Abstract

Information Technology, media and communication role has changed society and human civilization behaviour globally. Information and communication technology development is very quick and world relations are borderless, further significant social, economic and cultural changes are quickly. The impact of information technology contributes to welfare, progress and society civilization as well as acts against the law.The man and his girlfriend used information and communication technology facilities in which the man lend her a "Laptop" then they agreed to use the same "password" to use the laptop.Man was reported by his girlfriend on act the accusation that the man had accessed the laptop even though he has the girlfriend’s permission which laptop position was being "logged in".When the man opened "Facebook", there was a "chat" between his girlfriend and another man tell about the sexual nature of the accused man. There was disharmony. A man changed his girlfriend's Gmail, Facebook, yahoo passwords, and posted WhatsApp conversations between his girlfriend and another man on his girlfriend's Facebook.This research is related to illegal access through a district court decision for man, Number: 414/Pid.B/2021/PN.Jkt.Pst. decided on article 30 paragraph 2, Law of the Republic of Indonesia No. 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Technology (ITE) for the man.The objective research is to provide legal certainty for man that the article is not in accordance with legal certainty, because the man has obtained permission from his girlfriend, not the article changing his girlfriend's password.The method is normative legal research and statute approach which will discuss these allegations with secondary data then the research result can provide legal certainty and justice by changing the multiple interpretations of the article accusing the man that the legal position of man is not doing illegal access because he got girlfriend’s permission.

Abstract

Mediasi penal dilaksanakan di lingkup Polres Metro Bekasi sebagai metode diversi untuk anak berkonflik dengan hukum (ABH) terkait perkara kekerasan seksual (KS). Sanksi terhadap KS yang dilakukan oleh anak tidak diatur secara khusus dalam KUHP. Untuk memberikan perlindungan terhadap ABH, maka pemerintah mengaturnya di dalam Undang-Undang Sistem Peradilan Pidana Anak UU SPPA). UUSPPA memberikan amanat untuk penyelesaian tindak pidana oleh ABH agar mengutamakan konsep keadilan restoratif melalui metode diversi. Namun dalam UUSPPA terdapat syarat untuk diversi. Hal ini bisa membuat ada perlakuan berbeda terhadap anak pelaku tindak pidana KS yang ancaman pidananya di atas 7 tahun sehingga tidak dapat melalui proses diversi. Polres Metro Bekasi menerapkan mediasi penal sebagai usaha perwujudan keadilan restoratif untuk ABH yang tidak memenuhi syarat diversi. Penelitian ini menggunakan metode yuridis empiris untuk melakukan kajian terhadap justifikasi implementasi pelaksanaan mediasi penal, yang masih belum memiliki landasan hukum kuat (baru berupa hukum in concreto jika dibandingkan dengan diversi), dalam lingkup Polres Metro Bekasi. Hasil penelitian menunjukkan bahwa mediasi penal efektif dalam menangani kasus tindak pidana KS oleh anak di wilayah hukum Polres Metro Bekasi. Polres Metro Bekasi dapat mencapai keadilan restoratif yang melindungi hak anak berhadapan dengan hukum dan hak korban dari tindak pidana KS yang terkait.

Abstract

Social security is a crucial thing that everyone must have, as this has been regulated and guaranteed by the state, and the state has an obligation to fulfill the rights of these citizens. In connection with this matter, the Indonesian government has regulations regarding social security regulated in Law No. 40/2004 concerning the National Social Security System, including health insurance, work accident insurance, death security, and one that will be concern of discussion in this research is a program regarding Pension Security or commonly called Jamaican Hari Tua (JHT). The regulations regarding this matter have changed several times, but still aim to focus on ensuring that Indonesian citizens who are the JHT participants can enjoy a decent life after entering retirement. Provisions for disbursing funds for participants have changed from the initial regulations to the updated regulations, for example changes to implementing regulations regarding the JHT, namely the Ministerial Regulation of Manpower No 2/2022 concerning "Procedures and Payment of Pension Security", one of the problems that arises is regarding the conditions for disbursing the JHT funds especially by participants affected by Termination of Employment or commonly called Pemutusan Hubungan Kerja (PHK) different from the previous Ministerial Regulation of Manpower, which did not require the age of participants who were affected by the layoffs. This raises the pros and cons in society. This research focuses on protection for the JHT participants who are laid off before they are 56 (fifty six) years old, so they can withdraw the JHT contributions that have been paid, thus achieving the goal of Law No. 40/2004 to ensure people's lives.

Abstract

In representing the parties for proceedings in court or other institutions outside the court, advocates must show the legitimacy of their profession as an advocate. The validity is proven by the existence of a power of attorney from one plaintiff or defendant to an advocate with the designation of an extraordinary power of attorney. Following Article 1795 of the Civil Code: The granting of power of attorney can be carried out precisely, namely only regarding a particular interest or more, or in general, covering all the interests of the person giving the power of attorney. The unique power of attorney is the basis for granting power of attorney to the advocate to take any action that the recipient of the power of attorney may take to represent the interests of the power of attorney as the principal party. The following legal basis, in Article 4 paragraph (1) of Law no. 18 of 2003 concerning Advocates, before carrying out their profession, Advocates must swear an oath according to their religion or make a solemn promise in an open session of the High Court in their legal domicile. When filing a lawsuit, each extraordinary power of attorney is registered at the clerk's office at the judiciary, where it will be listed for data collection and supervision of the attorney. The research aims to analyze the application of Article 4 paragraph (1) concerning advocates who have not yet received an oath when they receive an extraordinary power of attorney from the plaintiff, then register civil cases at the clerk's office and continue to represent the plaintiff, follow the trial process until the judge makes a final decision. The research method used is a normative juridical approach.

Abstract

The initial process of buying a house at a developer company is carried out with a House Order Letter (SPR) and the consumer is immediately given a receipt for the purchase of a house unit. In its implementation, this SPR uses standard clause agreements which are more detrimental to consumers. In the course of this credit agreement, preceded by an SPR from the developer company, it became a thing that was detrimental to the community who had paid the receipt and was canceled unilaterally by the developer company on the grounds that the bank refused to apply for a mortgage. In this case, legal protection is needed for consumers to get a full refund of what they deposited because the unilateral cancellation has been carried out by the Developer Company. Business actors as parties who make agreements use standard clauses that tend to release, transfer or reduce their responsibilities which should be the responsibility of business actors, by violating Article 18 paragraph (4) UUPK, so that in general, consumer rights are still not protected because business actors are concerned with the fulfillment of protection for their parties against the risks they may face. The SPR agreement does not conflict with applicable law but its moral responsibility is required to protect consumers.
