Abstract

As a form of government in which the people who are sovereign and in power to determine their lives, democracy not only provides a breath of fresh openness and freedom but also promises a million hopes for a prosperous people's life. However, in line with the history of mankind, the government system that is predicted to be the best model of government from the worst, are also not free from problems, criticisms and crises that occur in it. The sovereignty of the people which has become the spirit of democracy has been eroded by the problem of the crisis of representation and direct involvement of the people in policy making. Democracy as a model of government reaps a crisis of public confidence which starts to regard this government system as an illusion of prosperity and justice. Interestingly, in the midst of the storm of problems that have plagued the democratic governance system in the present era, a breath of a new fresh air has emerged for the continuity of the sovereignty-based government system. In the city of Porto Alegre, Brazil, which is one of the main countries in the Latin American region, alternatives for strengthening participatory democracy have emerged through a model of governance based on Participatory Budgeting. "The implementation of this Participatory Budgeting has turned out to be able to restore the vital role of the people in policy making while at the same time improving the model of modern democratic governance which is increasingly hit by a crisis of trust and legitimacy from the people of today." Keywords: Democracy, crisis of representation, alternative democracy, participatory budgeting

Abstract

PT. Freeport Indonesia began operating in the Mimika district in Papua Province at the Gresberg mining. Their cooperation with Indonesia was marked with a contract of work I (Kontrak Karya / KK), with contract period of 30 years. The contract was made after the legalization of the investment LAW on 7 April 1967. This cooperation had been going long when KK II was established. However, in 2017 there was a change of regulation of natural resources management of Indonesia namely IUPK (Izin Usaha Pertambangan Khusus). This regulation initiated debate between Freeport and Indonesia government to reach a consensus. The method used to collect data in this study is qualitative method. Using mercantilist theory, this study suggests that state income and gains are major aspect in international cooperation.Keywords : Indonesia, Freeport, Mercantilism, and Foreign Policy

Abstract

This research aims to further explore the civil war that is taking place in Syria. This paper questions fundamentally, why did the civil war in Syria become a prolonged armed conflict? Or are there other factors that strengthen the strength of their resistance? This research offers a novelty of research on the situation of this conflict, is that the prolonged civil war in Syria is not only caused by internal conditions, but also the involvement of external actors. As with the approach of David E. Cunningham (2010) that the involvement of external actors in civil war produces two possibilities, namely; become a negotiating facilitator and help one party win. This research reveals that the involvement of external actors interventions - regional, international and transnational – actually prolongs the conflict. This is because the involvement of external actors causes the addition of combatants in the conflict, so the preference in the conflict increases.  Keywords: Civil War, Assad Regime, Regional Actor, International Actor, and Transnational Actor.

Abstract

This study discusses about digital era marked by the advancement of knowledge and innovation in the field of Technology, Information and Communication (ICT) which has provided major changes to all aspects of life, especially in economy. ASEAN as a regional cooperation in the Southeast Asia region, currently as an emerging market in e-commerce competition, especially for Singapore, Malaysia, Thailand, Indonesia, the Philippines and Vietnam (ASEAN-6). Based on this phenomenon, my research question is, how are ASEAN-6's efforts in facing of e-commerce liberalization in the digital era in line with the ASEAN framework (AEC Blueprint 2015 & 2025, ASEAN ICT Masterplan and ASEAN Digital Integration). This research use the theory of trade liberalization, the concept of economic integration and the concept of digital economics to be able to examine the phenomenon of e-commerce liberalization in ASEAN-6. The various literature reviewed by the author shows that the growth of e-commerce is influenced by four factors, namely: 1) internet infrastructure; 2) electronic payment system; 3) shipping services that has a wide coverage; 4) government policy framework in each ASEAN-6 country. In addition, there are several obstacles found including: 1) the geographical location of each ASEAN-6 country that affects the process of developing the internet infrastructure; 2) issues of personal data protection and cyber security related to electronic payment systems; 3) effectiveness and efficiency of the existence of shipping services, especially shipping between countries; and 4) policy discrepancies between countries. This study concludes that as a regional organization in Southeast Asia, ASEAN continues to strive to harmonize regulations among member countries, form a framework of cooperation and other agendas to be able to harmonize the development of ICT, especially the growth of e-commerce. The fundamental difference from this study with previous studies is that there have been no studies that examine e-commerce liberalization in the ASEAN region, so the author tries to collaborate on several facts related to the growth of e-commerce liberalization in ASEAN-6 Keywords: ASEAN, e-commerce, digital economy, economic integration

Abstract

Liberalization is one of the theis that is expected to be able to answer the acceleration and development of the economy of developing countries. One element of liberalization is market openness that will make developing countries unite with global markets both in accepting investments or trading in exports and imports. However, along with the development of technology, the demand for the North (developed countries) in carrying out its trade began to implement an "ecolabelling" policy. For developing countries with all their industrial capabilities, ecolabelling policy is the same as the non-tarrif limitation policy given by developed countries to developing countries. So that this paper will focus on the application of the ecolabelling policy provided by the North to products that will enter the northern market, as one of the efforts of the northern countries to apply "kicking away the ladder", assuming the Southern state does not get a balanced trade surplus with the north and continues to be a developing country. This writing will use a structuralist approach that concentrates on the international structure of the north and south to describe the relationship between developed and developing countries, and uses the concept of "kicking away the ladder" to answer the situation from the implementation of ecolabelling policies for South countries. Abstract

Protection of trademarks (goods / services) is one of the important things for every inventor. The success of the WTO as an organization that oversees cooperation in the field of trade has an important role in the struggle that was resolved in the field of trade, in accordance with the agreement in the TRIPs which discussed Intellectual Property that was sponsored both nationally and internationally. The damaged trademark case by the Wen Ken Group Company later became an example of violation of the agreement, when the trademark product / service that was registered did not conflict with the logo, symbol or symbol of an ideology or the State. The resolution of this dispute is then still a polemic in Indonesia because the decisions made are not in accordance with the provisions in force, so they are approved by the WTO. Keywords: Intellectual Property Rights, WTO, TRIPs, Trademarks, Disputes
