Abstract

Election fraud is one of the crucial issues that can damage the integrity of democracy in Indonesia. This study aims to critically examine various forms of election fraud from the perspective of the Election Law, especially how existing regulations regulate prevention, supervision, and handling. Using a juridical-normative approach, this study analyzes related legal provisions, including Articles in Law No. 7 of 2017 concerning Elections, and their relevance to implementation in the field. The results of the study indicate that although regulations have been designed to create honest and fair elections, weaknesses in aspects of law enforcement, supervision, and transparency are still loopholes for violations. In addition, the involvement of political figures and the weak legal awareness of the community have exacerbated this problem. This study recommends strengthening regulations, optimizing technology-based supervision, and political steps to the community as strategic steps to prevent election fraud in the future.

Abstract

This article examines the importance of antitrust policy and the protection of Micro, Small and Medium Enterprises (MSMEs) in creating economic justice in Indonesia. MSMEs serve as the main pillar of the national economy, contributing more than 60% to the Gross Domestic Product (GDP) and absorbing around 97% of the total workforce. However, MSMEs face various challenges, such as difficulties in accessing capital, technological limitations, and monopolistic practices by large companies that hinder their growth. The implementation of Law No. 5/1999 on the Prohibition of Monopolistic Practices and Law No. 20/2008 on MSMEs is essential to create a healthy competition climate and provide necessary protection for MSMEs. Cooperation between these two policies is expected to improve access to financing, technological support, and strict law enforcement against monopolistic practices. With this cooperation, MSMEs are expected to innovate, improve competitiveness, and make a greater contribution to inclusive and sustainable economic growth. This article emphasizes the need for collaboration between government and stakeholders to ensure that all businesses, both large and small, have a fair chance to thrive in the national economy.

Abstract

The Trias Politica, a concept first introduced by Montesquieu in The Spirit of Laws (1748), is an important foundation for modern democratic systems of government. The separation of powers into three main branches-legislative, executive, and judicial-aims to prevent the concentration of power that could lead to abuse of authority. However, the absence of an effective Trias Politica can have a significant impact on political stability, public trust, and government accountability. This research uses a descriptive qualitative approach to analyze the phenomenon of the absence of the Trias Politica in the global and national contexts. The results show that the non-optimal implementation of the Trias Politica, such as in Indonesia, creates major challenges, including weak legislative oversight, compromised judicial independence, and executive policies that are not in favor of the people. Reforms to the system of government are needed to ensure an effective balance of power and guarantee justice and political stability.

Abstract

This article discusses political phenomena related to dynasties in Indonesia, which have become an important concern in the context of the country's democratic progress. dynastic politics is a term that refers to the custom in which political power is inherited within a family or group, which often results in a smaller concentration of power and a greater decline in political participation. This study investigates the effects of dynastic politics on Pancasila democracy. On the one hand, political dynasties have the potential to provide continuity and stability in leadership, as well as allowing political networks and resources to be accessed. On the contrary, this practice can hinder the regeneration of leaders, reduce responsibility, and reduce public trust in political institutions which aims to provide a deeper understanding of how dynastic politics can be both a threat and an opportunity for the massesfuture of Indonesian democracy.this goal is achieved through the use of a descriptive approach and empirical data analysis.By considering the social, cultural and economic context, this article concludes that structural reforms and increasing public participation in the political process are needed to maximize the positive potential and reduce the negative potential of dynastic politics.

Abstract

The dismissal of Joko Widodo (Jokowi), Gibran Rakabuming Raka, Bobby Nasution from the Indonesian Democratic Party of Struggle (PDIP) became a shocking event and caused a big impact on Indonesian politics. This research aims to analyze how the dismissal of these three figures affects the dynamics of power in Indonesia, both from the political and social sides. This dismissal raises various questions about internal relations in PDIP, the party's political strategy, and its impact on public support for the three figures. This study also looks at how this event affects political stability at the national and local levels, and how this change can affect future political support patterns. By using a qualitative approach, this study explores the various effects of this dismissal on Indonesia's political map, both in the short and long term.
