Abstract

ABSTRACT Every person has his own human right to get his offspring through marriage. The procedure of a marriage in Indonesia varies since Indonesia recognizes multi religions and ethnicities that have different procedures. The result of the research shows that the Gayonese community still perform exogamy marriage system with some reasons, and one of them is that they consider that one clan/belah is one offspring so that they will maintain this system forever. Since the majority of them are Moslems, a marriage will be valid when it has fulfilled rukun or requirements for a marriage. Even though it dooms to extinct, there is a unique procedure of the marriage system in the Gayonese community such as sesuk pantang, teniron, i sarahen ku guru, mujule mas, sedulung, nik mas, sawah ukun, upacara dalem, membilang mas, beru, and mah beru. If they do not use exogamy system, they will be imposed on an adat  sanction like ‘farak’ (segregated) which is done by doing adat negotiation by sarak opai (adat institution). Abstract

ABSTRACT The Indonesian police officers as state’s apparatus have to comply with the prevailing legal provisions, especially a marriage conducted by an Indonesian police officer has to follow Marriage Law and the other regulations imposed on the Police Force. One of the requirements for getting marriage, before registering it to the Religious Affairs Office and the Civil Registry Office, is getting permission from the superiors. Police officers and government employees who work for the Police Force have to report to their superiors in written form when they want to get married. Without the acknowledge of their superiors, they will be considered as being single and their wives and children will not get any allowance; in other words, they are considered as having no dependent. A marriage without getting permission in the Police Force has an effect on a police officer’s wife and children in which they are legally protected by Law on Marriage and Law on Child Protection. The result of the research showed that the decision of the Disciplinary Infraction Meeting was considered correct in imposing punishment on police officers who violated the Government Regulation No. 2/2003 on Disciplinary regulation on the Indonesian Police Officers. Abstract

ABSTRACT Hibah (grant) is a direct handover unconditionally, without self-interest. In a legal act, it is a transfer of right of a person’s property to other people free of charge, without expecting anything in return. It cannot be withdrawn except it is from parents to their children as it is stipulated in Article 212 of KHI (Compilation of the Islamic laws. The research used normative juridical research and descriptive analytic method. The primary and secondary data were gathered by conducting library research and field research and analyzed qualitatively, and the conclusion was drawn deductively. The result of the research shows that a hibah actually cannot be revoked except it has been given by parents to their children as it is embodied in the Hadist and in the KHI. The building which has been built on the hibah land will automatically be owned by the person who built it, and the land which hibah is revoked will be owned by the giver of hibah so that the building built on it becomes illegal since it has no legal basis. Judge’s consideration in the Ruling is in accordance with the prevailing regulation since he uses Hadist and the KHI in his consideration. Keywords: Hibah, Revocation of Hibah, Building

Abstract

ABSTRACT Land registration is intended to compile and provide complete information about a plot of land and give legal certainty to the holders of land rights. The system of land registration in Indonesia is a negative system which has the positive tendency in placing land rights certificate as strong evidence although it is not absolute one since there will be the possibility for its holder to be claimed by other people who feel harmed by that certificate. The objective of this thesis is to analyze the dispute between Norma Tampubolon against the Land Office of Medan and Datuk Syahrial as the certificate holder that caused the Ownership Certificate No. 327/Sukaraja, registered in the name of Datuk Syahrial to be revoked due to its administrative defect through the Supreme Court’s Ruling No. 457 K/TUN/2013. This Ruling has encouraged the writer to find out the reason(s) of the State Administrative Court to pronounce the revocation of the certificate, the legal consequence on the revoked certificate, and the legal protection for its holder. The research used descriptive analytic and juridical normative method by analyzing the prevailing and competent legal provisions to be used as the basis for solving the research problems by using information from the source persons in supporting it. The result of the research showed that administrative defect became one of the reasons why the State Administrative Court pronounced an order to revoke the certificate. Since the Supreme Court’s Ruling No. 457 K/TUN/2013 was final and conclusive, the Ownership Certificate No. 327/Sukaraja was declared revoked and withdrawn from the circulation, and its status became the state land. Besides that, in reality, the Ruling did not give any legal certainty and legal protection to the certificate holder; on the other hand, it provided legal protection for the party that was won by the Court. Abstract

ABSTRACT In the implementation of auction, there is auctioning organizational structure which in the central government it is known as Auction Administration Inspection, and the regional level the implementation and/or the Ruling on Auction  Postponement from the Court should be informed in 3 (three) days prior to auctioning implementation. From the Articles found in the Civil Code and the Compilation of the Islamic laws, it is found that those who want to make an agreement, especially loan agreement, either in Sharia Banks or in Conventional Banks, have to fulfill the basic requirements stipulated in the Civil Code. The research problems were as follows: first, how about the legal force on foreclosure sale executed by the State Loan Service Office against non-performing loan; secondly, how about the legal provisions on joint property which is auctioned; thirdly, how about the postponement of foreclosure sale by the Medan District Court in its Ruling No. 601PK/Pdt./2007. The conclusion of the research is that legal force on foreclosure sale by the State Loan Service Office against non-performing loan in the execution or the implementation of the rulings is done by coercion on the loser in litigation. Article 35 of Law No. 1/1974 regulates joint property. In general, joint property is the property which is obtained during the marriage period in which both husband and wife attempt to fulfill their needs in their wedlock. Abstract

ABSTRACT A foundation is established not for commercial or profit sake, but to help or improve people’s life prosperity.When the society has a willing to establish a social foundation with social, religious and humanitarian purposes, or which purpose is for charity instead of seeking profit, they will become the establisher, manager, and supervisor of the Foundation. The thesis uses legal certainty theory. It employs normative juridical research method with descriptive analysis and refers to the legal provisions, legal documents and books related to the research problems. A legal entity which may manage education based on the Law on SISDIKNAS is the non-profit Legal Entity which acts as the education organizer. A foundation, a association, and other similar entities which have status of legal entity, remain to organize an education unit as long as they do not violate the legal provisions which regulate non-profit legal entity. The role and function of the Foundation managers in the implementation of non-profit principle are to carry out their duties with good intention, without causing loss or negligence, with full responsibility, and to pay everyone who contributes their time, energy, and intelligence to the Foundation. Abstract

ABSTRACT Physical control on uncertified land causes dispute in society because its legal basis on the land is only a notification letter from the village head or subdistrict head. It even does not have any letter which becomes the evidence for the land physical control.The research used juridical normative and descriptive analytic method by analyzing legal provisions in land law, especially on the transfer of physical control on land through transact by using APHGR made a Notary. The result of the research shows that the legal domicile of making Notarial deed on the renunciation of rights by compensation is valid and has legal force. It is used as evidence on the transfer of physical control on uncertified land which can be used as authentic evidence to register the land in the local Land Office. The panel of judges consideration in the Supreme Court’s Ruling No. 554PK/PDT/2014 in the case of APHGR made by the Notary which is in dispute is that certified land cannot be transferred its right through an APHGR by a Notary because he only has the authority to make an APHGR on uncertified land.   Keywords: Renunciation of Rights by Compensation, Notarial Deed, Tilled Land
