Kanun: Jurnal Ilmu Hukum
anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

ABSTRACT: Protection against forest ecosystem conservation in Aceh Tamiang manggrove decreased. This can be seen from the policy of land conversion in the forest ecosystem manggrove. Local governments have issued policies on the conversion of mangrove forest ecosystems that are not in accordance with its provisions, the conversion of the ecosystem of the mangrove forest to plantations. In addition, the exploitation of the mangrove forest by the community to the needs of charcoal that has lasted a long time and generations as well as land clearing for aquaculture ponds also cause damage to mangrove ecosystems. The conversion of mangrove forests has led to the effect that should be shouldered by the public, which reduced the catch of fishermen, the pollution of mangrove forest ecosystems. ABSTRACT: Dengan diberlakukannya UU No.32/2009 maka ketentuan UU No. 23/1997 menjadi tidak berlaku lagi. UU No. 32/2009 ini diberi nama UU tentang Perlindungan dan Pengelolaan Lingkungan Hidup yang isinya ternyata lebih luas pengaturannya dibandingkan dengan UU sebelumnya, yang diberi judul UU tentang Pengelolaan lingkungan Hidup, termasuk masalah pengaturan ketentuan pidananya baik dilihat dari sudut hukum pidana materilnya maupun formilnya. Ada beberapa persoalan berkaitan dengan hukum pidana materil yang berbeda ketentuannya dibandingkan dengan UU No. 23/1997. Diantaranya lebih diperbanyak perbuatan yang dapat diberi sanksi Pidana (perbuatan pidana), kemudian sistem penjatuhan hukumannya yang mengenal hukuman minimum baik untuk pidana penjara atau pidana denda, kemudian berkaitan dengan pertannggungjawaban, semakin dipertegas korporasi sebagai subyek hukum pidana. Sedangkan yang berhubungan dengan hukum pidana formilnya adalah soal pembuktian, dimana dalam UU No.32/2009 ini macam-macam alat bukti yang dapat digunakan untuk tindak pidana ini ditambah lagi selain dari yang ditentukan dalam pasal 184 ayat (1) KUHAP. Selain itu juga telah dimasukkan tentang perlunya sistem peradilan pidana terpadu guna penanganan yang lebih efektif. ABSTRACT: Zona Ekononi Eksklusif (ZEE) merupakan suatu rezim hukum baru yang diatur dalam Konvensi Hukum Laut 1982. Kepada Negara-negara pantai, seperti Filipina dan Indonesia diberikan hak berdaulat di ZEE yang jaraknya 200 mil dari garis pantainya untuk mengeksploitasi dan mengeksplorasi sumber kekayaan alam di laut atau memanfaatkan kekayaan hayati ikan. Dan hanya negara yang bersangkutanlah yang berhak memanfaatkan kekayaan ikan di ZEE, sedangkan negara-negara lain tidak boleh kecuali ada izin. Karena itu diperlukan kerjasama antar negara untuk melindungi dan melestarikan sumber kekayaan alam tersebut, namun perlindungan tersebut kurang diperhatikan oleh negara-negara di kawasan tersebut. Penulisan ini bertujuan untuk mengetahui tentang aspek-aspek yang relevan dilakukan melalui kerjasama antar negara dalam melindungi sumber-sumber perikanan di ZEE dan tentang pengaturan hukum internasional, regional dan hukum nasional dalam mengantifikasi perlindungan sumber-sumber perikanan di ZEE. Dalam kenyataannya perlindungan dan pelestarian sumber-sumber perikanan di ZEE diantara negara-negara ASEAN itu belum berjalan sebagaimana mestinya, meskipun usaha kearah tersebut dilakukan guna pelestarian ikan di laut ZEE. Namun perlindungan tersebut tidak efektif karena banyak kapal, baik dari Indonesia maupun dari Negara ASEAN lainnya yang menangkap ikan tanpa memperdulikan tentang perlindungan dan pelestarian sumber ikan di ZEE, bahkan banyak kapal ikan asing tersebut menangkap ikan di ZEE Indonesia secara illegal, sehingga unsur kepentingan perlindungan dan pelestarian sumber ikan tersebut diabaikan oleh kapal-kapal perikanan tersebut. ABSTRACT: This research aims to find justified theories with regard to the governance regulation in the field of forestry based on local autonomy as regulated in the Constitution 1945, find out law protection towards the usage of forest resources in the context of the autonomy and to obtain the concept of law regarding the protection of forest resources in the regulation of local autonomy. This is normative law research by applying historic and comparative legal research pointing at secondary data obtained from library research supported by primary data gathered from field research. This research is categorized as descriptive analysis research. The oblained data are analysed as juridical qualitative. The findings show that the regulation of forest resources has included te principles in accordance with sustainable development concept but it does not mean that the function of law as an engineering tool has been compatible with the purpose of the forestry management due to many evidences of deforestation. Practically, there is a conflict between central government and local government in therm of the authority of forest management, a lot deforestation causes forest amage in Indonesia, those facts show that the regulation regarding the authority of forest management ini the context of local autonomy implementation has not been able to protect the natural resources yet. The constraints faced are the law violations, lock of society participation in mking decision, collusion or conspiracy between businessman and bureacrats and security and lack of law enforcement. ABSTRACT: The purpose of this study is to investigate and explain the form of policies, synergy of government, the appropriateness of policies issued by the provincial and district governments with the authority granted by Act No. 26 of 2007 This research is a normative, legal source material is the primary law materials and secondary legal materials, obtained through field research and library research. Aceh government policies and the policy of local governments has not been able to resolve the border conflict districts. This affects the difficulty of making the border spatial planning policy. Although the provinces and Regency/Municipality in Aceh had formed the Coordinating Agency for Spatial Planning Area (BKTRW), but BKTRW has not functioned optimally. There are no known incompatibilities in spatial planning policy, because local governments are still awaiting the birth of the provincial Qanun. To local governments expected to make policy together adjacent to resolve border issues in spatial planning. Forms of collective wisdom can be shared qanun, joint regulation or collective decisions. In realizing synergy spatial planning in Aceh, the provincial government and Regency/Municipality is expected to optimize the function BKTRW Aceh and BKTRW Regency/Municipality.
