Abstract

Keizerina Devi A, SH, CN, MHumPeople’s economic difficulties today force them to need more budget to fulfill theirlife necessities. They can either apply for a loan to banks or other financial institutions.Due to its complicated procedures, difficult requirements, and particular collateral, pawnservice becomes an alternative. The most frequently pawned goods is gold because it is apromising investment goods. The research problems are about the status of all parties inthe financing using pawned gold in public and private pawnshops, legal liabilities of thecreditor if the pawned goods are lost or broken, and the legal liabilities of debtor ifownership of the pawned gold is illegal.The results of the research demonstrate that, regarding the legal status of allparties in which there is a borrower i.e. the debtor and a pawn broker i.e. the creditor, allparties have equal rights and obligations that they have to fulfill in order to run the goldpawning process well without any obstacles. The legal liabilities for the gold which ispawned, lost, or broken, is that the creditor is responsible to compensate all loss that hasbeen intentionally and unintentionally caused, since pawned goods are not theresponsibilities of the debtor. Regarding the legal liabilities of the debtor, if the pawnedgoods are proven to be illegally possessed, is that the debtor has to be responsible for allloss endured by the real owner and the creditor who provided the financing.Keywords : Gadai Emas, Jaminan Emas, Pembiayaan Gadai

Abstract

Dr. Jelly Leviza, SH, MHumGeographical indication is a sign indicating the origin of goods and/or products due to their geographical environments including the nature, man, or the combination of both which contribute to reputation, quality and particular characteristics of the goods and or products produced. The goals of the protection for geographical indication are to protect the specialization from replicating or misusing, to provide a chance and protection for local people to produce typical products to obtain maximum advantage, to benefit the consumers because the quality of products is guaranteed. This is an empirical normative judicial research with analytical descriptive. The result demonstrates that there are some agricultural products which are potentialto be regiostered as geographical indications in Aceh Province. The causative factor of why potential products for geographical indications are not yet registered is because the local people do not have a legal awareness, minimum fund, nonexistent of forum for society who care to protect and register the commodities, lack of requirements for geographical indication, and lack of cooperation among local people producing the products to be registered. Government of Aceh Province keeps on providing legal protection to protect the existing agriculutural products either the ones which indicate potential to be registered as geographical indication or the ones which have been registered.Keyword: Agricultural Product, Geographical Indication

Abstract

Law No 11/2008 on Electronic Information and Transaction (UUITE) gives anopportunity for the realization the concept of making Deeds by using technology withconference video. The research problems were how about legal certainty of a Notary’sauthority in making a deed through conference video, how about the validity of the personsappearing in the process of making a notarial deed through conference video, and howabout legal remedy in the implementation of making a deed deed through conference video.The research used juridical normative using secondary data and supported by interviews.Making adeed by using technlogy with conferencevideo is difficult to be implemented sincesome of these regulations are contrary to UUJN (Notarial Act) and the clauses in the UUKNrequire the persons appearing and the signing of the deeds. The exception is the Minutes ofRUPS which uses conference video stipulated in Article 77, paragraph 1 of UUPT and itsimplementation process is supported by UUITE. Meanwhile, there is no clear regulation onthe making of authentic deeds by technology. However, the validity of the persons appearingin the making deeds through conference video is possible viewed from Article 5 of UUITEwhich recognizes the validity of electronic information and electronic documents throughconference video. The legal force of the persons appearing in making deeds throughconference video, in law of civil procedure, is legal evidence since it has met material andformal requirements.Keywords: Notary, Technology, Conference Video
