Abstract

AbstractIn the current Government era where the Construction service industry has developed rapidly with all-round technology, the problem of claims is well known and is a common problem between Service Users and Service Providers in the Implementation of Construction Projects. Service Providers compete to win job tenders. Almost all service providers master technology and the ins and outs of construction services so that the price difference offered by the Service Provider at the time of the tender is no longer related to the difference in the price of goods and wages for a job but they are competing in their work efficiency. Construction service companies look for opportunities to win tenders not in terms of efficiency but in their prudence to see large claims opportunities at the time of the tender. Indonesia has interpreted the claim as a claim / lawsuit, so that the claim is not handled and served well but treated as something scary, therefore the government issued regulations that can regulate dispute resolution. The formation of arbitration is an interesting study of legal politics, given that its application is still an effective and professional problem so that the principles of justice and equality as mandated by Law No. 18/1999. This study requires two studies, namely one, how is the Indonesian Legal Dispute Resolution in arbitration? Second, what is the political understanding of arbitration law and what is its purpose. This study uses normative legal research methods which include research on legal principles. This study basically uses a qualitative method that examines the concept of the legal concept of political arbitration in its formation (legal politics). With the aim of providing an overview of the development of law in Indonesia, especially in the context of arbitration law. The results of this study note that the development of economic law, especially in the regulation of arbitration law tends not to start from the values that exist in society, but is taken from an urgent need at the time of reform even though it is in line with the development of law in the process of legal reform for justice and welfare law for the community, especially for entrepreneurs and business actor.

Abstract

With no control over the problems that threaten the extinction of endangered species in the world. An organization whose job is to provide protection for animals, which is named the International Union for Conservation of Nature andNatural Resources (IUCN) formed and signed the CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora), which is an International agreement related to protection and international trade in endangered species of wild animals and plants. Illegal wildlife trade threatens Indonesia biodiversity. CITES indirectly becomes a consideration foe making national rules. Therefore Indonesia has ratified CITES through Presidential Decree No.43 of 1978 and established Law No.5 of 1990 concerning Biological Natural Resources and their Ecosystems, as well as through BKSDA, as the executor of the task of carrying out conservation and overcoming free trade of endangered species.

Abstract

The maritime dispute between Indonesia and Malaysia in the Malacca Strait began with unilateral claims from both countries. Based on the 1982 Law of the Sea Law (UNCLOS) the Malacca Strait experienced an overlapping of the Exclusive Economic Zone (ZEE). Indonesia and Malaysia both ratified the 1982 Sea Law Convention (UNCLOS) and are in force today. Conflicts regarding the Exclusive Economic Zone (ZEE) between Indonesia and Malaysia can be resolved by litigation (court) and non-litigation (outside the court) can use bilateral agreements between countries. In article 280 UNCLOS 1982 that each State has the right to resolve disputes that exist in the way they want. The purpose of writing to find out how to resolve sea border disputes between Indonesia and Malaysia in the Malacca Strait region according to International Sea Law.

Abstract

In this discussion the authors take a case study of the Natuna Islands because Indonesia is one of the countries threatened with loss because Chinese vessels violate the Exclusive Economic Zone (EEZ) in the Natuna Islands, Riau Islands Province which is part of Indonesia. At first glance, the gas-rich waters seem to enter China's sovereignty. China's claims to Indonesia's Exclusive Economic Zone have no legal basis and are not recognized by UNCLOS. So in this case an adequate set of legislation is needed in order to maintain and empower it. Reviewing various laws and regulations such as Laws, Government Regulations, Presidential Decrees, etc. relating to the handling of national borders and borders in the Natuna Islands region.

Abstract

Children as the next generation of the nation become the hope of Indonesia's development in the future. Of course, when children face legal problems, they are entitled to get legal protection in order to achieve a sense of justice itself. In reality, children who are dealing with the law, both their capacity as perpetrators and victims are very vulnerable and so easily become victims of legal injustice. There are factors that must be considered in the process of law enforcement in order to achieve a sense of justice, including by choosing the right punishment for the child. Diversity and the concept of restorative justice need to be taken into consideration in handling cases of children who commit criminal acts of child protection.This writing is a normative study, then analyzed qualitatively by descriptive methods. Based on the results of the discussion and analysis, it is concluded that the diversion stages and the concept of restorative justice are needed as a consideration for judges to impose their convictions.

Abstract

Dewasa  ini,  tindak  pidana  korupsi  di  Indonesia  telah  mengakar  di  setiap  sendi  kehidupan. Terjadinya perbuatan korupsi tidak hanya ditentukan oleh pelaku, tetapi ditunjang pula dengan kesempatan yang diberikan olehaktor prabayar maupun sistem yang berlaku. Contohnya dapat kita simak dari peristiwa APBN yang seharusnya murnidigunakan untuk kesejahteraan rakyat, justru berubah menjadi lahan subur praktik korupsi oleh oknum pejabat pemerintahan.Langkah penggempuran pertama yang seharusnya dilakukan oleh pemerintah adalah penanaman pendidikan anti korupsi disetiap jenjang pendidikan dan di kalangan masyarakat, seperti di tingkat desa, RT, dan RW. Di samping penanaman pendidikananti korupsi, diperlukan pula penyelenggaraan reformasi sistem birokrasi secara transparan, akuntabel, dan netralitas.Selanjutnya, yaitu diadakan penguatan dalam konsep beserta kerangka kerja koordinasi dan supervisi pemberantasan korupsi diBadan Kepolisian RI maupun Kejaksaan Agung, yang disarankan agar mempunyai kelembagaan khusus yang berfungsi kedalam dan ke luar. Langkah terakhir yaitu adanya peran serta masyarakat secara terbuka dan partisipatif.

Abstract

This writing is based on the legal protection of Indonesian workers who are abroad, as a guarantee for a sense of trust and security in working in a foreign country, get clear legal protection, and to examine explicitly how social security for Indonesian Migrant Workers according to International Convention and the Act Number 18 of 2017 concerning Protection of Indonesian Migrant Workers. Using writing methods based on normative legal research, also known as doctrinal law research. Legal protection given to Indonesian Migrant Workers sought by the government for the creation of legal regulations that protect all activities of Migrant Workers who are Abroad. The government has the responsibility and obligation to safety and protect all its citizens wherever they are legally, so that their citizens have a sense of security of the right to work and there are no longer any cases that threaten the safety of Indonesian Migrant Workers.

Abstract

In Article 12 point j of Act Number 2 of 2008 concerning Political Parties, a political party has the right to form and have a Political Party Wing Organization.  However, there hasn’t been a further or a specific Political Party Wing Organization regulation both in the elucidation of the Act and the implementation regulations of the Act. This study has the main objective to find the legal status of the Political Party Wing Organization in Indonesia. This research is a normative juridical research. This study concluded that the legal status of the Political Party Wing Organization can be regulated as a public legal entity which is a part of the political party or an independent legal entity. We strongly suggest the regulation of the Political Party Wing Organization must be specified as a chapter in the Political Parties Act or perhaps as a new Act.
