juridical element.

Abstract

In cultural interaction, social integration occurs among ethnics or tribe that is shown by social bound that strengthen the ralation among them. In those interaction respect, believe,and solidarity, appeared to keep peaceful among each other. However, cultural interaction may ruin social integration also. This may couse hostility, prejudice, insecurity, and conflict among the ethnics.This study used qualitative approach to research the ethnics harmonization. The data was collected from observation and interview of community leaders, tribes leaders, common people in societies, non government organization and local government leader. Social prejudice, stereotype and ethnocentrism influenced by family, environment and personal experience causes some ethnics reluctant to communicate with another ethnics. The ethnics of Malay, Dayak, and Chinese have it is own cultural wisdom from their religion and traditional values. The ethnical diffrences is not the barrier of inter ethnics interaction; The intensity of interaction occurs on social activity, bussines, and religiosity become the channel to cultural understanding so that tolerancy could overcome the border of culture.

Abstract

The purpose of this research was to learn more regards: (1) the preparation of women politicians before excecuting their duties as parlimentiary members in order to implement the legislation, controlling and budgeting functions; (2) The performance of  women politicians involving their duties to execute the legislation, controlling and budgeting functions; and (3) The perception of men politicians on women politicians in their execution of legislation, controlling and budgeting functions.            Methods used in this research was qualitative (subjective’s perspective) with simbolic paradigm and dramaturgy as its variance. The data collection methods used in this research were interview, observation and documentation.The result of this research indicates that (1) In the preparation of women politicians before excecuting their duties as parlimentiary, there wasa synergy pattern development among one stage with another stages. This development include motivation stage, deepening subject material stage and consultation stage; (2) The performance of  women politicians whenexcecuting their duties: legislation, controoling and budgeting functions generally less than optimal comparedto men politicians. This conclusion was based on some constraints that  women politicians have to face, such as economics, culture, background and experience life in politics, and (3) The perception of men politicians on women politicians in their execution of legislation, controlling and budgeting functions some are still gender bias. In the other words  men politicians were still underestimate the competence and capacity of women politicians in their capacity as perlimeantary member. Nevertheles, men politicians generally stated that they  agreed to positioning women politicians as their partner in carrying out the functions of legislation, controlling and budgeting in West Java Parliament. Therefore, according to the perception of men politicians, the efforts to increase the capacity, competence and quality of women politicians have to be improved either through political education with gender literacy through the support of a number of regulations that provide protection against the participation and political rights of women.
