Abstract

This journal discusses the legal position of the Notary Deed that applies the Cyber Notary concept during the COVID-19 pandemic in Indonesia. The COVID-19 pandemic has changed the way we live our daily lives, including in the legal process. In situations where physical contact must be limited, the application of digital technology is important in maintaining the smooth process of making a notarial deed. The Cyber Notary concept allows making notarial deeds online through a safe and trusted digital platform. This journal discusses the legal basis, procedures, and legal challenges related to the implementation of Cyber Notary in Indonesia. In this study, the research method used is normative legal research by analyzing the laws and regulations related to the Notary Deed and the application of digital technology during the COVID-19 pandemic. The results of this study indicate that the Notary Deed made through the concept of Cyber Notary has a legal and binding legal standing. However, there are several challenges that need to be addressed, including issues of data security, electronic authentication, and reliability of digital platforms. In this context, clear regulations and adequate legal protection are needed to ensure the validity and integrity of Notary Deeds made through Cyber Notary. This research is expected to provide a better understanding of the implementation of Cyber Notary in Indonesia and provide relevant policy recommendations to overcome the related legal challenges. Abstrak Jurnal ini membahas tentang kedudukan hukum Akta Notaris yang menerapkan konsep Cyber Notary di masa pandemi COVID-19 di Indonesia. Pandemi COVID-19 telah mengubah cara kita menjalani kehidupan sehari-hari, termasuk dalam proses hukum. Dalam situasi di mana kontak fisik harus dibatasi, penerapan teknologi digital menjadi penting dalam menjaga kelancaran proses pembuatan akta notaris. Konsep Cyber Notary memungkinkan pembuatan akta notaris secara online melalui platform digital yang aman dan terpercaya. Jurnal ini membahas mengenai dasar hukum, prosedur, dan tantangan hukum yang terkait dengan penerapan Cyber Notary di Indonesia. Dalam penelitian ini, metode penelitian yang digunakan adalah penelitian hukum normatif dengan melakukan analisis terhadap peraturan perundang-undangan yang terkait dengan Akta Notaris dan penerapan teknologi digital di masa pandemi COVID-19. Hasil penelitian ini menunjukkan bahwa Akta Notaris yang dibuat melalui konsep Cyber Notary memiliki kedudukan hukum yang sah dan mengikat. Namun, ada beberapa tantangan yang perlu diatasi, termasuk masalah keamanan data, autentikasi elektronik, dan keandalan platform digital. Dalam konteks ini, regulasi yang jelas dan perlindungan hukum yang memadai diperlukan untuk memastikan keabsahan dan integritas Akta Notaris yang dibuat melalui Cyber Notary. Penelitian ini diharapkan dapat memberikan pemahaman yang lebih baik tentang implementasi Cyber Notary di Indonesia dan memberikan rekomendasi kebijakan yang relevan untuk mengatasi tantangan hukum yang terkait. Abstract

The COVID-19 pandemic has changed many aspects of our lives, including the way we conduct buying and selling transactions. Buying and selling online is a popular alternative for consumers to meet their needs. However, with the increasing activity of buying and selling online, the challenge of protecting consumer law is also becoming more complex. The purpose of this journal is to analyze consumer legal protection in the context of buying and selling online during the COVID-19 pandemic. Through this study, the authors identify the main issues faced by consumers in online buying and selling transactions, and discuss the legal framework that has been established to protect consumer rights. The author also presents several policy recommendations to improve consumer legal protection in buying and selling online during the COVID-19 pandemic Abstrak Pandemi COVID-19 telah mengubah banyak aspek kehidupan kita, termasuk cara kita melakukan transaksi jual beli. Jual beli online menjadi salah satu alternatif yang populer bagi konsumen untuk memenuhi kebutuhan mereka. Namun, dengan meningkatnya aktivitas jual beli online, tantangan perlindungan hukum konsumen juga semakin kompleks. Tujuan dari jurnal ini adalah untuk menganalisis perlindungan hukum konsumen dalam konteks jual beli online selama masa pandemi COVID-19. Melalui studi ini, penulis mengidentifikasi isu-isu utama yang dihadapi oleh konsumen dalam transaksi jual beli online, dan membahas kerangka hukum yang telah ditetapkan untuk melindungi hak-hak konsumen. Penulis juga menyajikan beberapa rekomendasi kebijakan untuk meningkatkan perlindungan hukum konsumen dalam jual beli online selama pandemi COVID-19.

In an increasingly digital era, the use of technology has affected various aspects of human life, including legal processes and legal agreements. Electronic notaries are one of the technological innovations that have the potential to change the way notaries work and provide legal services to the public. This article examines the application of electronic notaries, describing the basic concepts, benefits, challenges, and legal implications associated with their use. Abstrak Dalam era digital yang semakin berkembang, penggunaan teknologi telah memengaruhi berbagai aspek kehidupan manusia, termasuk dalam proses legal dan perjanjian hukum. Notaris elektronik adalah salah satu inovasi teknologi yang memiliki potensi untuk mengubah cara notaris bekerja dan memberikan layanan hukum kepada masyarakat. Artikel ini membahas penerapan notaris elektronik, menggambarkan konsep dasar, manfaat, tantangan, dan implikasi hukum yang terkait dengan penggunaannya.

Abstract

Problems related to housing and slum settlements occur because of population growth, population dynamics, and the increasing socio-economic demands of the community. The government's efforts to prevent slum settlements by accelerating infrastructure improvements and handling slums in every region in Indonesia by establishing the City Without Slums (KOTAKU) program which is a strategy from the Directorate General of Human Settlement as an element of the implementation of the Ministry of Public Works and Public Housing. This study aims to find out how the No Slum Program Policy (KOTAKU) is in Creating Livable, Productive and Sustainable Settlements in Tembuku Village. This study uses a qualitative descriptive research type by examining primary and secondary data sources. The informant determination technique in this study used purposive sampling. This study uses the theory of public policy processes. The results of the study show that the KOTAKU program's policies in realizing livable, productive and sustainable settlements in Tembuku Village are quite good, which is based on indicators of policy success (Riant Nugroho) which can be measured by the "five fixed" indicators, namely; right policy; right executor; right on target; environmental right; and precise process. But in practice it is still not optimal, namely the indicators are right on target and right on the process. There are several programs for handling slum areas which have not all been realized through the KOTAKU program due to several inhibiting factors such as uneven program socialization and limited budget funds so that the implementation of the KOTAKU program only focuses on one hamlet, namely Penida Kelod Hamlet.
