Abstract

Crew members are workers on the ship, in their duties and functions in operating and controlling cargo loads in their duties often get a lot of difficulties and which can result in several problems. Such as physical violence, sexual violence so that it can result in many violations that lead to human rights violations. The presence of crew members in the middle of the sea occasionally gets difficulties from the Indonesian government authorities in controlling their work to the safety of the crew members. The research that has been made is aimed at analyzing the protection and rule of law in the scope of national law and international law. This research is very aimed at making a contribution to the State of Indonesia so that it can provide protection in accordance with the provisions of laws that apply nationally and internationally. In international legal conventions, there are various arrangements that should provide legal protection for workers or crew members, which in principle have the context of international legal standards.

Abstract

In the 1945 Constitution there are two regulations regarding emergency situations (danger) which are regulated in two articles, namely Article 12 and Article 22. Article 12 of the 1945 Constitution states, "The President declares a state of danger, the conditions and consequences of a state of danger are determined by law". Then Article 22 paragraph (1) of the 1945 Constitution states, "In the event of a compelling urgency, the President has the right to stipulate government regulations in lieu of law". From the above provisions, it can be seen that there are two categories of circumstances according to the 1945 Constitution, namely (1) conditions of danger and (2) matters of compelling urgency. The terms (legal terms) used in the two articles are clearly different, the first term uses the term "danger" which is nothing but the same as the definition of an emergency. This research uses normative juridical research. The problem approach used in this research includes a legal approach, a conceptual approach, a case approach and a comparative approach. This research is a deductive research that describes legal events and legal consequences associated with the establishment of state emergencies in several countries. The data obtained were collected and analyzed qualitatively with a descriptive-analytical model. So that the results can be described comprehensively and systematically regarding the basic considerations in establishing the rule of law. The provisions regarding Article 12 and Article 22 paragraph (1) of the 1945 Constitution are basically also related to Article 10 and Article 11 paragraph of the 1945 Constitution. The problem in this research is how to regulate the legal basis for determining the status of a state emergency in Indonesia. with the United States? What is the President's authority in determining the state of emergency status in Indonesia with the United States?

Abstract

Education as a form of dynamic behavior change, both culture, civilization and community conditions. Education can accommodate changes that also occur in the era of the industrial revolution 4.0, globalization, the growth of the millennial generation, and national issues in the form of national civilization, national competitiveness, access to education, quality of education, vocational education and Indonesian employment, nationalism, radicalism, cultural/economic industries. creative, health, gender, demographic bonuses as challenges in the world of education. The social research method used is qualitative. The results showed that the method of education and training for PAUD teachers in the period after adapting to new normal learning or in adaptation after going through a pandemic period, began to be carried out by using virtual online training. The training method is carried out by learning using the Systematic Offline and Online Combination Mode Method in the context of career development through increasing the competency qualifications of PAUD teachers in the industrial era 4.0 the parties who are the institutions providing training for PAUD teachers. Education and training are expected to contribute to the realization of quality education for all Indonesian PAUD teachers.
