l Mashaadir : Jurnal Ilmu Syariah disajikan sebagai upaya untuk mempromosikan hasil-hasil kajian dan penelitian dalam bidang ilmu syariah. Abstract

Child marriage is a serious problem in the social, cultural, and legal realms in Indonesia, even though there has been a revision of the minimum age limit for marriage through Law No. 16 of 2019. This practice is still ongoing and is often legitimized with religious postulates. The fatwa of the Indonesian Women's Ulema Congress (KUPI) No. 02/IV/2017 was present as a critical response to this condition, stating that child marriage is haram because it is contrary to the principles of sharia maqashid, especially the protection of soul, intellect, and offspring. This article analyzes the legal basis and method of Islamic law reform used in the fatwa, using a descriptive-analytical qualitative approach and content analysis of fatwa documents and related literature. The results of the study show that this fatwa prioritizes a contextual approach, sharia maqashid, and collective ijtihad of women scholars, as well as integrating the values of gender justice and child protection as the main foothold. This fatwa not only contributes to the discourse on Islamic law reform, but also becomes an instrument of moral advocacy in fighting for children's rights and strengthening social movements to abolish the practice of child marriage.

Abstract

This article aims to analyze the contribution of Maqasid al-Shariah to sustainable economic development from the perspective of contemporary Islamic economics. Maqasid al-Shariah, which encompasses the protection of religion, life, intellect, lineage, and property, serves as a fundamental normative framework in designing an economic system that is not only materially just but also fulfills the spiritual and social needs of society. Using a qualitative approach based on library research, this article examines classical and contemporary literature to explain how the principles of Maqasid al-Shariah are implemented in Islamic financial sectors, wealth distribution, halal financial product innovation, and economic policies grounded in social justice. The analysis reveals that the application of Maqasid al-Shariah can provide strategic direction in establishing an inclusive, just, and sustainable Islamic economic system. This article also highlights implementation challenges, including the need for Shariah-compliant regulations that are adaptable to technological advancements and the complexities of global markets. Therefore, Maqasid al-Shariah is not only theoretically relevant but also carries significant practical implications for promoting public welfare and prosperity within the context of the modern economy.

Abstract

The rising phenomenon of juvenile delinquency in Indonesia such as brawls, alcohol consumption, and violence against teachers and parents has prompted several local governments to implement a policy of placing problematic children in military barracks. This policy aims to discipline children instantly but raises debates about its legal basis, psychological impact, and conformity with child protection principles. This study critically analyzes the policy of placing children in military barracks from the perspectives of national law, Islamic law, and child protection, and explores its implications for reforming the child rehabilitation system. The research employs a qualitative approach with normative legal analysis of statutory regulations, literature reviews, and document studies from child protection agencies. The findings indicate that the military barracks policy lacks a clear legal foundation, contradicts the best interests of the child principle, and carries a high risk of long-term psychological trauma. From an Islamic law perspective, the policy is inconsistent with the principles of maqāṣid al-sharīʿah, which emphasize education through compassion, gradual guidance, and exemplary conduct. This study recommends reformulating child rehabilitation policies into a community-based, humane, and collaborative model aligned with national and international child protection standards.

Abstract

This study aims to: analyze the impact of the Grojogan Sewu Nature Tourism Park (TWA) ecotourism development on community income, employment and business opportunities, and land use within the surrounding community; and analyze the development of ecotourism resources from a sharia tourism perspective. This study is a survey conducted around the Grojogan Sewu Nature Tourism Park tourist attraction located in Tawangmangu District, Karanganyar Regency. The results indicate that ecotourism development impacts community income, employment and business opportunities, and land use in the study area. Ecotourism development has a positive impact on community income, employment and business opportunities, and land use. The reconstruction of ecotourism resource development from a sharia tourism perspective has met the criteria for sharia tourism development, namely ecotourism resource development from a sharia tourism perspective, from an ecotourism perspective, from an environmental management system perspective, from a tourist destination competitiveness perspective, and from a perspective of preserving socio-cultural values ​​and local wisdom. The results of this study indicate that ecotourism development in the study area has met the criteria for developing ecotourism based on Sharia tourism.
