Abstract

Adat (customary) law in Indonesia generally recognizes polygamy system among the adat sovereignties and peers in several regions. In Minangkabau, this system is known as ‘kawin batambuah’(making more wives) since adat and religion permit a man to get married with 4 women so that some people consider it as a token of pride and fame. The research was conducted in Agam District, West Sumatera, where ‘kawin batambuah’ still exists. The samples consisted of 3 subdistricts: Ampek Angkek Subdistrict, Kamang Magek Subdistrict, and Canduang Subdistrict in Agam District, taken by using random sampling technique. The result of the research shows that the implementation of ‘kawin batabuah’ is only performed in religious manner which has the impact on the children, the wives, and the joint property. The impact on the children is that they are only the children of their mother without the responsibility of the father. The impact on the wives is that they do not get any fairness since the husbands tend to love their younger wives than the old ones. The impact on the joint property is that it will belong to the wives since their husbands are only ‘sumando’/visitors to their ‘rumah gadang’ so that it is difficult to contribute the property since the marriage is based on religion. In Islam, polygamy is permitted on condition that the wives are not more than 4 although in Agam District some men have more than 4 wives. Keywords: Polygamy, Kawin Batambuah

Abstract

Seen from its form, a marriage has many varieties; but in Indonesia, a legal marriage in the Law on Marriage and in the KHI (Compilation of the Islamic Laws) is monogamy and polygamy. The research used descriptive analytic and judicial normative methods or judicial literature research. The result of the research showed that a marriage istbat filed by a wife, whose husband is a polygamist by sirri marriage, is not found in KHI which only permits a marriage istbat on condition as follows: first, the marriage occurs in the process of divorce; secondly, the marriage book is missing; thirdly, there is a doubt whether one of the marriage requirements is valid or not; fourthly, a marriage has occurred before Law No. 1/1974 was in effect; fifthly, a marriage which is done by those who have no problem with the marriage itself according to Law No. 1/1974 (according to Article 7, paragraph 3 of KHI). Abstract

Indonesian is a constitutional state, and along with its judicial development the Islamic law is included as a legal source in Indonesia, especially in the civil law. A witness in the Court plays an  important role as evidence. In the Sura Al-Baqarah, verse 282, it is stated that a witness in the Islamic Law consist of two male Moslems or one man and two women. The result of the research showed that the presence of witnesses in the Islamic law is an obligation because a witness is required to make a deed valid although in the Islamic law two female witnesses are equal to one male witness, and  if one of the is absent, people will remind them. Terms manufacture UUJN Notarial deed in accordance with the provisions of islamic law. In the Al-Quran sura Al-baqarah verse 282 there are differences that the witness of two men, and had Islam while in UUJN not so, because it was in the making of a notarial deed in UUJN not based on Islamic law. Abstract

A banking credit contract has a degree of risk. In general, the Bank as a creditor will ask for a debtor's movable and immovable property to be used as collateral in the process of giving the credit in order to secure the credit channel from the risk of nonperforming loan or the debtor is not able to pay off his loan. The research used judicial normative and descriptive analytic. It is made by using authentic deed ofPPAT (official empowered to draw up land deeds) and was registered in the Land Office where the land was located so that it has legal enforcement and legal certainty in its implementation. The consideration of the panel of judges of the Supreme Court in their Ruling No. 1842 K/Pdt/2003 was that the debtor who gave the hypothecation had committed legal act because he had given collateral obtained illegally so that the APHT was cancelled by the Court since it was legally defective and contrary to the prevailing legal provisions on Hypothecation.   Keywords : Position of Law on Creditor, Collateral, Cancelling APHT by the Court, Unauthorized Debtor

Abstract

The Agrarian law which is effective in Indonesia is based on tenure which can be proved by various tenures on land. The state’s tenure is the State’s authority to organize or to distribute authorities on land. HPL (the right to manage) which is part of the state tenure is owned by BP Kawasan and as an administrator BP Kawasan exempts Authoritative Yearly Required Money to the holder of land rights, including ownership. Actually ownership as the most powerfull and unlimited right is not required to pay UWTO, but HPL and its land management do not break up end so that they become the factor of the bound between the holder of the land rights and BP Kawasan. The land problem in Batam is only related to the overlapping land regulation but also to two authorities. BP Kawasan as the holder of HPL has the obligation to register the HPL and the authority to give and distribute parts of HPL land which is requested to become land rights throught an agreement as the basis for the applicant for the rights in registering the new land rights in order to get legal certainly. The entire land in Batam is generally controlled by BP Kawasan, but there are some parts of it which are not registered; they are known as ”kampung tua”(old village). Ideally the land rights given from HPL are affordable, but some of distributed land has been changed to ownership by increasing its right status. Abstract

The mechanism of the inheritance division of the customary communities of Aceh Utara is implemented in accordance with the results of the meetings and discussions among the heirs. When there is a dispute in distributing the inheritance, it is resolved through several steps, firstly through family meetings, secondly through Gampong (village) level, thirdly, through Mukim level (Village Union). If it cannot be resolved through meetings and discussions (customary), it will be solved by Sharia Court. Acehnese tend to divide the inheritance according to customary law than to resolve it in the Sharia Court because if a problem is resolved in the Sharia Court, it will cause a disharmony among the heirs, and it takes quite long time and high cost. The issuess raised in this study were how would the mechanism of the implementation of inheritance division be, how Islamic inheritance law influences the implementation of the customary inheritance of the communities in Northern Aceh, and why the communities in Northern Aceh tend to divide inheritance according to customary law than to resolve it in Sharia Court. It uses judicial empirical approach with descriptive analysis. The data are systematically analyzed using qualitative method, namely the analysis of which a conclusion can be drawn inductively and deductively so that solutions to the problems can be gained. Abstract

In the international level, recognition on women’s rights as human rights is rooted in the Declaration of Human Rights in 1947 and was validated by the United Nations General Assembly on November 10, 1948. Women’s rights is also found in various legal provisions, and one of them is Law No. 39/1999 on Human Rights, Law No. 1/1974 on Marriage, and Qanun No. 6/2009 on Women Empowerment ad Protection. The objective of the research was to analyze women’s rights according to Qanun No. 6/2009 on Women Empowerment and Protection which was related to Law No. 39/1999 on Human Rights. Abstract

Sales contract on land and building in cash signed by a Notary usually causes dispute because after the contract has been made the seller does not do physicall delivery on the object since he feels that the contract has not yet been made before the real offcial empowered to drow it up. In consequence, the buyer files a complaint ti the court. The problems of the reseach were as follows: how about the legal consequence of making a sales contract on certified land and building, how about the consequence of not continuing to follow up sales contract, and how about judge’s legal consideration in the supreme court’s ruling No.396 PK/Pdt/2014.
