Abstract

Depresi postpartum (DPP) adalah masalah kesehatan mental yang serius dan merupakan isu global dengan prevalensi mencapai 17,22% di seluruh dunia. DPP berdampak signifikan pada kualitas hidup ibu dan perkembangan anak. Penelitian ini menganalisis efektivitas intervensi DPP secara sistematis menggunakan metode PRISMA, mencakup data dari sumber publikasi seperti CrossRef, PubMed, Springer, dan Semantic Scholar, serta artikel yang tidak dapat diakses dicari melalui ResearchGate. Hasil menunjukkan bahwa Terapi Perilaku Kognitif (CBT), terutama berbasis internet, efektif dalam mengatasi DPP, sementara intervensi yang dimulai selama kehamilan memberikan dampak positif pasca-melahirkan. Preferensi intervensi, seperti konseling interpersonal di Amerika, menyoroti pentingnya nuansa budaya. Oleh karena itu, pengembangan intervensi yang relevan secara budaya dan eksplorasi dampak jangka panjang dari intervensi selama kehamilan sangat diperlukan untuk meningkatkan strategi global dalam penanganan DPP.

Abstract

The global COVID-19 pandemic has presented unprecedented challenges to health systems around the world, including Indonesia. In this context, health-related law enforcement has become increasingly crucial. This paper discusses the urgency of revising regulations on minor criminal offences in health law in the pandemic era. This research uses a qualitative method with a descriptive-analytical approach, focusing on analysing the prevailing laws and regulations, the implementation of law enforcement, and its impact in public health emergency situations. Revisions to health law regulations need to be made to adjust to the dynamics of the pandemic and the protection of public health. The mismatch of existing regulations may hinder quick and effective response to health-related offences. These changes are expected to strengthen the legal framework, provide legal certainty, and improve public compliance with health protocols. Finally, this study provides recommendations for policymakers on concrete steps that need to be taken to optimise health law enforcement in pandemic emergencies.

Abstract

Health workers play a vital role in maintaining public health and safety. However, in carrying out their duties, it is not uncommon for health workers to commit minor offences which are often caused by emergency situations or high work pressure. This paper aims to analyse the legal protection for health workers who commit minor offences. This research uses a qualitative method with a juridical-normative approach, examining existing laws and policies and applying case analysis to describe the situation faced by health workers. The results showed that although there are legal provisions governing the discipline and responsibility of health workers, there is still a legal vacuum in terms of adequate protection for those who commit minor offences. Revision and refinement of regulations are needed to provide fair protection for health workers and encourage them to carry out their duties with a sense of security without worrying about experiencing disproportionate legal action. This study recommends the establishment of a humane and rehabilitation-focused law enforcement mechanism, as well as the development of clear guidelines regarding the handling of minor offences by health workers.

Abstract

Enforcement of public health laws requires effective sanctioning instruments to ensure compliance. In dealing with minor offences, there are differences in the use of criminal and administrative sanctions in various countries. This study compares the application of both types of sanctions in health law systems in several countries. The analysis shows that administrative sanctions are used more frequently than criminal sanctions to deal with minor health law violations. Administrative sanctions are considered more effective, efficient, and proportional due to their faster and more flexible enforcement process, as well as their more moderate penalties. On the other hand, criminal sanctions are more applicable for more serious offences that significantly threaten public health, as they provide a stronger deterrent effect. The right combination of criminal and administrative sanctions is key to achieving comprehensive and effective health law enforcement. The selection of the type of sanction in accordance with the seriousness of the offence as well as the cultural context and legal system of each country is an important factor in its application.

Abstract

The COVID-19 pandemic has brought significant changes in various aspects of life, including in the legal and health sectors. One of the issues of concern is related to minor criminal offences in the health sector, such as drug counterfeiting, smuggling of medical devices, and violation of health protocols. These problems require more comprehensive handling through revision of existing regulations. The method used is a literature study by analysing various related literature sources. The results showed that regulatory revision is very important to do, given the complexity of the problem, law enforcement challenges, and the need to strengthen a more adaptive and effective legal framework. The concept of regulatory revision that needs to be considered includes strengthening the authority of law enforcers, improving coordination, clarifying the typology of criminal offences, toughening sanctions, and encouraging community participation. A more nuanced and proportional approach must also be applied, so that law enforcement does not overburden the community in the midst of a pandemic crisis situation. Regulatory revisions are expected to strengthen public protection, increase compliance, and prevent potential violations in the health sector.
