Abstract

The decision of the Constitutional Court is a legal product produced by the Court, whose decision is final and binding. The meaning of the final and binding clause means that since the decision is read in front of the court it is open to the public, has binding legal force and there is no further legal action. This research includes normative juridical research, using a statutory approach and a conceptual approach. Juridically the authority of the judicial order is implied in Articles 10 and 23 of Law no. 15 of 2019 amendments to Law no. 12 of 2011 concerning the Establishment of Legislation, and is explained again in DPR Regulation No. 13 of 2016 concerning procedures for drafting a national legislation program. The construction of the judicial order lies in the final and binding nature of the Constitutional Court's decision itself. Follow-up actions are not always delegated to the legislature, because in practice it is permissible for relevant institutions that have the authority to issue orders or regulations so that there is no legal vacuum for too long and does not interfere with the running of the government.

Abstract

The research in this journal discusses the authority of the Election Organizing Honorary Council (DKPP). DKPP is one of the triumvirate election organizers in Indonesia whose authority is to handle problems that occur between Election Organizing Institutions. This research uses normative law research methods by using several approaches including statute approach, case approach, and conceptual approach. In the Political Law of Elections in Indonesia, the status a quo gives the DKPP such coercive authority related to the enforcement of the code of ethics. However, over time, there is a problem that considers that DKPP has exceeded the limits of its authority as an Ethics Institute. Moreover, after the transfer of his secretariat to the Ministry of Home Affairs, it was feared that it would interfere with the independence of the DKPP as one element of the election organizers. Because basically the EMB must be independent and with integrity. The transfer is based on Presidential Decree No. 67 of 2018. This should not have happened because the Elections Organizing Body does not only handle the legislative election process but also the Executive. So it is feared when this happens it will interfere with the independence of the DKPP. Bearing in mind that, the decision of the DKPP is final and binding.

Abstract

The aim of this research is to explain how the sustainabiliy of UNESCO Creative City Network predicate for Pekalongan City based on the actors involved and success indicators for Pekalongan City in order to mention the barriers appeared that associated with the continuity of the UCCN This research used Qualitative approach and supported by simple Quantitative method by collecting data technique using depth interviews, observations, document studies and questionnaire with 100 respondents. The research result shows that the sustainability of creative city in Pekalongan are in the state of suspended animation and still being ruled out because there are other things to be considered more important by Pekalongan Government. Tools and infrastucture are not available such as there is no creative room and abandoned technopark construction. Besides, the integrity of actor has not been tied together well because the differences of opinion and mindset. Pekalongan Creative City Forum (PCCF) has not been able to take the role maximally so thereby appeared the barriers along with the sustainability of the UCCN. To do so requires efforts to give socializations and knowledge transfer to the society, in addition to create tools and infrastucture to support the creative city especially in building a place where involved actors can gather together.

Abstract

This research raises the issue of legislation in the multi-party presidential government system in Indonesia after the amendment to the 1945 Constitution. In order to make this research more focused, the researcher proposes two main questions, namely; How exactly are the legislative problems that occur in a multi-party presidential government system? Likewise, how are the efforts to resolve the legislative problems in a multi-party presidential government system?. To answer these two problems, the researcher uses several approaches in this normative research. Among these approaches are the statutory approach, the conceptual approach, the historical approach and the case approach. Based on the results of the discussion in this study, the researcher concludes two main conclusions related to the problematics of legislation in the multi-party presidential government system in Indonesia after the amendments to the 1945 Constitution. namely, the weakening of the president's power in terms of legislation due to the increasing influence of the DPR's power in the legislative process, even though the president has double role. Furthermore, the legislative problem that occurs in the multi-party presidential system of government in post-amendment Indonesia is the waning spirit of upholding the principle of checks and balances in the formation of legislation.
