Abstract

Abstract Land registration in Indonesia is regulated in Article 19, paragraph (1) of Law No. 5/1960 on Basic Regulation of the Agrarian Law which states that “in order to guarantee legal certainty, the government provides land registration in all over Indonesia according to legal provisions regulated by the Government Regulation.” The research used juridical normative method, using legislation approach. It also used prescriptive analytic method, using primary, secondary, and tertiary legal materials. The result of the research In this case, PPATs and public officials in the provincial working area are not able to do their job effectively and efficiently relating to the deeds they have made. It seems that the working area extension does not enable PPATs to do their performance effectively and efficiently in providing accuracy, certainty, and the truth of authentic deeds made before them since the Indonesian territory is varied and very large. Therefore, they are not able to do their job effectively and efficiently. Keywords: Effectiveness and Efficiency, PPAT and Work Area

Abstract

ABSTRACT The sale of collateral through auction in an attempt to return the credit of PT Bank Mandiri (Persero), Tbk. The implementation of auction through the court is considered as the right method in finding legal certainty in the process of auctioning collateral between the Bank and its clients. The result of the research showed that legal provisions which give the authority to the Bank execute the collateral through the process of auction were in accordance with Law No. 4/1996 on UUHT in which there is parate execution (in the name of God the Almighty) which has the same strength as Court’s Ruling. Legal remedy of the Bank to return the whole credit through the process of auction is by asking for the credit payment in the form of collateral and personal guarantee to debtors.

Abstract

ABSTRACT Investment Contract between a cooperative and individuals is made after there is an agreement of both parties. The problem is that the cooperative management does not implement the contract (default) toward the individuals who have provided capital as borrowed capital for the cooperative so that the latter will be successful in doing its business in oil. The objective of writing the thesis with the title, “Default in Investment Contract between Cooperative and Individuals (A Case Study on the Medan District Court’s Verdict No. 469/Pdt.G/2014/PN.Mdn),” is to give the description about the form of default in implementing a contract and the form of liability of cooperative management and its legal consequences.The research used juridical normative method which processed only secondary data which consisted of laws, juridical theory, and other sources which were relevant to the theme of the research. Field research and interviews were also conducted to support the data and the theories.The result of the research showed that there were some types of default in the implementation of investment contract between cooperative and individuals who provided borrowed capital for the cooperative. Abstract

ABSTRACT Syiqaq or dispute between husband and wife in a marriage can be caused by nusyuz from the husband’s side or from the wife’s side. The result of the research shows that the incidence of syiqaq between husband and wife at Meunasah Papeun village is caused by nusyuz in the form of what has been said or infidelity. The position of the marriage during the syiqaq, according to the Islamic law, is still legitimate for the husband as long as he complies with the requirements for a marriage, while for the wife,since she is prohibited to get married again because she is still bound in a wedlockthe marriage is illegitimate. Abstract

ABSTRACT A traditional work is the result of thought or idea , Article 38 of Law No. 28/2014 on Copyright has its title, “Traditional Cultural Expression and Copyright of Unknown Inventor.”The research used juridical empirical and descriptive analytical The samples were taken by using snowball sampling technique. The result of the research showed that legal protection for the expression of traditional culture is stipulated in Law No. 28/2014 on Copyright which is based on the  of Article 38,  of Law No. 28/2014. What it means by “traditional cultural expression” is the effort of the community to protect the traditional cultural expression such as registering the Melayunese traditional marriage as one of traditional cultural expressions, increasing the quality of human resources in conserving Adat and Culture which has been a heritage from generation to generation, adjusting various customs and traditions to the age development without abandoning or changing them, continuously taking care of the Batubara Melayunese traditional marriage. The reasons why the Batubara Melayunese have not yet registered their traditional marriage are first, their ignorance about Law No. 28/20124 on Copyright; secondly, they are not legally aware of registering copyright on traditional marriage; thirdly, there is no seriousness of the Government apparatus in the registration of copyright about the traditional cultural expression of traditional marriage. Abstract

ABSTRACT As what occurs in the lease certificate according tothe Supreme Court’s Ruling No. 798 K/Pdt/2014, the signing of leasing agreement embodied in the Leasing Contract is done before Notaries in Medan. The research problems are formulated as follows: how about the validity of Leasing Contract signed by those who are not heirs, how about Notary’s liability for a leasing contract, how about juridical analysis on leasing contract signed by those who are not heirs in the Supreme Court’s Ruling No. 798 K/Pdt/2014. The research used juridical normative or doctrinal law method. Abstract

Abstract Based on Article 55, paragraph (1) of Law No. 37/2004 on Bankruptcy and Postponement of Paying off Debt, secured creditor can execute his right as if there were no bankruptcy. This provision gives him specific position to get the paying off his receivable earlier than the other creditors. However, there are also other creditors who can get their receivables as workers’ wages earlier as it is stipulated in Article 95, paragraph (4) of Law No. 13/2003 on Manpower which states that when a company is filed bankrupt or liquidated according the prevailing regulation, workers’ wages and other rights as the debt should be paid early. In this case, there is a contradiction in norms between the two articles and which creditor that should be prioritized to get his payment. Concerning Article 9 above, Pertamina workers submit judicial review to the Constitutional Court which hands down the Ruling No. 67/PUU-XI/2013. The result of the research shows that by the issuance of the Supreme Court’s Ruling No. 67/PUU-XI/2013, the position of secured creditor which used to be higher than that of workers’ wages is now under the workers’ wages. In getting their paying of their receivables as wages, now workers have their right to precede secured creditors. Keyword : Secured Creditor, Workers’ Wages

Abstract

Since 1974 the government has done the two ways, and around 2000s the government has subsidized them by using PRONA (National Agrarian Program) by giving mass certificates and strategic land dispute settlemen. The research problems are as follows: how about the implementation of PRONA in the working area of the Land Office of Padangsidimpuan, the use of PRONA, and how about the obstacles and the effort to settle them by the Land Office of Padangsidimpuan in implementing PRONA in its working area. The implementation of PRONA in Padangsidimpuan is done gradually. PRONA facilitates people to have their land certificates with simple process and the cost is guaranteed by the government. People are facilitated by the government from the process until the cost of certification. Some obstacles in land registration through PRONA are people ignorance of the regulation and their misunderstanding in its cost. It can be settled by providing counseling about its implementation with guidance and procedure of PRONA. Keywords: Land Registration, PRONA, National Land Agency
