Abstract

Results: Hasil menunjukkan bahwa korban kini memperoleh perlindungan melalui UU No. 13 Tahun 2006 tentang Perlindungan Saksi dan Korban serta memiliki hak menuntut ganti rugi melalui proses mediasi dan gugatan perdata. Highlights: Perlindungan korban diatur secara eksplisit melalui UU No. 13/2006. Penyelesaian perkara perdata diawali dengan mediasi sebelum pengadilan. Proses hukum menjamin hak korban atas kompensasi dan pemulihan keadilan. Keywords: Civil Law, Assault Case, Legal Protection, Compensation, Indonesian Law

Abstract

General Background: Trees play a vital role in maintaining environmental balance, particularly along roadways, contributing to ecological stability and human well-being. Specific Background: In Sidoarjo, tree protection policies are implemented by the Environmental Service to regulate business activities, yet challenges remain in enforcement. Knowledge Gap: Despite existing regulations, including Regent Regulation No. 29 of 2018, the protection of tree functions has not been fully effective, highlighting gaps between national law, local regulations, and practical implementation. Aims: This study aims to examine the legal protection of tree functions in Sidoarjo and assess regulatory implementation. Results: Findings indicate that while national and local regulations, such as UU No. 32/2009 and Perda No. 8/2013, provide a legal basis, the execution of tree protection policies remains suboptimal due to overly comprehensive local regulations that dilute enforcement strength. Novelty: The study integrates normative juridical analysis with local policy evaluation, providing a critical perspective on the alignment of environmental protection laws with administrative practice. Implications: Strengthening regulatory coherence and enforcement mechanisms is essential to ensure sustainable urban environmental management and fulfillment of citizens’ rights to a healthy environment. Highlights: National and local laws provide a strong legal basis for tree protection. Enforcement of tree protection in Sidoarjo is not yet optimal. Overly comprehensive local regulations reduce practical enforcement strength. Keywords: Tree Protection, Environmental Functions, Sidoarjo, Legal Regulation, Roadways

Abstract

Background: Open trip mountain services organized by communities are increasingly popular but prone to breaches of contract, causing losses to climbers. Specific Background: Cases such as forced descent at Pos 2 Sembalun Lawang, Gunung Rinjani, highlight the lack of clarity regarding compensation rights in community-managed trips. Knowledge Gap: Existing literature rarely addresses the intersection of civil law principles and economic transaction theories in regulating compensation for open trip services. Aim: This study analyzes legal obligations and compensation mechanisms for climbers affected by breaches of contract using civil law perspectives and supply-and-demand theory. Methods: Normative legal research with statutory and economic theory approaches, supplemented by secondary sources, analyzed descriptively. Results: Participants are entitled to compensation when services fail to meet agreed standards. Theories of offer, acceptance, and trust clarify when agreements are legally binding and how liability arises. Dispute resolution can occur through mediation, arbitration, or court litigation, with distinct procedural considerations. Novelty: Integrating legal theory with economic principles provides a clearer framework for determining compensation and managing expectations in open trip services. Implications: Understanding these frameworks enhances legal certainty and protects climbers’ rights in community-organized outdoor tourism. Highlights: Legal responsibility arises upon confirmation of trip participation. Theories of offer, acceptance, and trust guide compensation claims. Multi-path dispute resolution supports fair and efficient outcomes. Keywords: Compensation, Breach of Contract, Open Trip, Civil Law, Community Tourism

Abstract

General Background: The 2024 General Election in Indonesia emphasized transparency and fairness, with campaign periods becoming critical for political competition. Specific Background: In Sidoarjo Regency, numerous campaign prop (APK) violations occurred, reflecting challenges in compliance with electoral regulations. Knowledge Gap: Limited studies have analyzed empirical data on the scale and type of campaign prop violations at the regional level in relation to local law enforcement practices. Aims: This study examines the forms of campaign prop violations and law enforcement measures undertaken by the Sidoarjo Regency Election Supervisory Agency (Bawaslu) to ensure alignment with election law. Results: Findings indicate 5,599 total violations, dominated by the PDIP party with 1,068 cases, primarily related to the misuse of public facilities for campaign materials. Enforcement actions included administrative sanctions such as written warnings and prop removal. Novelty: This research provides region-specific empirical data on electoral violations and demonstrates the role of local Bawaslu in maintaining legal compliance. Abstract

General Background: The railway system serves as a vital component of public transportation supporting human mobility and logistics. Specific Background: However, persistent violations of the prohibition against being on railway tracks remain a serious safety issue in Indonesia, particularly in suburban and rural regions. Knowledge Gap: Despite the existence of Law Number 23 of 2007 concerning Railways, limited studies have examined the law’s juridical interpretation and its uneven enforcement between urban and rural areas. Aims: This study aims to analyze the legal basis, enforcement barriers, and implementation differences regarding the prohibition of being on railway tracks. Results: Findings reveal that enforcement is more consistent in urban settings due to stronger supervision and infrastructure, while rural areas face challenges stemming from weak law enforcement, poor coordination, and low legal awareness. Novelty: This research provides a juridical and comparative insight into the disparities in legal application across regions. Implications: Strengthening safety infrastructure, community legal education, and interagency coordination are essential to achieve legal compliance and public safety in railway operations. Highlights: Law enforcement is stronger in urban areas than in rural ones. Legal awareness and safety infrastructure remain key challenges. Coordination among authorities is vital for public railway safety. Keywords: Railway Law, Legal Prohibition, Public Safety, Law Enforcement, Indonesia

Abstract

Background: Divorce in Indonesia often leaves disputes over property division, particularly regarding the distinction between joint property and inherited or premarital assets. Specific Background: A recurring issue is whether personal assets renovated during marriage can be considered joint property, given unclear regulations and limited case law guidance. Knowledge Gap: Current laws, including Law No. 1 of 1974 and the Compilation of Islamic Law, do not explicitly address the status of renovated inherited property, leaving courts to rely on principles of contribution and fairness. Aim: This study examines how renovated personal assets are treated in divorce cases at the Sidoarjo Religious Court and provides recommendations for legal clarity. Method: Using a normative juridical approach with statutory and case study analysis, data was collected from legislation, court decisions, and legal literature. Results: Renovations to personal property can be classified as joint property if supported by significant financial or non-financial contributions from both spouses; otherwise, they remain personal property. Evidence and proof of contribution are critical in court decisions. Novelty & Implications: The study highlights the need for clearer regulations and public awareness to prevent disputes, ensure fair asset distribution, and protect the rights of both spouses and children in divorce proceedings. Highlights: Renovated inherited assets may become joint property with documented spousal contribution. Evidence of financial and non-financial contributions is crucial in court recognition. Clearer regulations are needed to reduce disputes and ensure fairness. Keywords: Joint Property; Inherited Property; Divorce; Asset Renovation; Legal Contribution
