Abstract

The notary as a public official in carrying out his duties and obligations to make an authentic deed is obliged to act impartially (independent) to the appearers so that the authentic deed made by him avoids legal problems, namely a lawsuit for the cancellation of the authentic deed.This notary does not receive legal sanctions, either administrative sanctions in the form of written warnings, suspension, dismissal with respect and dismissal with disrespect, civil sanctions in the form of compensation claims by the appearers or the injured party for the issuance of the authentic deed, or criminal sanctions in the form of filing a notary public to the police by the injured party and can be sentenced to imprisonment.The obligation to act impartially (independent) to the appearers in making authentic deeds in accordance with the provisions of paragraph 1 of Article 16 of Notary Position Law No. 2 of 2014 concerning amendments to the Notary Position Law No.30 of 2004. The results of this study indicate that the legal criteria for acting impartially for the notary in order to carry out their duties and obligations to make an authentic deed based on the Notary Position Law and notary code of ethics is that the notary must act impartially or neutral towards the appearers, not act as the party in making such authentic deed and not making authentic deed for the benefit of children, wife and family of notaries in lineage.The legal consequence of an authentic deed made by a notary when the notary takes sides in making the authentic notary deed is that the authentic deed is only powerful as a deed not made before an public official, and a lawsuit for cancellation can be submitted to the court by the injured party,and legal sanctions on the contents of the deed containing partiality to one of the parties is that the notary may be subject to administrative sanctions in the form of a written warning, suspension (suspension), dismissal with respect and dismissal with no respect.

Abstract

Penerbitan sertipikat pengganti ini sangat penting bagi pemegang hak atas tanah, karena dengan sertipikat adalah bukti yang menunjukkan bahwa dia adalah pemilik dai tanah tersebut. Maka dalam hal ini Pemerintah memberikan solusi ataupun jalan keluar bagi masyarakat yang mengalami kerusakan ataupun kehilangan sertipikat hak atas tanah yaitu dengan adanya suatu sertipikat pengganti. Metode yang dipakai maka penelitian ini dapat digolongkan dalam jenis penelitian yuridis normatif yang dilakukan dengan cara menelaah dan menginterpretasikan hal-hal yang bersifat teoritis yang menyangkut asas, konsepsi, doktrin dan norma hukum yang berkaitan dengan kekuatan hukum penerbitan sertipikat tanah pengganti. Dari hasil penelitian maka dapat ditarik beberapa kesimpulan: Sertipikat pengganti yang telah diterbitkan sama halnya dengan perlindungan hukum terhadap pemegang sertipikat hak atas tanah yang pertama kali, dimana sertipikat tanah merupakan alat bukti yang kuat, yang memberikan kepastian dan perlindungan hukum bagi pemiliknya, karena setelah diterbitkannya sertipikat pengganti, maka dilakukan pembatalan terhadap sertipikat yang hilang tersebut, sehingga sertipikat yang lama tidak berlaku lagi.  Kekuatan hukum atas sertipikat pengganti yang telah diterbitkan Sertipikat pengganti mempunyai kekuatan hukum yang sama dengan sertipikat yang dinyatakan hilang, karena sama-sama merupakan salinan buku tanah dan surat ukur dengahn nomor yang sama. Faktor-faktor penghambat yang dihadapi dalam pelaksanaan penerbitan sertipikat pengganti hak atas tanah adalah hambatan dari pihak kantor Pertanahan Kabupaten Deli Serdang antara lain kurangnya sumber daya manusia (SDM) yang dalam hal ini tenaga ahli di bidang pertanahan.

Abstract

 One of the objectives of land registration activities conducted by the Government including complete systematic land registration is to create legal certainty and protection including legal certainty of the object of land field. The application of a contradicture delimitation principle in the framework of complete systematic land registration becomes important to be examined in an effort to realize the legal certainty of land object that aims to avoid the occurrence of disputes, conflicts and the land issues in the day. The type of research used is research on empirical law by using primary data that is submitted from field research with the method of interview to the party of Medan Land Office, and the secondary data obtained by the method of literature study.  Keywords : Contradictory Delimitation, Field Measuring, Complete Systematic Land Registration. Salah satu tujuan dilakukannya kegiatan pendaftaran tanah yang dilakukan oleh pemerintah termasuk pendaftaran tanah sistematis lengkap yaitu untuk menciptakan kepastian dan perlindungan hukum diantaranya kepastian hukum atas objek bidang tanah. Penerapan asas kontradiktur delimitasi dalam rangka pendaftaran tanah sistematis lengkap menjadi hal yang penting untuk dikaji dalam upaya mewujudkan kepastian hukum terhadap objek bidang tanah yang bertujuan untuk menghindari terjadinya sengketa, konflik dan perkara pertanahan dikemudian hari. Jenis Penelitian yang digunakan adalah penelitian hukum empiris dengan menggunakan data primer yang diproleh dari penelitian lapangan dengan metode wawancara kepada pihak Kantor Pertanahan Kota Medan, dan data skunder yang diperoleh dengan metode studi kepustakaan. Kata Kunci : Kontradiktur Delimitasi, Pegukuran Bidang, Pendaftaran Tanah Sisematis Lengkap.

Abstract

Fiduciary collateral is a guarantee for tangible and intangible movable objects given by the debtor to the creditor as the recipient of fiduciary collateral to guarantee repayment of the debtor's debt to the creditor in a loan agreement at the bank.The binding of fiduciary collateral results in the creditor having the preferred position of the fiduciary collateral object to execute the fiduciary collateral object in paying off the creditor's receivable.Confiscation of fiduciary collateral objects by the state through a court ruling that has permanent legal force because the debtor's mistake is not the responsibility of the creditor, and the creditor can file resistance (verzet) on the confiscation of the fiduciary collateral object. The results indicate that the implementation of a financing agreement with fiduciary collateral in a finance company PT. OTO MULTIARTHA is a customer obliged to fill out a loan application form completely by filling in his identity based on the data contained in the resident identification card and family card, the type of goods to be financed, the amount of the down payment, the installment period, the amount of installments each month, then the customer sign the application for credit and is also signed by the guarantor, both husband and wife, or the biological parent / guardian of the applicant.The legal status of the fiduciary collateral object which was confiscated by the state through a court decision related to criminal cases of conservation of biological natural resources and their ecosystems is the property of PT. Oto Multiartha and must be returned by the state through a court decision to PT. Oto Multiartha,because the debtor's debt has not been paid off and analysis of Medan District Court's Decision No. 315/PDT/2015/PT.MDN in the Case of Confiscation of Fiduciary Collateral Object in the form of a Car of Daihatsu Xenia which instructs to return the fiduciary security object in the form of 1 (one) unit car of Daihatsu Xenia is in accordance with applicable legal provisions under Articles 20 and 24 of Law No. 42 of 1999 concerning fiduciary collateral and also based on Article 194 and paragraph 6 of Article 195 of Criminal Code and Article 574 of Civil Code.
