Abstract

LEGAL PROTECTION FOR WIVES AS VICTIMS OF INFIDELITY: A REVIEW OF LAW NO. 23/2004 ON THE ERADICATION OF DOMESTIC VIOLENCEThis study aims to: (1) identify the legal protections available for wives who are victims of infidelity as outlined in Law No. 23/2004 on the Eradication of Domestic Violence, and (2) examine the factors that hinder legal protection for these wives under the same law. The research employs an empirical methodology employing direct involvement in the field. Legal protection encompasses all efforts made to fulfill the rights and aid witnesses and victims, thereby ensuring a sense of security within the legal system. This protection can be categorized into two main forms: preventive and repressive legal protection. Preventive protection seeks to avert legal violations through clear regulations, legal counseling, and oversight by authorities. In contrast, repressive protection involves actions taken after a violation has occurred, such as law enforcement, imposing sanctions on perpetrators, and providing support and rehabilitation for victims. The study identifies two significant factors that hinder legal protection for wives who are victims of infidelity, as reviewed by Law No. 23/2004: the challenges associated with proving psychological violence and economic constraints. Abstract

This research aims to determine (1) the role of investigators concerning perpetrators involved in the criminal acts of printing and circulating counterfeit money and (2) the obstacles experienced by investigators when investigating these criminal acts. This research employs an empirical legal research method that examines law in its practical application and analyzes how law functions within the community. The findings indicate that: (1) Investigators encounter difficulties in gathering sufficient and valid evidence to prove the criminal acts committed by suspects. Besides that, advancements in increasingly sophisticated counterfeiting technology present additional challenges in identifying counterfeit money. (2) Another significant obstacle is the weak coordination among law enforcement agencies. Differences in procedures, policies, and interests among these agencies frequently impede effective coordination. Lack of communication and inter-agency rivalry also worsen the situation, thereby hindering the effective investigation of the criminal acts of printing and circulating counterfeit money.

Abstract

This study aims to: (1) How is the Role of the National Narcotics Agency (BNN) in Eradicating Drug Abuse in Gorontalo City, (2) Factors that Inhibit the Implementation of Rehabilitation of Drug Abuse Victims by the National Narcotics Agency (BNN) of Gorontalo City. The type of research used in this study is a research on reality rules. Empirical research is research with field data as the primary data source, such as interview output and observation. Empirical research is used to analyze rules that are considered to be the behavior of people who always interact and have social aspects. The results of this study indicate that: (1) To determine the Role of the National Narcotics Agency (BNN) in the implementation of Drug Abuse Rehabilitation in Gorontalo City, (2) Factors Inhibiting the Role of the Police in North Bolaang Mongondow are Budget limitations, Low community participation, Lack of facilities and infrastructure. The author's suggestions in this study: (1). To the police to be more serious in eradicating drug abuse in North Bolaang Mongondow (2). To find out the factors that hinder the implementation of the rehabilitation of victims of drug abuse by the National Narcotics Agency (BNN) of Gorontalo City.

Abstract

This research aims to (1) describe the implementation of Article 5 of Local Regulation No. 6 of 2019 concerning population administration in Gorontalo Municipality and (2) identify the factors affecting it. The type of legal research used is empirical legal research with a qualitative approach. Data collection is through interviews with employees of the Population and Civil Registration Office of Gorontalo Municipality and the community. This research shows that the implementation of Article 5 of Local Regulation No. 6 of 2019 concerning Population Administration in Gorontalo Municipality has not been fully optimal. Although regulations establish residents' rights to obtain population documents justly, equal services, and personal data protection, the facts indicate unequal services and indirect discrimination persist. The main factors affecting its implementation include a lack of professionalism and human resources at the Population and Civil Registration Office, as well as low public awareness of the importance of population administration. Therefore, it requires human resources and oversight to truly ensure the achievement of the objectives of the Local Regulation

Abstract

This study aims to (1) determine how law enforcement efforts are implemented against the theft of four-wheeled and two-wheeled vehicles in Gorontalo City, and (2) analyze the factors influencing the number of vehicle theft cases, specifically in 2024, which experienced the highest increase in such cases compared to the previous year. It employs an empirical legal study methodology, involving observations at the Gorontalo City Resort Police and the Gorontalo District Court. Data collection is through interviews with investigators from the Gorontalo City Resort Police and junior legal clerks, who served as participants in the study. The findings reveal that law enforcement efforts against vehicle theft in Gorontalo City have been carried out under legal provisions and the Criminal Code. However, several factors have contributed to the increase in vehicle theft cases over three years, particularly in 2024. Economic factors seem to drive individuals to engage in vehicle theft. Additionally, environmental factors, technological developments, and certain legal aspects indicate that current law enforcement measures have not yet deterred offenders effectively. This study recommends enhancing cooperation between the community and law enforcement agencies to improve oversight of vehicle theft in Gorontalo City. Furthermore, legal counseling is necessary to educate the public on the importance of avoiding involvement in vehicle theft cases
