Abstract

In the midst of the flourishing of the sharia insurance industry, there are also many lawsuits for default. This study will analyze the application of the legal terms of the agreement based on the KUHPer and the application of sharia insurance contracts in the sharia insurance industry in Indonesia by taking the case study of Anik against PT Asuransi Jiwa Generali Indonesia. As for analyzing the case, a descriptive explanation is used which aims to construct the extent to which the sharia insurance agreement applies the legal requirements of the sharia insurance agreement and contract. Thus, the author recommends strengthening supervision which is analyzed using the juridical-normative method.

Abstract

Divorce can occur due to allegations of adultery by the husband to his pregnant wife so as to relate to the status of his child. The husband's doubts can make him take Li'an's oath. DNA testing is commonly used for personal purposes such as the determination of guardianship of the child or the parent of the child and for a legal purpose. From the analysis, it is known that the status of the child due to Li'an's divorce according to Islamic law is the breakup of the relationship between father and son although it will be known that the child conceived by his wife is true, while according to the law is positive if there is evidence in the form of DNA tests that the child conceived by his wife is the right child of his husband, then nasab relationship with his father remains.

Abstract

Intellectual Property Rights (IPR) is a right that arises from the results of human brain thinking that produces a product or process that is useful for human life. The object of IPR arrangement is a work that arises or is born from human intellectual ability. IPR itself has many kinds such as copyright, brand rights, patents, industrial design, trade secrets, protection of plant varieties, to the design of integrated circuit layouts. IPR itself in the context of Islamic Law is included as a gift of Allah S.W.T.. In this paper, the author is interested in studying IPR in the view from the point of view of property ownership theory and its implications. This is considering the utilization of IPR that can bring commercial value to IPR holders as an exclusive right. Whether the conception is in accordance with Islamic sharia or there are other concepts that are more ideal to be applied.

Abstract

In the application of Islam by its ummah, there are two great teachings, namely the Sunni Sect and the Shi'ite Sect. Shi'ite sects are considered a cult in the application of Islam. As for this sect can be obtained and buried in several countries such as Iran which makes it the official flow of the country, Afghanistan, India, Pakistan, Syria, Lebanon, Greece, Britain, North America, China, and the Soviet Union. As for in this article, the author will discuss the flow of Shi'ite Isma'iliyah and Shi'ite Itsna 'Asyariah which are two of the most famous Shi'ite sects and spread in several countries mentioned earlier. The author will discuss the understanding, the concept of imamah, and the teachings embraced by the two sects of Shi'ite in detail and discuss the parts that are considered heretical in it.

Abstract

Rigid and non-flexible laws will lead to complex conflicts. So that a legal system is needed whose existence can be accepted by the community. This research focuses on how Islamic Law is positioned in the perspective of Indonesian national law as well as how the application of Islamic Law in Indonesia. This research uses normative juridical approach methods by conducting a comprehensive review of theories, concepts and laws and regulations to find answers to problems in research. Thus resulted in a conclusion that the position of Islamic Law in Indonesia has been in line with the philosophical-political, juridical, and sociological order. Although its implementation still finds obstacles, Islamic law has succeeded in contributing to the establishment of national law. This is evidenced by the formulation of Islamic Law into several products of Indonesian laws and regulations.
