Abstract

Abstract: The Influence of Dutch East Indies Politics and Law on Islamic Law Legislation in Indonesia. Dutch East Indies politics and law is based on the interests of Dutch colonialism in Indonesia. At the start, the Dutch exercised a compromising brand of politics and law, however this was less than advantageous. Then, in its growth, the Dutch executed confrontational politics and law, which, evidently, was effective in swaying their power. Afterwards, Indonesia became independent in 1945. It turns out that confrontational thinking, as exhibited in the politics and law of the Dutch East Indies, had an influence on the Indonesian nation. They often rejected efforts to legislate Islamic law into the national legal system for a number of types of reasons. This article aims to examine the progression of Dutch colonial politics and law and its influence on the production of Indonesian Islamic politics and law over the course of independence.Keywords: law and politics, Islamic law, Adat law, Dutch East Indies, conflictAbstrak: Politik Hukum Hindia Belanda dan Pengaruhnya Terhadap Legislasi Hukum Islam di Indonesia. Politik hukum Hindia Belanda didasarkan pada kepentingan penjajahan mereka atas Nusantara (Indonesia). Pada awalnya Belanda menempuh politik hukum kompromistis, namun kurang menguntungkan. Lalu, dalam perkembangannya Belanda menjalankan politik hukum konfrontatif yang ternyata efektif dalam melanggengkan kekuasaan mereka. Setelah Indonesia merdeka 1945, ternyata cara berpikir konfrontatif seperti dalam politik hukum Hindia Belanda berpengaruh bagi sebagian bangsa Indonesia. Sering mereka menolak upaya legislasi hukum Islam ke sistem hukum nasional dengan pelbagai macam alasan. Abstract

Abstract: Biological identity verification before marriage from a fiqh standpoint. This article treats falsifying biological identity for marriage as an important phenomenon that should be responded to academically. By way of analyzing discourse concerning this subject, this article reveals that weaknesses in how civil law and citizenry are administrated, if not fixed, will give rise to more such cases of it. On the other hand, the theory that love is the biggest motivation for falsifying biological identity is taken into account to clarify why this violation occurs. The conclusion reached in this article is to accommodate for the capacity to verify biological identity—when deemed necessary—before marriage. The author reinforces this idea by drawing upon several hadiths, applying al-maqâshid al-syâri‘ah theory, as well as calling to expand classical fiqh to the context of solving this contemporary problem.Keywords: biological identity, verification, contemporary problem, classical fiqh, contextualisationAbstrak: Verifikasi Identitas Biologis Menjelang Perkawinan dalam Perspektif Fikih. Artikel ini meletakkan fakta pemalsuan identitas biologis dalam perkawinan sebagai fenomena yang penting direspons secara akademis. Melalui analisis wacana atas berita yang terkait, tulisan ini menyingkap bahwa ada sejumlah kelemahan pada sistem administrasi keperdataan dan kependudukan yang jika tidak dibenahi akan melahirkan kasus-kasus serupa. Di sisi lain, teori bahwa cinta adalah motivasi terbesar untuk melakukan sesuatu dimanfaatkan untuk menjelaskan mengapa pelanggaran itu dilakukan. Kesimpulan yang direkomendasikan adalah mengakomodasi kebolehan melakukan verifikasi identitas biologis—jika dianggap perlu—sebelum perkawinan. Penulis menguatkan gagasan ini dengan melakukan kontekstualisasi atas beberapa hadis, penerapan teori maqâshid al-syarî’ah serta ajakan untuk mengembangkan fikih klasik dalam rangka mengatasi problematika kontemporer.Kata Kunci: verifikasi, identitas biologis, problema kontemporer, fikih klasik, kontekstualisasiDOI: 10.15408/ajis.v12i1.963

Abstract

Abstract: The Implementation of al-Wa’d in Syariah Business. Scholars are in disagreement with one another when it comes to their views on what Islamic law says about the legal requirements of meeting one’s obligations and how or whether protracting that obligation should be punished. Hanan bint Muhammad Husen Jistaniyah, says that iltizâm is the term for obligations that are statements involving will; luzûm is the term for obligations that come from syariah ruling. Wa’d, which forms part of a combination of mu‘âwadhât (tijârî) contracts, can be mulzimised in two ways. First, sides agree that contractual document must express explicitly that wa’d is binding, insofar as that obligation (ittifâqiyya) is fulfilled by both sides when, or on the condition that, it is able to be fulfilled. Second, the regulatory side makes and activates legislature saying that wa’d, which can be found in the combination of mu‘âwadhât (tijârî) contracts, is binding, so both sides are obliged to fulfill qânûniyya, when, or on the condition that, it is able to be fulfilled.Keywords: Contract, Fatwa, Mulzim, Wa’dAbstrak: Implementasi al-Wa‘d dalam Bisnis Syariah. Ulama berbeda pendapat tentang hukum memenuhi janji: dianjurkan (sunah/wajib dîniyya) dan wajib secara hukum (qadhâ’iyya). Menurut Hanan binti Muhammad Husen Jistaniyah, iltizâm adalah term kewajiban yang lahir karena pernyataan kehendak yang bersangkutan, sedangkan luzûm adalah term kewajiban yang lahir karena ketetapan syariah. Wa‘d yang merupakan bagian dari rangkaian akad mu‘âwadhât (tijârî) dapat di-mulzim-kan dengan dua cara. Pertama, pihak-pihak sepakat dan dinyatakan secara eksplisit dalam dokumen kontrak (akta) bahwa wa‘d yang dilakukan bersifat mengikat sehingga wajib dipenuhi oleh pihak-pihak (wajib ittifâqiyya) apabila sebab atau syaratnya telah terpenuhi; atau kedua, pihak regulator membuat dan memberlakukan peraturan perundang-undangan menyatakan bahwa wa‘d yang terdapat dalam rangkaian akad mu‘âwadhât dinyatakan sebagai wa‘d yang bersifat mengikat sehingga para pihak diwajibkan untuk memenuhinya (wajib qânûniyya), apabila sebab atau syaratnya telah terpenuhi.Kata Kunci: Akad, Fatwa, Mulzim, Wa’d.DOI: 10.15408/ajis.v12i1.968

Abstract

Abstrak: Syariat Islam di Era Otonomi Daerah di Indonesia. Perkembangan Hukum Islam di Indonesia telah berlangsung sejak berdirinya kerajaan-kerajaan Islam di Nusantara sebelum datangnya masa penjajahan Belanda yang kemudian hari menguasai Nusantara selama lebih kurang 350 tahun. Pemberlakuan Hukum Islam itu sendiri berjalan dalam lima fase dengan mengalami pelbagai keadaan sebagai peluang sekaligus tantangan dari pihak penjajah yang bertujuan “devide at impera”, memecah belah dan mengadu domba, untuk tetap terus menjajah. Seperti siasat Snouck Hurgronje, dia mencetuskan gagasan teori Receptie dalam rangka memandulkan Hukum Islam, yang oleh Hazairin disebut “teori Iblis”. Perjalanan Hukum Islam pada fase menjelang kemerdekaan dan sesudahnya tetap eksis walau harus diperhadapkan dengan hukum Adat dan hukum Hindia Belanda. Sebagai bukti eksistensi Hukum Islam maka pengundangan Undang-undang No.1 Tahun 1974 Tentang Perkawinan menjadi pedoman bagi umat Islam Indonesia saat ini.Kata Kunci:        السلطة, التشريع اللإسلامى, الأحكام الإسلاميةAbstract: Shariah in the Era of Regional Autonomy in Indonesia. Developments in Islamic Law in Indonesia have taken place since Islamic kingdoms were established in Nusantara before the arrival of the Dutch colonisation period, which dominated Nusantara for the next 350 years. The imposition of Islamic law on its own has moved through five phases, going through various opportune periods. But at the same time it faced a challenge from the colonial side, whose goal was to “divide and conquer” to maintain oppression like the strategy of Snouck Hurgronje. The Dutch created the theory of Receptie as an effort to sterilize Islamic law, which Hazairin then called “Satanic law”. The course of Islamic law during the phase just before independence and afterwards still exists, even though it must be admitted it is Adat and Dutch law that guides Indonesia. But as evidence of the existence of Islamic law, there is the enactment of the 1974 Marriage Act, which serves as guidance for followers of Islam today.Kata Kunci:   السلطة, التشريع اللإسلامى, الأحكام الإسلاميةDOI: 10.15408/ajis.v12i1.973

Abstract

Abstract: The MUI Fatwa about Female Circumcision. The issue of female circumcision has become a public issue following research, either independent or sponsored, repeatedly finding there to be a number of negative effects arising from allowing the enforcement of female circumcision in a number of countries. The issue of children’s and women’s protection are also often connected to the issue of the implementation of circumcision, especially in relation to children’s rights and women’s reproductive rights. This study finds that provisions targeting female circumcision do so in an effort to protect women’s rights. This article finds that the MUI fatwa, as well as ulamas’ views on madzhab and fiqh, which regulates procedures pertaining to the implementation of female circumcision, serves to strengthen the protection of children’s rights, that is, protection from negative effects which is caused by extreme actions in the dangerous practice of circumcision.Keywords: female circumcision, MUI, fatwa, fiqh, children’s protection.Abstrak: Fatwa MUI tentang Khitan Perempuan. Masalah khitan terhadap perempuan menjadi isu publik setelah adanya pelbagai penelitian, baik yang dilakukan secara independen maupun karena ada sponsor, yang menemukan adanya pelbagai dampak negatif yang ditimbulkan dari penyimpangan pelaksanaan khitan terhadap perempuan di beberapa negara. Isu perlindungan anak dan perempuan juga sering kali dikaitkan dalam masalah pelaksanaan khitan, khususnya terkait hak anak dan hak reproduksi perempuan. Studi ini menemukan bahwa ketentuan mengenai khitan perempuan sejalan dengan upaya perlindungan terhadap hak perempuan. Fatwa MUI, sebagaimana juga pandangan ulama mazhab fikih yang mengatur tata cara pelaksanaan khitan perempuan, justru meneguhkan perlindungan terhadap hak anak, yakni perlindungan dari dampak negatif yang ditimbulkan akibat tindakan berlebihan dalam praktik khitan yang menyebabkan bahaya.Kata Kunci: khitan, perempuan, fatwa MUI, fikih, perlindungan anakDOI: 10.15408/ajis.v12i1.964
