Abstract

Based on Article 21 of UUKUP, the State has the authority to dun tax early although hypothecation is attached on the confiscated object so that the position of creditor as the hypothecation holder who has preference right on debtor’s debt is weak. The research used judicial normative and statute approach. The result of the research showed that collateral with hypothecation on it confiscated by the State will not eliminate its droit de suite of the collateral according to Article 7 of UUHT which states that hypothecation will not end although it is transferred to another party (in this case it is confiscated by Tax Office). By the binding of hypothecation, the authority on the collateral is transferred to creditor to execute it when debtor is not able to pay off his debt. The right of the collateral owner will be returned when hypothecation is cancelled because the loan has been paid off. Keywords: Hypothecation Protection, Taxes Payable, Collateral

Abstract

An instrument witness has to give his testimony correctly according to what he has witnessed during the reading of a deed in the court’s proceedings about the true legal act in the deed, the presence of litigants, and their identity. The research used judicial normative method with legal statute approach. The result of the research showed that the presence of a witness is the principal prerequisite to make the deed authentic. A witness’ position is very important in a notarial affair, and he gets protection in giving his testimony about a deed with legal problem. Law No. 31/2014 on the amendment of Law No. 13/2006 on Protection for Witness and Victim gives legal protection for witness during his testimony in the proceedings. Abstract

Another creditor is a requirement to be met by an applicant who applies for bankruptcy before a court; it is a requirement stipulated in Article 2 paragraph (1) of the UUKPKPU (the Law on Bankruptcy and Suspension of Obligation for Debt Payment) which obliges the presence of two or more other creditors in applying for bankruptcy. In the development of bankruptcy cases, the other creditor occasionally refuses and objects to the debtor’s bankruptcy. The research used normative judicial method which was descriptive. An appeal by the other creditor who was not one of the parties involved in the first level court reflected a position equity between the other creditor and the bankruptcy applicant (the debtor themselves or the creditor) who were involved in the first level court. Abstract

Serdang Bedagai Regency is one of the areas in North Sumatera Province which has the area of 1,900.22 km2, consisting of 17 subdistricts and 243 villages with the population of 602,522. It is one of village rice barns in North Sumatera Province, and its rice production is increasing each year and has the potency for developing agribusiness, but in 2015 it decreased because agricultural land area became less and less. In 2010 it was 41,057 hectares, but in the period of 2011-2015 it decreased drastically to 38,502 hectares which decreased 2,555 hectares or 16% within 5 years; this was because it was shifted its function to residential or industrial land. The research problems were whether there was the acceleration of agricultural land transfer to residential land, how about the impact of agricultural land transfer to residential land, and how about the role of Government in coping with the acceleration of agricultural land transfer to residential land in Serdang Bedagai Regency. Abstract

Credit contract occurs when someone needs fund and it is provided by a creditor in a form of a contract. It is closely related to collateral since every credit needs security on the fund which is borrowed. The insurance of the reimbursement is indicated by collateral in mortgaging a debtor’s property for the reimbursement. If the debtor cannot pay off this debt, the collateral cannot be directly transferred to the creditor. The research used descriptive analytic and judicial normative method. The conclution of the study was that the legality of the result of PHGR is legally null and void. Its legal consequence is because its settlement is not certain since the MPD (Regional Supervisory Council) of Medan did not get any report from the parties concerned of this case. It is recommended that Notaries have prudential principles, more prudent, moral and ethics. The MPD of Medan should be more careful in examining and controlling which are reported by Notaries each month. Abstract

The Karonese who domicile in Karo Regency have their customary legal system which concept of settling the problem in the form of ‘runggun’ did not work as negotiation for consensus principality. It is occurs as a result of still many complaints about the disputes of the inheritance of adat land in the Kabanjahe District Court. The research used judicial normative method, supported by field study. The enabling factors of the dispute in inheritance of adat land which was settled in the Kabanjahe District Court were as follows: the dispute could not be settled by ‘runggun’, the lack of trust in the decision in ‘runggun’, and the need for legal legitimacy on the dispute settlement. The Kabanjahe District Court provides the settlement by mediation and in the form of verdict and both of them are used by the Karonese community although the latter is commonly used. It is occured by the obstacles faced by the Kabanjahe District Court which consist of two problems; external obstacles comprise the participation of the conflicting parties and their attorneys, laws, and the lack of socialization about law on land and land registration. Abstract

Shipping agreement with PT Anugerah Semesta Persada was made verbally. PT Anugerah Semesta Persada used verbal agreement because not only it acted on behalf of the consigner, but also as the expediter that directly connected with the shipping agency. It was the accountability of PT Anugerah Semesta Persada that the customer incurred loss in the shipping agreement because of the very limited availability of air freight transportation. PT Anugerah Semesta Persada was accountable for the compensation due to its fault to pay the highest price of the goods. It had not paid the compensation for the transport cost that had been expended by the consigner .The legal protection for the consumers that incur loss in the goods shipping agreement with PT Anugerah Semesta Persada is regulated in the legal provisions regarding freightage either preventively or repressively. Abstract

In any society, a hibah (grant) is not uncommon; it is done by a person as the realization of his freedom to organize his property. However, it is necessary to know that has its own rule which has to be obeyed. A grant which violates legitime portie (legitimate portion) of another legitimaris (heir) will cause revocation. Therefore, it is necessary to study the organization of a grant and a grant by will in the Civil Code, how about the legal consequence of giving a grant which violates legitimate portion of a heir by a testator, and whether judge’s consideration and Ruling No. 188/Pdt.G/2013/PN.Smg on giving a grant of the whole inheritance which violates legitimate portion of a heir are correct. Abstract

The problems of the research were what were the Judge’ considerations in settling the case in the Verdict of the PK (Judicial Review) No. 37 PK/TUN/2013, how the legal efforts of PT. Pelabuhan Indonesia I, and how the execution of the Verdict of the PK No.37 PK/TUN/2013 was. In order to find the answers to the problems, this research was descriptive analytical. The Judge’s considerations in the Verdict of the PK No.37 PK/TUN/2013 regarding the annulment and revocation of the certificate was in line with the procedure. The legal efforts that could be made by PT. Pelindo I (Persero) was applying for the establishment that the invalidation was nonexecutable, making remeasurement of the land and making resistance. The Verdict of PK No. 37 PK/TUN/2013 regarding the annulment and revocation of the certificate of Management Rights No.1/1993 belonging to PT.Pelindo I (Persero) could not be executed (non-executable).
