Abstract

The response of the value of justice to the application of the principle of legality is essentially an attempt to make changes to the concept of the Criminal Justice System which is considered retributive and inhumane. The principle of legality with the guarantee of legal certainty does not fully guarantee community justice, therefore a shift in the orientation of thought which was originally only formal legality to material legality is needed.

Abstract

The development of online motorcycle taxis has been very fast lately because it is accompanied by millennials who are very dominant in liking this new transportation. Indonesia could be one of the world's examples of transportation with the help of this digital cellphone. However, to be an example, of course, it needs really in-depth arrangement and research so that it can run and develop according to the needs desired by the community. Many problems experienced by this online transportation. But there is no problem that cannot be overcome with experience and through it. Therefore, educated people are needed to research more deeply and find solutions. The right one for that. Currently, there are 2 of the most popular online motorcycle taxis in Indonesia, namely Go-Jek and Grab, and it is likely that in the future the newest competitors will emerge thanks to people's preference for this new style of transportation. Here the author wants to convey the form of legal protection that this online-based application can provide to the public. The author uses the library research method or literature review.

Abstract

When the law acts as a tool of social engineering (law as a tool of social engineering) inevitably places the rule of law in a very important position in regulating people's lives. Public policy is often understood as an instrument used by the government to solve technocratic public problems. Departing from the above background, the problem to be revealed is the extent to which the success of legal politics in the implementation of public services in Indonesia in realizing good governance. Based on the discussion that has been described above, it can be concluded that the role of legal politics is very much needed in the implementation of excellent public services in order to achieve good governance.

Abstract

Although in the positive law in Indonesia the process of settlement of criminal cases can not be completed outside the court does not mean that in certain cases not possible implementation. Restorative Justice is a process of settlement that is conducted outside the criminal justice system by involving victims, perpetrators, families of victims and perpetratos, communities and parties with an interst in a crime committed to reach an agreement. In this case the criminal justice process focused on criminal prosectution is transformed into a process of dialogue and mediation to create an agreement on a more fair and balanced criminal prosecution for the perpetrator and the victim.

Abstract

Marriage is actually a momentum to share happiness with others, share the legality and romance of happiness as a married couple. But not infrequently couples have to cover up their happiness through unregistered marriages. Several factors that cause someone to do unregistered marriage such as age that is not enough as recommended by the government, economic problems and the most ironic is polygamy. Siri marriage is a form of marriage that is carried out under the hands based on religious teachings, customs and without official recognition from state law, because it is not registered in state-owned institutions. The author uses the library research method or literature review. This literature review research is conducting research from library books, magazines, journals and articles and sources from the internet that are relevant to the problems discussed.
