Abstract

Kehamilan adalah masalah yang sangat pribadi, dan setiap individu memiliki hak untuk menjaga privasi dalam dirinya. Perempuan berhak untuk memutuskan kapan kehamilannya dan jika ingin menjadi ibu adalah bagian penting dari kontrol diri dan masa depan yang lebih baik bagi perempuan. Kehamilan yang tidak diinginkan dapat membahayakan kesehatan fisik dan mental pada perempuan, sehingga dalam hal ini perempuan dapat mengambil keputusan aborsi atas dasar hak menentukan nasibnya sendiri. Memaksakan perempuan untuk menjalani kehamilan yang tidak diinginkan adalah tindakan yang melanggar hak otonomi tubuh mereka. Tujuan penelitian ini adalah mengetahui bagaimana pengaturan aborsi di Indonesia serta ditinjau dari hak memilih pada perempuan (Pro-Choice) dan Feminist Legal Theory (FLT). Pandangan Pro-Choice dan FLT memberikan argumen yang kuat untuk melindungi hak-hak perempuan dalam melakukan aborsi. Dalam memahami dan menghormati hak otonomi tubuh, kesehatan, dan keselamatan perempuan, serta menerapkan prinsip-prinsip FLT seperti hak privasi dan anti-diskriminasi, dapat membantu masyarakat memandang isu aborsi dengan perspektif yang lebih inklusif dan hormat terhadap hak-hak perempuan. Penelitian ini menggunakan metode yuridis normatif yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini ialah memastikan bahwa perempuan dapat melakukan aborsi berdasarkan hak memilihnya dan akses terhadap layanan aborsi yang aman tidak terhalang oleh berbagai hambatan praktis dan sosial, dan bahwa hukum yang berlaku di lapangan sejalan dengan ketentuan yang ada dalam kedua undang-undang tersebut. Namun, tetap ada batasan-batasan tertentu yang harus diikuti, seperti batasan usia kehamilan tertentu, konseling, dan persetujuan tertentu yang diperlukan.

Abstract

Mangrove forests are an ecosystem element that is beneficial to the community, especially in the coastal area of ​​Binanga village, Sendana subdistrict, Majene regency. However, gradually the degradation of mangrove forests occurs which turns into community economic activities which indirectly erode the benefits of mangroves. The management and use of land in the mangrove forest area in Binanga village, Sendana subdistrict, Majene district, West Sulawesi province seems not to be optimal in managing spatial planning so that the mangrove vegetation is threatened with destruction. This research aims to provide an analysis regarding the regulation of coastal areas as mangrove conservation zones in Binanga village, Sendana District, Majene Regency. The type of research carried out is normative juridical with a statutory approach and a conceptual approach. The research results conclude that the policy of regulating coastal areas as mangrove conservation zones needs to be managed wisely and sustainably so that the impact of human activities can be controlled and some coastal areas are maintained for conservation. Apart from that, it is necessary to institutionalize mangrove resource management in Binanga village, by optimizing the role of the village government and establishing a Mangrove Forest Resource Management Institution (LPS-HM) in the village as a formal institution established by the Village Government.

Abstract

This research is conducted to compare literature regarding the regulation and implementation of leniency programs specifically against cartels in Indonesia. The Competition Law of Indonesia under Law Number 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition does not regulate leniency programs. The United States, the European Union, Japan, South Korea, and Singapore have implemented leniency programs to combat cartels in their countries, and these have proven effective. These countries have made amendments to their anti-monopoly or anti-cartel regulations. Reflecting on these advanced nations, which have successfully implemented leniency programs, Indonesia could adopt such measures effectively. However, due to the absence of legislative regulations serving as a legal basis for leniency programs, implementation becomes challenging. Indonesia must be ready to accept and initiate a movement that can bring about changes to improve the legal system. Leniency programs to eradicate cartels are one of the ways forward for Indonesia, representing a positive new initiative.
