Abstract

This writing is aimed at elaborating the forms of violation against woman (wives) in the case of divorce in Jambi City. This research is exploratory. In this case, divorces in Jambi are predominantly dominated by sue-divorced, cerai gugat (67.975%). From the research, uncovered some facts that the dominant forms of violationos are: physical violatios (37.255 %), psychological and emotional violations (88.235%), and sexual violations (0.64%). All kinds of the above violations are interconnected into each other in causes. The law enforcement for equality and protection on the woman are still very far from perfedct. From this view, it is worth socializiing the gender equality to the society as well as to the law practitioner and to the law-decision maker.

Abstract

Position of child by Sirri marriage, based on prevailing crustaceans associated to the mother. This provision makes child by Siri marriage did not get the rights protected by the rule of law. In fact, the legal status of Siri marriage according to Islamic law is valid, just not officially recorded. Determination of child by Siri marriage as young lawful means to protect the rights of children, especially those born through the Siri marriage.

Abstract

This article is to position the gender to its proper and appropiate place. This conducted by criticizing to the interpretation of the holy texts. As the feminism-thinkers are not poles apart in their interpretation, but they are in uniformity and commitment to put back Islam the religion of peace where man is considered equal to each other. Human beings are equal in their efforts to develop their potentials toward their perfection.

Abstract

This writing highlights the functions and the roles of woman in some aspects of life, like in faiths, worships, education, social and political struggle in society. Anticipating the challlenge of this era, the woman should function both in domestic and in public roles in order to keep and balancing their own and respective existence. The movement and the progress of woman should be supported by creating chances and eliminating the hindrance-factors like unwelcoming attitude toward their appearance outside the house affairs, and eliminating the so called ‘fear-factors’ around the woman. All these factors can be handled by improving their skills, innovative and creative works.
