Abstract

The parate execution can be really cancelled if there is a lawsuit from the third party on the plan for the implementation of foreclosure sale as stipulated in Article 27, point c of the Decree of the Minister of Finance No.93/PMK.06/2010 on the Operational Manual of Auction, this condition is also experienced by PT. Bank Sumut in the implementation of parate execution. The research used judicial normative and descriptive analytic methods. The regulation on the implementation of parate execution of collateral in the Indonesian legal provision is still based on Article 224 of HIR and Article 258 RBg. The obstacle in the implementation of parate execution of collateral at PT. Bank Sumut comes from substantial aspect, the structural aspect and legal cultural aspect. The Ruling of the Medan District Court No.167/Pdt.G/2013/PN.Mdn juncto the Ruling of the Higher Court of Medan No.270/PDT/2014/PT-MDN states that PT Bank Sumut does not violate law. Abstract

Illegal act done by a Notary in writing a deed is contrary to legal norms an, therefore, it is against law which regulates a Notary’s authority, obligation, and prohibition in writing a deed according to Article 84 and Article 85 of UUJN. The offences are illegal act, victim that suffers a loss, violation against law, and causal relation between loss and wrong doing. A Notary’s liability for what he has done is the consequence and punishment upon him. He will be liable for civil case, criminal case, position, code of ethics, and State’s administration. His letter of appointment issued by the Minister of Law and Human Rights can be revoked and can be dismissed. The effort to prevent from illegal act by a Notary is the supervision and fostering by the Minister on a Notary by establishing Notarial Supervisory Council and supervision and fostering by Notarial association, INI (Indonesian Notarial Association) by establishing Review Board. Abstract

Inheritance problem will be experienced by most people if one of them dies; therefore, inheritance law is very important for human beings, especially heirs since it is related to the heirs’ survival and needs. Inheritance Law includes three components: the property, the testator, and the heir who receives the transfer or the distribution of inheritance. Besides that, inheritance exists because of death, inheritance by will, and inheritance without will. The problem will exist when there is a delay in distributing inheritance. The research problems were the position of heir in the Inheritance law in Indonesia and how about writing inheritance right certificate. The research used descriptive analytic method with the approach or approval of transferring inheritance. Secondary data were gathered by compiling primary, secondary, and tertiary legal materials. Abstract

The result of the research showed that the position of the Bank and the clients in a credit contract is never in balance. The reason of PT Bank Mandiri for applying the requirement for Single Banker in giving credit to debtors is merely to apply prudential principle. The legal consequence of its implementation of applying the requirement for Single Banker in credit contract of PT Bank Mandiri, Tbk related to the Law on Hypothecation is that it will be legally null and void because it is contrary to Law No. 4/1996 on Hypothecation. In practice, however, a credit contract is never legally null and void because of applying the requirement for Single Banker since it is generally practiced by the banks in Indonesia. It is recommended that Bank Indonesia as the establisher and supervisor of the National Banking standardize the content of credit contract of each bank operating in Indonesia by paying attention to the balance in right between a debtor and a bank. In order to make it balanced and righteous in the obligation of creditor and debtor, before signing the credit contract, both parties should understand its content so that the right and obligation of clients can be completely understood. Abstract

Nowadays a land title, possessed simultaneously by two different persons or corporations, is frequently found so that all construction work has to be stopped and abandoned because until the land title is certain, it will remain a conflict. The conflict is resulted from both owners who acknowledge having the proof of the title of a same plot of land. Such conflict can be observed in a case mentioned in the the Supreme Court’s Ruling No.189 PK/PDT/2009. The research was a descriptive analysis using judicial normative method or legal library research. The role of the Judge in settling the case of the land title validity was to carry out his function and authority honestly and fairly, in which he had to be able to interpret the prevailing law actually and he also had to be brave to create a new law as a legal form. Based on the Judge’ consideration in the Verdict No.189 PK/PDT/2009, it was pronounced that SHM 6036 Cilandak was void because SHM 897/Cilandak had been transferred in Deed 16 and Deed 17. SHM 897 was taken by the owner. It was manipulated to be declared missing, reported to the Police and requested to be reissued with a new SHM.. Consequently, by the objection of the Judge of the Supreme Court in the Ruling No.189 PK/PDT/2009, the Title Certificate No. 6036/Cilandak possessed by the claimant was annulled and he lost his right over the land. The significance of the Verdict on the defendant was that the Certificate No.897/Cilandak possessed by the defendant was pronounced valid and he has the right to occupy and own the land. Abstract

The research problems were how the implementation of inheritance distribution customarily in Angkola community in Tapanuli Selatan Regency, how about the role of adat council if there was a dispute in distributing inheritance in  Angkola community, Tapanuli Selatan Regency, and how about legal force of dispute settlement in inheritance according to the Adat Arbitration Council in Angkola community in Tapanuli Selatan RegencyThe implementation of inheritance law in Angkola community, Tapanuli Selatan Regency originally used inheritance law by adat which states only a boy who has the right on inheritance from his parents while a girl does not. She is usually get the property as a gift (Holong Ate), the giving of moveable and immoveable property. However, after the coming of Islam to South Tapanuli the inheritance law changed, especially in those who became Moslems. The Angkola Moslems are subject to the Islamic Inheritance Law: 2 portion for a boy and 1 portion for a girl. Abstract

In the regulation on merger in Indonesia, a company that wants to merge is a corporation. Therefore, a company which is not a corporation does not comply with the regulation on merger as stipulated in Law No. 40/2007 on Corporation and Implementation. Merger of corporations on employees has positive and negative impacts. The positive impact of the merger of corporations is that the worker still work and reemployed so that they will get better wages and can work for the merging corporation. The negative impact of the merger of corporations is that the corporation dismisses its employees by only give them severance pay, money for the length of service, and compensation. The type of protection for the employees who are reemployed is that the merging corporation has to accept the transfer of all rights and obligation from the corporation that wants to merge, including the rights and obligation of the employees since they must not be harmed. It depends on whether they voluntarily quit from their job or they do not want to work for the merging corporations. Employees have the right to get severance pay, money for the length of service, and compensation. Theory of justice by Jhon Rawls states that the type of protection for employees is not fair due to efficiency and merger for the sake of the advantage of a certain number of people who harm other people (employees) like the rule which regulates the dismissal of employees. Abstract

Land plays an important position for the Indonesian people in general and for farmers in the rural area in particular because it constitutes their main source of life and earnings. The research used judicial normative and descriptive analytic method. The result of the research showed that land transact based on land certificate issued by a village head was valid and has legal force. However, after the land transact based on the land certificate issued by the village head, the buyer has to register the land in the Land Office where it is located. Abstract

Go public is one of the choices to the companies that will need additional capital to run and develop their business activities. However, when the benefit of going public is no longer effective to the companies, they will prefer to go private, which is an action of open limited liability companies to switch their status by eliminating their stock notes in the stock exchange. As one of the capital market supporting professional, a notary also takes part in either the implementation of go public or go private. The capital market notary should possess the knowledge of capital market and has registered himself/herself to the Financial Service Authority. Notary plays a role in the articles of association of each capital market person and the making of important deeds such as agreements of investment fund, emission guaranty, and trustee.
