Abstract

Mawah of Mudharabah is a Syariah-based economic system in Aceh. It has been developed and practiced by the Aceh community since the 16th century long before Indonesian dependence. The problems answered in this study were how Mudharabah/Mawah practice was implemented in Ingin Jaya Subdistrict, Aceh Besar District, how Mawah law in Islam is, how Mawah problem was solved when a dispute occurred in Ingin Jaya. Ta’awun (assisting) theory and ‘Urf theory, Justice theory and Mashlahat theory were the related theories used in this study. By using an empirical juridicial approach the study was conducted by meeting the study respondents and informants to interview them directly. The study found that the practice of Mawah is in accordance with the practice of Syariah Islam so called Mudharabah, a practice which is legally based on Al-Quran and Hadits. The study suggested to improve and sustain Mawah activity as it is very useful in helping the community livelihood. Keywords: Mawah, Mudharabah, Aceh

Abstract

The national institutional arbitration in Indonesia is BANI (Indonesian National Arbitration Board. The research used judicial normative and descriptive analytic method. The data were gathered by using secondary data which consisted of primary, secondary, and tertiary legal materials as the main data. The obstacles in implementing arbitration decision in settling the dispute in debt and credit in Indonesia consists of judicial obstacles which comprise the execution which cannot automatically be implemented, there is still another decision which can be made after arbitration decision, and the settlement by the arbitration board is very limited. Technical obstacles consist of the lack of arbiters, the lack of information about the existence of BANI, and the highly dominant skill of arbiters. The attempts made by BANI to cope with the obstacles are by setting up a standard for arbitration clause such as the types of problem which can be settled through arbitration, the appointment of arbitration, the prevailing legal provisions, laws, and regulation, and the publication of quarterly bulletins, either in Indonesian or in foreign languages, so that people will know and understand the existence of arbitration board with all its functions as an alternative in settling disputes in business outside of Court. Abstract

Foreign investment indicates that a motive of a company to invest its capital in a certain country is to obtain profit. The profit comes from several factors such as low workers’wage and selling raw materials for finished products.meanwhile the country which receives the capital expects the participation of of the investor to develop its national development. However it usually faces problem about the status of subsidiary company when holding company gets the facility of PMA (foreign investment). Law of investment as the legal means of foreign investment in Indonesian doesn’t clearly  regulate in detail the status of subsidiary company. This problem become the basic thinking for the researcher to conduct a research , based on judicial point of view . on the status of subsidiary company with its holding company changed to foreign investment. Abstract

Chinese ethnic group has matrilineal system which means that only the boy who has the right to inherit his parents' wealth. . But, based on the result of the research, inheritance is not only given to the boys but also to the girls which indicates that there has been the shift of understanding about their custom. The research used descriptive analytic method. The data were gathered by using library research and field research. Chinese Hainan ethnic group in Medan usually adopt children by using customary method because of their lack of knowledge of legal system on adoption in Indonesia, and there is a legal loophole in implementing the regulations practically so that there is the potential legal conflict in the future. Besides that, in Chinese Hainan ethic group in Medan there is the shift of custom in the inheritance system from matrilineal to bilateral hereditary line.     Keywords: Chinese Hainan Ethnic Group in Meda

Abstract

The overlapping of land allocation in Batam authority area began with the issuance of the Decree of the Minister of Forestry No. 173/Kpts-II/1986 on the Allocation of Forest Area in Riau Province (TGHK). The Minister of Forestry then followed up with the Decree of the Minister of Forestry No. 47/Kpts-II/1987 on the Allocation of Forest Area in Batam Island. In reality, this decree has ignored the TGHK provision. The result of the research showed that legal certainty on the overlapping of land allocation in forest area on the land of Batam indicated that the Decree No.47/Kpts-II/1987 and its certified copy was had to be ignored; therefore, the ownership management rights of Batam Authority was in effect. The legal protection for land owners in Batam Authority area was concerned with the old rights owned by villagers by setting the location of old villages in Batam under the Regional Regulation (Perda) No. 2/2004 on RT/RW (neighborhood/citizen associations) of Batam in 2004-2014. The legal protection for the land rights which were obtained based on the distribution in parts of HPL land by Batam Authority to the third party was by providing alternative land from the outside forest area. In the case of the resolution for the overlapping of land allocation of Batam Authority Management Rights, the Authority Board of the Development of Batam Industrial Area, supported by Batam Municipality Administration in 2001, lodged a request for structuring forest area in Batam Island through mechanism of changing the of forest area allocation to the Minister of Forestry. Abstract

Transfers of shares carried out in a PT is through buying and selling, there is a difference between the PT closed with PT open. PT enclosed in buying and selling shares is done by the determination of the statutes and policies determined by the shareholders. In a Limited Liability Company transfers of shares may take place silently in which the events are there is a debtor's shares have been sold without the lender without the knowledge sidebitur. Therefore, the researchers looked at the need to do further research on the transfer of ownership of shares in a limited liability company. The issues raised in this research are: first, how the transfer of rights to shares in the Company Limited. Secondly, what is the legal effect of the transferred shares secretly on limited liability. Third, how is the decision of the court on the case of the decision No. 1130 / K / Pdt / 2010. To examine the above matters, conducted research that is descriptive analysis. Method research approach is normative juridical approach. This study uses secondary data consisting of primary legal materials, legal materials and secondary legal materials tertiary. From the research, it can be concluded, first, the transfer of shares is done through a deed of transfer of rights. It is stipulated in Article 56 of Law No. 40 of 2007 on Limited Liability Company. Second, the transfer of tacit on this stock will have an impact over the ownership of shares in which an individual or other legal entity has the right and responsibility for its shares. Third, if the Board of Directors in carrying out its authority should not violate the principle of breach of trust by default in carrying out the duties and responsibilities for the care of the company, the Board of Directors may take advantage of the Law of Corporations in the United States. This concept prevents the courts in the United States to question the business decision-making by the Board of Directors, which is taken in good faith for the defense of himself when he was accounted for in the management of the company. Abstract

A right to proceed the collection of tax debt is when a tax payer/tax guarantor has some personal debts (civil), but at the same time, he also has some debts to the country (fiskus). If his assets are not sufficient to pay all his debts, the country has the rights to proceed the tax debts. Of course, in carrying out the rights to proceed towards the assets of the bankrupted-tax payers, they will face other creditors who have the same interest. Therefore, it is important to be analyzed how the decision of rights to proceed to pay the tax debts to fiskus to the tax payers stated bankrupted, how the procedures to collect tax debts to the tax payers stated bankrupted, how the obstacles in the rights to proceed the tax debts to fiskus to the tax payers stated bankrupted. Abstract

Article 22 of Law No. 1/1974 on Marriage states that “a marriage can be cancelled when the parties concerned does not fulfill the requirements for a marriage. ”When one or some of the requirements is missing, the marriage is invalid. The forgery of identity, especially of the status of the groom or bride -to-be, for getting married commonly occur today, and the incidence of forgery can happen anywhere. One of the examples about the forgery of identity in marriage which causes the cancellation by the Religions Court Class IA, Medan, is the case No. 435/Pdt.G/2013/PA.Mdn. Therefore, it is necessary to study the responsibility of P3N (Assistant Registrar of Marriages) since there is a complaint about marriage cancellation because of forgery of identity, the judge’s consideration in the Religious Court, Medan, on marriage cancellation, and legal consequence of the marriage cancellation according to the Verdict No. 435/Pdt.G/2013/PA.Mdn. PPN (Registrar of Marriages) and P3N (Assistant Registrar of Marriages) had the authority/responsibility to forestall or to cancel a marriage which did not fulfill the requirements, including the forgery of identity of groom or bride-to-be. When the P3N violated this regulation, he could be charged with criminal proceedings as the collaborator of forging of document. Legal consequences of marriage cancellation were as follows: first, the cancellation of the Book of Marriage Certificate No. 609/73/VII/2012 on July 20, 2012; secondly, there was no iddah for a wife whose marriage was cancelled; thirdly, joint property was owned by each party, the child was considered legitimate and had the right to be taken care of (hadhanah) by the father, and had the right to have guardianship and to be an heir. Abstract

Business development encouraging the increasing number of foreigners coming to Indonesia to do business has made many new changes in the practice of business law in Indonesia. In the field of law, this Memorandum of Understanding is new so the special definite regulation to regulate it is not yet available, and for this purpose, the authorized official should make law intended to enact a regulation of legislation to facilitate the life of the nation such as politics, economy and the law itself. The purpose  of this  study  was   to  analyze   1.   How  Memorandum  of Understanding is legally regulated in Indonesia if one of the parties breaches the contract during the implement process of the Memorandum of Understanding, 2. How the dispute occured due to the breach of contract found in the Memorandum of Understanding made by PT. Matahari Anugerah Perkasa and CV. Ponorogo is settled, and 3.  What legal sanctions should be imposed to the party that do not perform his/her obligations as agreed in the Memorandum of Understanding.The data for this analytical prescriptive study with empirical juridical approach were obtained through documentation study and interviewing related respondents. The data obtained were analyzed through descriptive data analysis. The conclusion drawn from the result of this study is that I. If there is a breach of contract in the Memorandum of Understanding, it is legally regulated based on the content of the Memorandum of Understanding, meaning, if the contents of the Memorandum of Understanding meet the elements found in Article 1320 of the Indonesian Civil Codes, the regulation refers to the Article 1338 of the Indonesian Civil Codes stating that it can be applied as a law for those who made the Memorandung of Understanding which means that the agreement stated in the Memorandum of Understanding has a legal power in accordance with Article 1338 paragraph (1) of the Indonesian Civil Codes. Yet, if the agreement stated in the Memorandum of Understanding was made as a letter of intent (memorandum of agreement) only, the legal sanction for it is only a moral sanction, 2. The dispute occured due to the breach of contract found in the Memorandum of Understanding made by PT. Matahari Anugerah Perkasa and CV. Ponorogo was settled by way of concensus and deliberation, and 3. The breach of contract found in the Memorandum of Understanding made by PT. Matahari Anugerah Perkasa and CV. Ponorogo requires CV. Ponorogo to pay a compensation for Rp. 500,000,000.00 (five hundred million rupiahs) to PT. Matahari Anugerah Perkasa for the breach of contract it made. Abstract

The Objective of the research was to analyze the control and the efficient use of fallow (uncultivated) land, according to the prevailing legal system, either the law which specifically regulates the control and the efficient use of fallow land or the law which is indirectly related to fallow land The research was judicial normative which used legal and conceptual approach.The result of the research showed that the authority to control fallow land was the delegation of authority in which the President delegated his authority to the Head of the National Land Board of the Republic of Indonesia to control fallow land, according to Article 17 of PP No. 11/2010. In the implementation of the control, Committee C that had the authority to identify and to study land which is indicated as fallow was established. The mechanism of controlling fallow land was through some stages: inventorying land which was allegedly fallow, identifying and studying land which was allegedly fallow, giving warning to people entitled to the land, confirming fallow land, fallow land was used to people’s interest through agrarian reform, State’s strategic program, and State’s general reserves had to be in line with Regional Layout Program.
