Abstract

DOSEN PEMBIMBING:1. H. Hasballah Thaib2. Utary Maharany Barus3. Idha Aprilyana Sembiring A will is a statement written by a person who wants to give his property to someone else after he dies. It is stated in the Civil Code and KHI (Compilation of the Islamic laws) that the testator is allowed to distribute only one third of his property to protect his heir. The research used juridical normative method. The research used descriptive analytic method The result of the research, based on the Civil Code, Chapter XIII, Book Two, Article 874 until Article 912. Article 194 until Article 209 of KHI states that a Notary is required to ask the testator in a written Deed whether the property belongs to him as stipulated in Article 194, paragraph 2 of KHI, whether the other heirs have agreed, and only one third of the property which is allowed to be given as it is stipulated in Article 195, paragraph 2 of KHI. The Plaintiff has made LL binti Y, a 17 year-old girl as the Defendant III as it is stipulated in Article 330 of the Civil Code in conjunction with Article 68, paragraph 1 of KHI since she is not an adult yet. When the property is the inheritance controlled by defendants, it becomes a dispute in ownership. Based on this consideration, the plaintiff’s claim is obscure (obscuur libel); therefore, the case is not accepted (niet onvankelijke verklaart).Keywords: Notary’s Liability, Revocation of Will, Exceeding Regulation

Madiasa Ablizar Notary is a general official authorized to make authentic deeds as stipulated in the format and content based on the prevailing laws and regulations in the field of authentic deed making in general and authentic notary deeds in particular. The type of research used in this study is normative legal research. The nature of this research is analytical descriptiv. The results of the discussion of the problems that arise in this study is the arrangement of the regional notary honorary assembly in providing answers to approval at the request of investigators, public prosecutors and judges in the judicial process as stipulated in the Regulation of the Minister of Law and Human Rights Number 7 of 2016 concerning Notary Honorary Assembly. Conduct self defense where in the examination conducted by the examining body formed by the notary regional council chairman and the notary can make other legal remedies by filing an objection to the request of the investigator in the judicial process that is given by the notary honor council to the local State Administrative Court. Abstract

Hasim Purba The research used juridical normative and descriptive analytic method.Secondarydata were gathered by conducting library research and analyzed by usingqualitative data, and the conclusion was drawn deductively. The conclusion isthat the causes of the overlapping legal standing of land in the society arepsychological factor, in which people do not understand the legal aspect of landso that they do not register their land, the weakness in registering their land, theweakness in the regulation of registering their land, incomplete digital map, lackof coordination in surveying and land registering, ignorance in surveying andissuing land certificate, and lad mafia. The efforts made by BPN in forestall it isby improving the performance by controlling administration and coordinationbetween the sections and the village management, and recording registeredcertificatesinto digital maps. The people should participate actively in protectingtheir land by maintaining and installing boundary markers on their land andrecording any legal acts on their land.Keywords: Land, Revocation, Legal Standing, Overlapping

Abstract

In practice, a covernote is made by a reliable Notary/PPAT in disbursingfunds in a credit contract. Covernote is not regulated in the Notarial Act ad in theGovernment Regulation on PPAT, or in the Law on Banking. The researchproblems are how about the authority of a Notary/PPAT to issue covernote for theinterest of stakeholders in a credit contract, how about the legal certainty ofcovernote issued by a Notary/PPAT to disburse credit in banking credittransaction, and how about the liability for a Notary and debtor when theNotary/PPAT cannot settle the case of the Hypothecation on time specified in thecovernote.The research used juridical normative and descriptive analytic method.Primary data were gathered by conducting interviews, secondary data wereobtained from Law No. 30/2004 on Notarial Position, Law No. 4/1996 onHypothecation, PP No. 37/1998 on the Regulation on the Position of the OfficialEmpowered to Draw Up Land Deeds, law No. 7/1992 on Banking, and Law No.10/1998 on the Amendment of Law No. 7/1992 on Banking. SaidinIn order to provide the insurance of legal certainty and protection for people’s land justly and equally, and to encourage national economic growth and people’s economy in particular, it is necessary to conduct accelerated complete land registration in all parts of the Republic of Indonesia. PTSL (Complete Systematic Land Registration) is a program conducted by the Ministry of Agrarian Affairs and Spatial Planning/ Head of Indonesian National Land Office to increase the number of land registration and certificate issuance in Indonesia. The conduct of this program is stipulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/ Head of Indonesian National Land Office No. 6/2018 on Complete Systematic Land Registration. In practice, there are some obstacles encountered in its implementation; thus, some field target planning in a region cannot be achieved. The research discusses the legal regulations of the conduct of accelerated PTSL, PTSL as accelerated land registration, and its implementation in Medan.Keywords: Land Registration, Complete Systematic Land Registration, Policy and Solution

The capacity and the authority to do the transfer are in the hand of a profession/position which is known in the Indonesian law as PPAT (Officials Empowered to Draw up Land Deeds) who have the authority to draw up authentic deeds in Land Title or Apartment Ownership. This profession does not belong to the position in the State’s structure but it is an independent profession. It means that the position of a PPAT does not depend on any party and even on the State. In doing his job, a PPAT obtains earnings/fee based on the products he has yielded, authentic deeds.The deed of a PPAT is made as evidence that a certain legal act has been carried out concerning Land Title and Apartment Ownership. One of types of Deed made before a PPAT is Sale & Purchase Contract. Buy and sell are an agreement in which a party binds himself to submit a certain thing and the other party pays for it. Sale & Purchase contract made before a PPAT is the formulation from the parties which is embodied in it. In the transaction, the delivery of goods and its payment are done transparently and in cash. Therefore, the goods which will be delivered, along with the price are mentioned in the Deed so that in the formulation of the Sale & Purchase contract, a PPAT is required to use prudential principles in embodying the willingness of the parties to the Deed in order to be protected against any claim from the authorities.Keywords: Officials Empowered Draw up Land Deeds, Authentic Deed, Sale & Purchase

SaidinAdoption is a legal act which transfers a child from their parents’ authority, legal guardian, or other people who are liable for their caring, education and raising the child in to an adopted family. It is no longer a strange thing in today’s Indonesian society because adopting child has been frequently done in Indonesia.The results of the research demonstrate that the factors that encourage child adoption in Mandailing community in Panyabungan Utara Subdistrict is to pass on and maintain a lineage of the family who does not have any biological child, to maintain marital bond so that a divorce can be prevented. However, the motivation of child adoption has been developed today; it is now done to provide the adopted child prosperity.Keywords: Adopted Child, Position, Customary Law of Mandailing
