Abstract

This research uses a field research method with a legal and descriptive-analytical approach, with primary data obtained from interviews and secondary data from legal documents and legislation. The summoning of parties in cases at the Religious Court is an important process in the settlement of cases, including absent cases such as divorce with parties whose whereabouts are unknown. In this context, the application of e-summon technology (electronic summoning) is expected to increase the effectiveness of summoning. This study aims to evaluate the effectiveness of the application of e-summons in absentia cases in the Tulang Bawang Religious Court using Campbell's (1970) theory of effectiveness, which includes four indicators: time efficiency, cost efficiency, accuracy of targets, and quality of service outcomes. This study uses a field research method with a juridical and descriptive-analytical approach, with primary data derived from interviews and secondary data from legal documents and legislation. The research results show that e-summons via website is more efficient in terms of time and cost compared to conventional methods, although there are still constraints on access to information by the defendant, which impacts the full realization of procedural justice.

Abstract

Love language is a trendy term these days. However, the application of love language is largely ignored by society, especially career families. For this reason, this study aims to describe how career families apply love language strategies in improving the quality of their relationships and how it impacts their family harmony. A qualitative research method was used to collected a phenomenological approach. Data collection techniques were used through in-depth interviews and observations of career families. The results of this study are career families who apply the concept of love language in their families will make it easier for them to improve the quality of family relationships where there are many demands by career families both at work and very little time with family. Therefore, love language is very necessary in career families. In addition, there are impacts if career families do not apply love language in their families, so that small conflicts arise in the household, such as infidelity, differences of opinion, and damage to the relationship between children and parents.

Abstract

Marriage which is ideally understood as an eternal bond, has not been fully realized in practice. Data from the Central Bureau of Statistics (BPS) indicate an increase in divorce rates in West Sumatra from 2020 to 2022. In 2020, there were 291,677 divorce cases, which rose to 447,743 cases in 2021 and further increased to 516,334 cases in 2022. Mediation, which is expected to be the most effective means of reducing divorce rates, has not yet yielded optimal results. This study aims to analyze divorce mediation in Minangkabau society from the perspective of Tafsir Al-Azhar. The topics discussed include: (1) the concept of divorce mediation in Supreme Court Regulation No. 1 of 2016 on Court Mediation, (2) the role of culture in divorce mediation practices within Minangkabau society, and (3) the concept of mediation from the perspective of Tafsir Al-Azhar. The research method used is a normative study with a descriptive analysis approach. The findings indicate that a culturally based approach in the mediation process is a strategic solution that mediators can utilize to optimize the function of mediation. Furthermore, integrating the cultural values of society with the Supreme Court's policies aligns with the mediation concept mandated in the Qur'an, as interpreted by Hamka in Tafsir Al-Azhar.

Abstract

The Sorong Serah traditional marriage ritual in Sembalun Bumbung Village, East Lombok, is a cultural heritage of the Sasak people that is full of moral values ​​and local wisdom. However, so far there have not been many in-depth studies that explore its symbolic meaning and social relevance amidst changes in community culture. This emphasizes the importance of this study to fill this gap. This study aims to explore in depth how the implementation of the Sorong Serah ritual can form the foundation of family resilience, both from social, emotional, and spiritual aspects. Through a qualitative approach with data collection techniques in the form of participatory observation, in-depth interviews with traditional leaders, bridal couples, and the surrounding community, and documentation studies, namely written, audio, and visual documentation. This study successfully mapped the structure and symbolic meaning in the stages of Sorong Serah. The results of the study show that Sorong Serah is not merely a symbolic ceremony, but rather an educative and affirmative means that strengthens the bonds of the nuclear family and the extended family. Research in Sembalun Bumbung Village revealed that the Sorong Serah ritual is not merely a customary ceremony, but rather an educative and affirmative means that strengthens family resilience and social cohesion. The main findings show that symbols such as kepeng in the Nyorong procession contain messages of responsibility and respect between families. Customary figures act as mediators to prevent conflict before marriage, indicating the existence of a customary-based social resolution system. The active involvement of the younger generation and the integration of customary values ​​with Islamic teachings demonstrate a dynamic and strategic cultural adaptation in preserving the meaning of this ritual amidst social change.

Abstract

Constitutionally, India adheres to the principle of secularism while still allowing religious communities to apply their respective laws in private matters. For Muslims, these provisions are regulated under the Muslim Personal Law (Shariat) Application Act, 1937. In practice, however, the implementation of this law faces challenges due to strong social and patriarchal influences. One of the most controversial issues is the practice of triple talaq, which has led to gender inequality. This study aims to analyze the process of legal transformation of triple talaq within Islamic family law in India and the implications of its prohibition. Using a qualitative method with a normative-juridical approach, this research examines primary legal sources and academic literature. The theory used in this study is the theory of legal pluralism. The findings reveal that the reform of Islamic family law in India has been a long process beginning with the Shah Bano case (1985) and the Muslim Women Act (1986), evolving through the Dania Latifi case (2001), and culminating in the Shayara Bano judgment (2017), which reinforced the prohibition of triple talaq. This transformation signifies a shift from the dominance of traditional fiqh toward a national legal system oriented toward justice and the protection of Muslim women.

Abstract

This research explores the challenges of intrafamily debt and strategies for building sakinah families among pottery artisan households in Banyumulek Village, West Lombok. As a traditional craft industry center, this community exhibits unique socio-economic characteristics with fluctuating income patterns dependent on tourism seasons, creating distinctive financial vulnerabilities. Using qualitative descriptive methodology conducted from July to September 2023, this study involved five families with significant debt problems (ranging from 50 to 70 million rupiah) who successfully maintained family sakinah. The research integrates Islamic law perspectives and marriage law frameworks in analyzing intrafamily debt issues. The results show that families implement various strategies including: building mutual trust and support, setting clear debt repayment targets, developing positive beliefs about debt resolution, maintaining open communication through deliberation, and strengthening spiritual dimensions. Concrete efforts include opening additional businesses, taking side jobs, allocating income specifically for debt repayment, and implementing strict financial management. The challenges faced include internal conflicts over debt allocation, economic pressures from income fluctuations, and social pressures from community stigmatization. Solutions implemented reflect emotional and spiritual maturity, including commitment to non-violence during conflicts, adaptive financial management strategies, spiritual reinforcement through worship, and mental resilience against negative perceptions. This study contributes empirically by demonstrating that sakinah families maintain harmony not through the absence of financial problems but through adaptive coping mechanisms that integrate Islamic values with practical economic strategies. The study concludes that a sakinah family is identified by the ability to manage challenges while maintaining sakinah, with success correlated with the category of sakinah family according to the Ministry of Religious Affairs classification.

Abstract

This study examined the influence of khuruj practices on family harmony within the Jamaah Tabligh community in Central Lombok Regency. Khuruj, as a form of da'wah involving leaving home for a certain period of time, creates unique dynamics within family relationships, particularly regarding economic responsibilities, child and spouse nurturing, and the maintenance of domestic harmony. This study employs a qualitative approach with field research as its research method. Data collection techniques include observation, in-depth interviews with twelve informants, and documentation with informants comprising members of the Tabligh Jamaah family, community leaders, and religious figures in Central Lombok. The research findings reveal that harmony within the households of Jamaah Tabligh families in East Lombok Regency is achieved through three key strategies: (1) establishing open communication between spouses as the foundation of the relationship, (2) agreeing on the time and duration of khuruj in a proportional manner, and (3) optimizing the role of the wife as the guardian of household balance. This study provides insights into the importance of communication and collaboration within Tabligh Jamaah families to achieve harmony in economic responsibilities and child upbringing. The wife's role as a supporter of family stability and agreements regarding khuruj time are key to reducing tension within the household. Thus, this study can serve as a reference for families in managing social and economic dynamics and strengthening family resilience.

Abstract

The prevalence of stunting in several regions of Indonesia, including Tulung District, Klaten, remains above the national target. One of the main obstacles in addressing this issue is the phenomenon of parental rejection of the stunting diagnosis given to their children. This study aimed to analyze in depth the factors underlying this rejection and to examine them through Peter L. Berger and Thomas Luckmann’s social construction theory and the Maqāṣid al-Syari’ah framework. Using a qualitative method with in-depth interviews and participant observation, the study involved 4 inclusion informants (parents of children aged 6–59 months who rejected or ever rejected the stunting diagnosis) and 8 triangulation informants, including village midwives, nutrition officers, posyandu cadres, village officials, and religious leaders. The findings reveal that parents’ rejection of the stunting diagnosis is constructed through a social process and reinterpreted according to everyday experience, cultural norms, and emotional meanings of parental success. In Berger’s framework, this rejection represents a cycle of externalization of personal experience, objectivation through shared community beliefs, and internalization as social reality that resists medical authority. From the Maqāṣid al-Syari’ah perspective, this behavior reflects a contradicsm from the principles of hifz al-nafs (protection of life), hifz al-‘aql (protection of reason), and hifz al-nasl (protection of offspring).

Abstract

Islam provides clear household guidelines to obtain harmony (sakinah). On the other hand, many contemporary Muslim families face dynamic challenges, particularly debates surrounding the role of wives. While previous studies have examined family harmony from various perspectives, empirical research on the lived experiences of Salafi wives remains limited. This study addresses that gap by exploring how the wives of Salafi ustadz in Jember understand and practice household harmony within the framework of Islamic teachings. Using a qualitative case study approach with purposive sampling, ten respondents were interviewed and observed. The findings reveal five key perspectives on achieving harmony: (1) choosing a religious husband; (2) possessing and applying Islamic knowledge; (3) maintaining good communication; (4) orienting toward afterlife happiness; and (5) prioritizing faith over emotional dependency. At the same time, they identified four major challenges: (1) balancing domestic and gendered responsibilities; (2) negotiating religious identity in a conflicting social environment; (3) addressing emotional and communication needs; and (4) managing economic difficulties. This study contributes to Islamic family law and gender discourse by demonstrating how Salafi wives integrate Qur’an- and Sunnah-based principles into family life while navigating modern household dynamics.

Abstract

This study concerns the teachings of Thoriqoh Qodiriyah wa Naqsabandiyah (TQN) Darul Falah Mataram and their implications for marital harmony among followers. Indonesia's divorce rate reached 466,000 cases in 2023 (BPS, 2023), indicating the need for alternative approaches to strengthen family institutions. This qualitative case study was conducted in Pagutan Village, Mataram City, NTB, employing triangulation through in-depth interviews with Mursyid, Khalifah, and 15 followers (selected purposively based on marriage duration >5 years and active participation >3 years), participant observation, and documentation. Data analysis utilized descriptive techniques following Miles and Huberman's model. Results show TQN's three pillars dhikr, muraqaba, and Tafakkur practiced through structured activities significantly improve marital harmony through: (1) enhanced interpersonal communication quality (openness, empathy); (2) moral character development (patience, compassion); and (3) strengthened family solidarity. Duck's Interpersonal Communication Theory and Pargament's Spiritual Theory validate these findings. The tariqa community functions as emotional support, spiritual identity formation, and constructive conflict resolution, contributing to harmonious households based on Mawaddah wa Rahmah principles (QS Ar-Rum:21). This research fills the literature gap on tariqa's role in family harmony and offers practical insights for spiritual-based household guidance strategies aligned with Islamic Family Law principles.
