Abstract

Pemilihan Kepala Daerah secara langsung yang dipilih oleh rakyat, Penyelenggaraan Pemilihan Kepala Daerah (Pilkada) sejatinya merupakan bagian penting kehidupan bernegara Indonesia di era Reformasi. Pilkada secara lansung juga diharapkan bisa menghasilkan kepala daerah yang memiliki akuntabilitas lebih tinggi kepada rakyat. Pilkada langsung adalah wujud nyata dari pembentukan demokrasi di daerah. Kepala daerah dan wakil kepala daerah dipilih dalam satu pasangan calon yang dilaksanakan secara demokratis berdasarkan asas langsung, umum, bebas, rahasia, jujur dan adil. setiap hak warga negara dijamin oleh undang-undang sebagaimana di atur dalam UU No. 12 tahun 2005 tentang Pengesahan International Convenant on Civil and Political Rights, (Konvenan Hak-hak Sipil dan Politik. Salah satu pemenuhan syarat sebagia calon kepala daerah diantara tertuang dalam putusan nomor 56/PUU-XVII/2019, yaitu bagi calon kepala daerah yang telah selesai menjalani masa pidana diharuskan menunggu waktu selama 5 (lima) tahun untuk dapat mengajukan diri menjadi calon Kepala Daerah.

Abstract

Rumusan masalah dalam penelitian ini adalah : (1) Landasan hukum pengaturan pidana pornografi yang korbannya anak., (2) Pertanggungjawaban pidana terhadap pelakunya. Dari penelitain hukum yang telah dilakukan dengan menggunakan penelitian yang disebutkan diatas dapat disimpulkan bahwa, pada rumusan masalah yang pertama mengenai Landasan hukum terkait pidana pelaku pornografi yang korbannya anak dapat dilihat dari Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang RI No. 23 Tahun 2002 tentang Perlindungan Anak serta Undang-Undang RI No. 35 Tahun 2014 Tentang Perubahan Atas UU No. 23 Tahun 2002 Tentang Perlindungan Anak, Undang-Undang No. 44 Tahun 2008 tentang Pornografi, dan Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, Sedangkan pada rumusan masalah yang kedua akan membahas mengenai Pertanggungjawaban pidana terhadap pelakunya.

Abstract

The study aims to find out and analyse what qualifications for criminal acts of Macar and to know and analyze when the perpetrators of the matter convey public opinion can be categorized as Makar crime. The methods of study used are normative juridical, based on the principles of the law, the rules of the law and the legislation or books/literature relating to Makar action. Normative legal research is a study that examines prevailing norms including laws that have relevance to the problem as the source of legal material. Based on the results of the study can be concluded that communicating in public is permissible because it is part of human rights, namely the right of freedom to convey opinion as stipulated in article 28 CONSTITUTION of the Republic of Indonesia year 1945. Expressed opinion may be categorized as a criminal offence if it meets the provisions of article 88 of KUHAP. In article 88 the criminal CODE stated that there is an evil agreement, if two or more people have agreed to commit the crime, continued in article 88 of the bus with the overthrow of the government is negating or changing the form of unauthorized government under the Constitution. Therefore, presenting opinions in public can be categorized as Makar action if it is evident that in the implementation there is an indication or that has an intention to overthrow the government, with the intention to kill, or seize independence, or negate the ability of the President or vice President ruled.

Abstract

This study provides an overview of the implementation of Village Fund management in Konawe District, as well as the factors that influence implementation and strategies that must be carried out in order to improve implementation, as well as providing assistance to Local Governments in developing Village Funds. The implementation of the Village Fund management policy in Konawe District has been carried out since 2015. However, with the approval of the goals, the implementation of the Village Fund in Konawe District has not been optimal. The planning formulation process has not yet been approved according to established procedures, discussion of the objectives of improving governance, development and community empowerment, has been carried out optimally, but the goal of continuing to increase the capacity of community institutions in the village in planning, implementing and developing development has not run optimally. Likewise, the accountability program has not been carried out optimally which does not have a standard operating procedure on the systematic arrangement of the responsibility. Some of the factors that influence the implementation of the Village Fund in the Konawe Regency are communication, resource capabilities, implementing attitudes, and bureaucratic structures. the main instrument in research is the researcher itself. Data sources used are primary data sources and secondary data relating to policies and empirical requirements for the implementation of the Village Fund Management Policy. In this study, also using survey research to obtain primary data on village funding policies in Konawe District.

Abstract

The purpose of this study is to determine the business continuity of PT. Hero Supermarket Tbk by using secondary data in the form of financial statements from 2014 - 2018. This study uses the Altman Z Score method which is one method to assess bankruptcy of a company. The results of the study are based on data taken from PT. Hero Supermarket Tbk from 2014 - 2018 shows that the condition of the company continues to experience a decline in performance, especially in the food sales segment. The closure of several Giant outlets is the company's step in overcoming the financial condition that continues to decline. The results of the assessment by the Z Score method show that PT. Hero Supermarket Tbk experienced financial distress in 2017 (Z Score 1.66) and 2018 (Z Score 1.27). However, the business progress of PT. Hero Supermarket Tbk can still be supported by the beauty health and home furnishing segments namely Guardian and IKEA.

Abstract

Akibat dari lemahnya aturan sanksi kepada peserta BPJS terkait kewajiban iuran, BPJS kesehatan pada tahun 2019 mengalami defisit sekitar Rp. 500 miliyar dari proyeksi awal pada tahun ini. Pada proyeksi awal total kerugian mencapai Rp. 28 Triliun tahun ini. Dengan proyeksi terbaru, defisit membengkak menjadi Rp. 28,5 triliun pada tahun ini. Proyeksi pembekakan tersebut berasal dari pengalihan defisit tahun 2018 ditambah beban pembayaran tagihan rumah sakit sejak awal tahun 2018.Direktur keuangan BPJS Kesehatan Kemal Imam Santoso mengatakan perusahaan masih memiliki carry over defisit keuangan Rp. 9,1 triliun dari tahun lalu. Sementara defisit keuangan pada tahun ini mencapai lebih dari Rp. 19 triliun. Kenaikan potensi defisit keuangan terjadi akibat banyak faktor, salah satunya adalah kurangnya kepedulian terhadap kewajiban membayar iuran, selain itu devisit yang terjadi setiap tahun dan terus bertambah disebabkan banyaknya peserta mandiri yang tidak membayar iuran atau membayar iuran hanya saat membutuhkan pelayanan kesehatan . selain itu tunggakan pembayaran iuran juga banyak dilakukan oleh pemberi kerja atau perusahaan bahkan pemerintah daerah, dengan terjadinya hal seperti ini maka korban dari defisit adalah peserta yang selalu memenuhi kewajibanya.

Abstract

The aim of this research is to identify the existing condition of the Jl. Cikapundung Barat of Bandung night culinary region, resistant factors in developing and the effort of developing the region in order to support the cultural heritage tourism development region Alun-alun-Braga. The Methodology used is descriptive qualitative to describe data of the phenomena derived at the locus of the research namely Bandung Cultural and Tourist Office and the Region of Night Culinary Jl. Cikapundung Barat of Bandung. Interactive and SWOT analysis are used to analysis collected data as consideration to determine development strategy. Data collections were derived by observation at the locus and interview with Bandung Cultural and Tourism Office, food seller, visitors and the local society of the region. The discussion of this research is focused on development strategy based on SWOT analysis of the Jl. Cikapundung night culinary region of Bandung and assessment of the Alun-alun-Braga Region. The result is to integrate the Jl. Cikapundung Barat of Bandung as apart of the cultural heritage tourism development region Alun-alun-Braga.

Abstract

This research is based on the theory of Marketing Management science related to the development of the digital economy in modern global-based platform organizations as one of the applications that accelerates and facilitates the use of online shopping application services in Indonesia. This research method uses a quantitative descriptive approach with the nature of the research is explanatory. The population in this study is the number of digital marketing service users by 120,856 respondents and the sampling technique using the Slovin formula obtained as many as 100 respondents used in this study. The results obtained in this study are that partially the use of digital marketing obtained tcount > ttable (1,588 > 1,290) and easy access to services obtained tcount > ttable (1,434 > 1,290) has a significant positive effect > 0.10 in increasing people's purchasing power Medan city, while simultaneous use of digital marketing and the ease of access of services obtained the value of Fcount> Ftable (2.337 > 2.36) has a positive and not significant effect on increasing the purchasing power of the people of Medan City in the era of the marketing industry revolution 4.0

Abstract

This paper aims to reveal the experience of Tan Deseng, a Sundanese musical artist of Chinese descent, in interpreting the kasundaan he lived. This paper is based on the existence of Chinese descendants who behave in a Sundanese, even more Sundanese than the Sundanese themselves. The qualitative method of phenomenology is used for the collection and analysis of data in revealing Tan Deseng's experience to live as a Sundanese. The results showed that Tan Deseng lives as a Sundanese with all its aspects, from the Sundanese language, Muslim, married to Sundanese, philosophy of life, to the arts as the identity of a Sundanese. According to the criteria of a Sundanese, it can be said that Tan Deseng is a Sundanese subjectively and socio-culturally.

Abstract

Masalah transportasi bukan merupakan sebuah persoalan yang biasa dimasyarakat, transportasi sudah menjadi persoalan yang kompleks, pada dasarnya transportasi berguna bagi perpindahan barang maupun orang dalam jarak yang bahkan bisa dikatakan dekat. Minat masyarakat untuk menggunakan transportasi umum sangat berpengaruh pada sistem yang diterapkan. Dalam sistem transportasi yang baik dibutuhkan beberapa subsistem pembentuk sistem tersebut. Subsistem tersebut dapat diklasifikasikan menjadi tiga yaitu sistem kegiatan, sistem jaringan dan sistem pergerakan. Ketiga sistem tersebut harus berjalan bersamaan karena ada keterkaitan antara ketiganya, bukan tidak mungkin jika ketiga sistem tersebut mengalami kendala pada prakteknya, maka akan mengganggu stabilitas sistem yang sudah dibangun. Undang-undang juga menyinggung tentang sistem transportasi walau secara tekstual tidak disebutkan, hanya secara kontekstual hal itu dapat diartikan dalam sistem transportasi yang efisien dan efektif, maka akan banyak menimbulkan pertanyaan tentang pengaturan sistem transportasi dalam undang-undang.
