Abstract

The results of this research are as follows: First, Article 2 and Article 3 of the Anti-Corruption Act does not meet the principles in the formulation of a crime namely lex certa (must be clear and not multiple interpretations) and lex stricta means the formulation of the criminal act must be interpreted firmly and strictly and is prohibited from analogizing so it is not prohibited from analogizing. reflecting legal certainty and contradicting Article 28 D paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The limitation for the Board of Directors to achieve legal certainty and justice is the application of the Business Judgment Rule principle as regulated in the Limited Liability Company Law. Law enforcers must always pay attention and uphold the principle of legality in law enforcement, which reflects legal certainty.Key words: Corruption Crime, Board of Directors Authority, Regional Owned Enterprises (BUMD) Persero Company.

Abstract

During the Covid-19 pandemic the Government through the Ministry of Law and Human Right Regulation, issued an Assimilation Policy and Integration for Adult and Children Inmate. The implementation of this policy is accompanied by a monitoring device for Inmates who receive the program. Supervision of the implementation of assimilation and integration is carried out by the Rehabilitation center (Bapas), with a supervisory officer called the Social Adviser (PK). The supervision is carried out by observing and assessing the implementation of the service program, coaching and mentoring of the prisoners that are conducted by online. This supervision is a means of preventing and controlling the Covid-19 virus, and so that they do not violate the law again. Supervision that is not carried out optimally can result in violations of the law again by the perpetrators of criminal acts. Especially in a pandemic situation, the repetition of violations of the law is in the public spotlight, because it makes a double impact on the community apart from the pandemic impact. Based on the description above in this Scientific Writing, the writer takes the title "Juridical Analysis On The Supervision Of Assimilation And Integration To Adult And Child Inmates During Covid 19 Pandemic (Study At Class 1 Rehabilitation Center Of Malang)". This research has the formulation of the problem in the form of: how was the supervision of assimilation and integration for adult and children inmates during the Covid-19 Pandemic? and what factors influence the implementation of assimilation and integration supervision for inmate parole and integration when the Covid-19 Pandemic? Furthermore, this study aims to describe and explain the supervision of assimilation and integration for adult and children inmates when the Covid-19 Pandemic, also describe and analyze the factors that influence the supervision of assimilation and integration for adult and children inmates during the Covid-19 Pandemic.Keywords: Oversight, Assimilation, Integrity, Prisoners, Children

Abstract

This research resulted, First, with the informed consent not necessarily the medical staff / doctor cannot be sued or prosecuted, precisely with the existence of this informed consent the medical staff / doctor must work professionally and in accordance with operational standards as stated in informed consent. Second, hospitals as legal entities (corporations) can be prosecuted and accounted for by malpractice actions of health workers in hospitals. Article 46 of Law Number 44 Year 2009 concerning Hospitals that hospitals must be responsible for negligence committed by doctors practicing in hospitals is a burden borne by the owner and management of the hospital. Third, there are several efforts that can be taken in the event of negligence or malpractice by health workers / doctors / hospitals, namely by reporting to the MKEK / MKDKI, conducting mediation, civil litigation and criminal reporting.Keywords: Informed Consent, Patient, Hospital

Abstract

The purpose of this study was to analyze BPJS Health services in Kertosono District Hospital Nganjuk District, and to analyze the supporting and inhibiting factors of BPJS Health services in Kertosono District Hospital Nganjuk Regency. The results of this study are: First, health services in Kertosono Regional Hospital Nganjuk said to be very good, it is because of the commitment of the Kertosono Regional Hospital who want to provide health services according to good standards and based on public service standards to the community. Second, the supporting factors in providing services to patients are, the attitude of employees who are friendly and polite, the services provided are satisfactory and the flow is easy, there are poster announcements related to BPJS, clear goals and objectives, and sufficient financial. The inhibiting factors of HR owned by hospitals are not comparable to those treated (patients), frequent miscommunication between officers and patients, incomplete medical devices, inefficiency of the BPJS claim process, and arrears of payment from the BPJS.Keywords: Services, Health, Badan Penyelenggara Jaminan Sosial (BPJS)

Abstract

Violence that has a psychological impact on children's education is currently not clearly regulated in Indonesian law. The law only explains the various forms and rules regarding violence in general. Problems will occur when a child (student) experiences violence, be it physical, psychological, or sexual violence thathas an impact on the victim's psychological can not hold the perpetrator accountable, because if the case of violence is brought to the law, the perpetrator will only be subject to the article related to violence or visible wounds. As for the psychological impact felt by the victims there are no rules to sanction perpetrators of violence to be responsible for the psychological state of their victims. The purpose of writing this law is to know and analyze legal protection guarantees for children victims of physical violence that have psychological impact on the continuity of formal education of children and also to determine the appropriate form of legal protection for children victims of physical violence that have psychological impact on the sustainability of children's formal education . This legal writing uses a type of normative juridical and this study also uses a qualitative descriptive analysis method.Keywords: Legal Protection, Violence, Psychic, Children's Education

Abstract

Legal protection or legal assistance for government procurement of goods services is actually regulated  in relevant laws and regulations, but what kind of protection has not been explained and regulated in detail in the laws and regulations. Due to the absence of a rule that regulates explicitly and clearly related to the protection of actors in the procurement of government goods/services and the lack of attention from the government.
